Raped by the police

So, whatever happened to "keep your laws off my body" anyway? And how does the so-called "War on Drugs" permit the police to rape innocent civilians?
1.  David Eckert, regular Joe Shmo, finishes up his shopping at Walmart, and then neglects to come to a complete stop at a stop sign pulling out of the parking lot.  Cop stops him.

2.  Cop observes David Eckert seemingly clenching his butt cheeks.  Decides that's probable cause to suspect Eckert is hiding drugs in his butt.  He detains Eckert and obtains search warrant to allow for an anal cavity search.

3.  Cop takes Eckert to ER.  Doc there refuses to do cavity search citing it's "unethical."

4.  Other medical center is all, "Sure!  We'll happily anally probe him!"  Eckert is admitted.  And then the real fun begins.
  • Eckert's abdomen is x-rayed.  No drugs.
  • Eckert's anus is probed.  No drugs.
  • Eckert's anus is probed again.  Still no drugs.
  • Eckert is given an enema, and forced to crap in front of docs and police.  His stool is searched.  No drugs.
  • A second enema is given.  Same deal.  No drugs.
  • A third enema is given.  Again, no drugs.
  • Docs perform another x-ray.  No drugs.
  • Eckert is sedated, and a freaking COLONOSCOPY is performed.  NO FREAKING DRUGS.
At no time during any of this did Eckert agree or give consent.  In fact, he protested throughout, as well he should have.
And it turns out he wasn't the only man raped by the police. "Our investigation reveals another chapter. Another man, another minor traffic violation, another incident with Leo the K-9 and another example of the violation of a man's body.
Police reports state deputies stopped Timothy Young because he turned without putting his blinker on."

Ladies and gentlemen, the land of the free....

Questions for those with more knowledge than myself:

When a cop calls a judge to get a warrant, is "probable cause" all he needs to say, or does he actually have to give more details?

Anonymous Salt November 06, 2013 3:55 PM

The warrant was executed outside of its jurisdiction and past its executable time. The judge who issued it should also be ridiculed.

The second hospital should be sued for malpractice at the very least. Performing procedures over the protest of the victim....

There was a time when I thought police were actually to be trusted in general. Now it is more like evaluating them to determine whether they are just a member of the biggest gang around or actually an upholder of the law.

Anonymous Horace Staccato November 06, 2013 4:03 PM

Cops are simply reflecting the fact that they have been hired and trained by Leftist bureaucrats. Leftists are essentially physical cowards. Their "no tolerance" stance is presented as a courageous stand against whatever outrages them, but really it's just a rationalization for panic and bullying; both characteristic of bratty Leftists. Cops have now been trained to act like panicky Leftist twits. AND you will note that they have been taught to treat law-abiding White people as if they are saggy-pants nonWhite gangbangers. This is a typical denial of reality in the service of the evil Leftist narrative.

The police have become a perfect reflection of that gang of Leftist thugs currently destroying their own civilization; a gang of thugs epitomized by that effeminate, affirmative-action parasite currently defiling the White House.

But that was a man with a spine and judgment. Nowdays cops follow policy which protects them and the department from being sued since judgement and thought are no longer required. I'm wondering, if this is policy is it standard policy in many departments? If so, it's gotta be changed.

Just like how cops are illegally taking video evidence at any scene to hide their crimes, I fear the day when people are taken into custody and never seen again.

Think of how easy it would be for this person to have just disappeared after he was found to be innocent. Instead of risking their cushy gov jobs by allowing him to tell his story, he could have been dumped into the woods and never seen again. The only thing stopping it is the morality of the witnesses (doctors and nurses that know what went on in the clinic), once that is gone.....

Blogger swiftfoxmark2 November 06, 2013 5:02 PM

Please tell me this is illegal and the guy has recourse ...

It was illegal, largely because the search warrant had expired by the time they started administering enemas. Also, the search warrant was executed improperly as they had to go to another county in order to find a doctor.

As for recourse, there is none. A judge will probably dismiss any charges brought to the cops and a jury will find in favor of the defendants in the civil case.

So no recourse in the legal realm. Of course, if you want to go by God's law, then those officers and doctors should be stoned.

Anonymous ENthePeasant November 06, 2013 5:07 PM

At what exact point then, should one resist? When one's belt is taken away? When one is ordered to face into a corner? When one crosses the threshold of one's home? An arrest consists of a series of incidental irrelevancies, of a multitude of things that do not matter, and there seems no point in arguing about any one of them individually - especially at a time when the thoughts of the person arrested are wrapped tightly about the big question: "What for?" - and yet all these incidental irrelevancies taken together implacably constitute the arrest. A. Solzhenitsyn, "The Gulag Archipelago."

The police aren't even worried about the bad press - all these incidental irrelevancies - nothing happening here, on your way...what they want, as AS also wrote about, are passive rabbits - perfect prey for the wolves.

Fair enough. But upon learning what the pigs did, I would expect an honest judge to hold them in contempt of court. I have no idea what the limits are in terms of jail time or fines for contempt of court. But the judge should give each officer the maximum of both.

That would be in addition to any penalties from criminal or civil proceedings.

Of course we all know that the judge is not an honest one, that criminal charges will never be filed, and that at best a civil trial will punish the taxpayer.

I read from the statement by Ekert’s attorney “Hispanic officers may have targeted 'white boy' because they 'don't like him living in their community”, to be an indication that the La Raza faction is asserting themselves, now that they are in positions of authority. The additional factor being the latest news of Timothy Young, if this is him, he sure looks like a ‘white boy’ to me (https://plus.google.com/100794896249600524692/posts). I fear the day when it is commonplace for people to be taken into custody and never seen again.

I don't think it takes much of a stretch of the mind to see how the State might have an interest in Mr. Eckworth's story never being told. Get the right minded doctors and nurses that depend on the state for survival and.... "Nope, no Eckworth was here last night, might want to check over at Deming, they probably took him there".

Its largely irrelevant. We've seen quite an example of what the police do when they start getting targeted at home. They quit. They leave. Just like all bullies. Punch them back and they fold.

Something you know a little about eh?

Regardless... it will be very much like the shooting rampages. its unthinkable. Until it happens. Then it isn't unthinkable at all. Then it happens more and more... and you wonder how anyone could be dumb enough to think it was unthinkable in the first place.

Maybe americans... maybe mexican cartels... maybe MS-13... it doesn't matter.

Especially libertarians. They never have anything to fight for at all but their own selves - and this militates against them fighting at all.

Again with the "you have no society without us" crap.

You do not know squat about "society", civilServant. Your myopic vision of what people think of when they think of society limits your imagination. You've constructed a castle in the clouds in your mind with only one possible direction things can go, and that blinds you to the fact that that direction doesn't work.

Your policotopia won't happen. It might not be replaced by an Ayn Rand-esque society. It might be replaced by any number of farily ugly, thuggish realities instead. In fact, lots of folks figure it will be replaced by more than one new society and some of them will probably be unpleasant one way or another.

But what we have now is on it's last legs.

False.

First they will turn their violence against the white police. and anyone else that directly interferes in their drug business.

After that... certainly there will be all manner of violence.

"Especially libertarians. They never have anything to fight for at all but their own selves - and this militates against them fighting at all."

Wishful thinking but also irrelevant in the larger scheme. I'm guessing that the sodomized gentleman in question isn't a libertarian nor are 99 percent of the people on the internet who are outraged by this incident. In fact the leftists are only dangerous so much as they can convince others to do their dirty work like these two bullies passing as cops. I've known a lot of men in my life who have done, and some are still doing, dirty work. None of them would be supportive of the police position and a lot of them would not let this pass. I suspect the sodomized in this case was a bit of a gamma and was doing everything peacefully possible to appease them... which was impossible because like all physical cowards, which most bureaucrats are from my experience, they were excited by his begging. What I've noticed is the talk is turning in two directions: Resistance and separation. Civil Servants are dismissing this of course (they're out of a fucking job once that starts, not to mention the sodomy will be on the other foot, so to speak) but as often happens in life people have to grow to the idea. One thing cops never take into account is that the general public, to include criminals, mostly gives them a pass and assumed they are just trying to do an honest days work. Once that belief goes away so does their position as morally superior men. Besides, there's a lot of Libertarians like me who understand that eventually one has no choice to but to fight back. Bottom line is you're missing the point... and BTW, you should arm yourself and save some money.

I am not insulated from danger.. but I am insulated from certain types of threats. MS-13 has no presence here for example... therefore they are very low on the threat list.

But I don't like the term insulated at all. I prefer the term.. prepared. and by prepared... I mean I have many many plans that are executable. Not merely a primary and a back up... but many... many more.

You say you always carry so, I'm going to assume you have a state issued license too. Look up your state statutes but, most states with carry laws have statutes in place for use of, up to and including, deadly force if you feel the officer is using excessive force.

The media don't typically cover it, but legally justified killings of on-duty cops do happen, and I remember cases of grand juries refusing to indict. Still, your chances of being wrongfully convicted if you do find yourself in that situation are probably very high.

That aside, for the most part, police in this state are really cool about the concealed weapon. As evidenced by the half dozen times I've been stopped and they could care less if I had a firearm in the car (CHL holders rarely give them any problems). Almost all CHL holders here will tell you the same thing.

"Your cop buddy couldn't have been talking about shooting a cop in self-defense."

Correct, he didn't know. He was talking about your everyday Joe. The statute I'm talking about specifically targets police officers on top of the already existing state firearms statutes and constitutional rights. They wouldn't have made the statute without seeing a need for it. I do agree that it would be VERY hard to defend.

evidently, the dogs have to do regular recerts. this dog's cert expired last year. so it would appear that the dog HAD been used regularly as a K9 ( there was also talk of previous false alerts by this dog ) and the officer / dept just hadn't bothered to go back for the refresher course. this info was in one of the first articles linked.

proper recerting is one of the things that it's easy for sloppy people to let slide, that doesn't really mean anything, but that will get their ass reamed if they face a decent lawyer in court.

of coure, proper certification has nothing to do with the issue of whether or not the dog has also been trained to 'false alert' on command.

And that effort, believe it or not, is really the most valid form of struggle of all. In the end we cannot guarantee outcomes. But we can guarantee effort.

Revolutions are never made up of a majority of the population. They're often just the men too fucking ashamed to be pushed around by any more by the Stay-puft man. Bi-directional contempt is a good recipe for 3kfps.

A good example of reaping what you sow. If it's convenient, for various reasons, to allow uncharismatic or nonsocial children to be tortured and molested by their so-called peers, by allowing it, society has abandoned the principle that such thing shouldn't be allowed. Once you've abandoned that principle in the case of unpopular people, you've given up the best argument against not allowing it in the case of other people, as well. Including yourself, at some point in the future.

The problem is, the increasingly tacit assumption nowadays is that a person's body belongs not to themselves, but to the government. Thus, it is not 'rape' or even 'child molesting' if the government decides that it is fine. However, even if the person gives their consent, it is 'rape' or 'child molesting', if the government decides for whatever arbitrary reason that it is not fine.

Grow up, Ann. It's pathetic that you are STILL whining about how people were mean to you at school. Do you still not understand that part of why they were mean to you is because you are obnoxious and seriously overrate your intelligence?

Get over it already.

Game on....cops put themselves in this predicament. Yes, dancing on their graves is justified. When one dies, so what? All the murders they have covered up...and they think they wear the white hats. No. You pathetic braindead pension worshiping cops, you are in the sights of all Constitutional freedom loving individuals. You better pick your side soon.

Make sure to yell this statement at the top of your lungs when your precious daughter is brutally assaulted by a vibrant or that your house is ransacked by shit colored cretins (right, Scoob).

How, exactly, are cops going to prevent this from happening? Especially if they're out playing anal-probe-meter-maid?

Anonymous Stilicho November 07, 2013 6:50 AM

This is the doctor.

This is a completely new take on the "anal probe by aliens" phenomenon.

Was Roswell (also NM, by the way) just a traffic stop gone wrong?

Anonymous Loki Sjalfsainn November 07, 2013 7:27 AM

certainly didn't take them centuries.

I can't make you intelligent, either.

i think you might be more convincing if you didn't spend so much time clenching your butt cheeks around Thor's big hammer.

Yet another one with deviant fantasies about me. I am not surprised.

Blogger Nate November 07, 2013 8:10 AM

"If he's registered CCW with the state, then the cop will know that, at some point during the traffic stop"

Actually that's not true. Most states data bases are not nearly as well executed as you people assume they are.

The vast majority of the time the cop will have no idea you have a ccw unless you hand it to him.

Anonymous Tallen November 07, 2013 9:10 AM

Make sure to yell [that cops are all thugs with badges] at the top of your lungs when your precious daughter is brutally assaulted by a vibrant or that your house is ransacked by shit colored cretins....

As noted by others, the cops will only be a cleanup crew in the former scenario. If stopping the rape will, as is likely, entail at the very least display of a weapon, they have to be called, but only because of how the system treats these sorts of things (and has to if anyone is shot). If not, you and your daughter will have to weigh the risks of not having the police-judicial complex pursue that "vibrant" vs. the can't calculate ahead of time costs and risks of involving the complex at all. That's no longer clear cut.

In the latter, it's becoming an open question if you should even involve the cops at any point. This is something I thought about lately: when is the risk of involving the cops to get a police report for a claim to your insurance company worth it? I decided the loss would have to be pretty high, I have to consider it to be an implicit deductible.

Brings a whole new meaning to turning the other cheek. They do it because they know that for the most part, that they can get away with it. Until men start taking these matters into their own hand and making these cops pay with their lives, it will continue and get progressively worse. Instead of seeing dollar signs, men need to start seeing vengeance.

Ah, Loki, so good to see you still going up and down in the world, and to and fro in it, seeking what mischief as you may. I must admit that of all of the comments I've read on VD's estimable weblog, yours and Stickwick's are the ones I've enjoyed the most. But I must confess that, as regards your postings, I've always had something of a weakness for personae who take on superhuman and daemonic roles, from C.S. Lewis' Screwtape, through Sax Rohmer's Dr. Fu Manchu, all the way down to the 'Cthulhu for President' postings (as perhaps can be seen from my chosen 'avatar').

I have one question for you, though, my dread lord: Isn't the cognitive dissonance between your secret identity and your demigod nature beginning to get get to be a bit much? After all, the Lady Sigyn seems in her latest postings to be swearing fealty to the Abrahamic God and the pale Galilean. How long will you put up with this divine cuckoldry?

Anonymous Loki Sjalfsainn November 07, 2013 2:09 PM

After all, the Lady Sigyn seems in her latest postings to be swearing fealty to the Abrahamic God and the pale Galilean.

As much as I should like to divest her of this fealty, I countenance it. It appears to form the foundation of her loyalty to me.

That loyalty has been tested and proven. I do not grant you to ask how.

Blogger Bernard Brandt November 07, 2013 2:38 PM

That loyalty has been tested and proven. I do not grant you to ask how.

I would not wish inquire as to the loyalty or honor of a woman, far less the fair Lady Sigyn, who by many of her postings has already shown herself to be 'a woman of wisdom and virtue, to be far prized above rubies.' While I might inquire as to your worthiness to have her, I fear that I am not that interested in the personal lives of demigods.

But I am afraid, my dear lord, that until and unless you are in a position to exercise your vaunted dominion over me, you fail to have the means to grant or to withhold anything to or from me.

Which pretty much makes my point. You obviously find it acceptable for children to be sexually molested, if you happen to find them 'obnoxious'. Once that principle is accepted, pretty much anyone is going to be up for grabs, since there is probably no human being that someone, somewhere, does not find 'obnoxious'.

Roper: So now you'd give the devil the benefit of law?

More: Yes. What would you do? Cut a great road through the law to get after the devil?

Roper: I'd cut down every law in England to do that.

More: Oh, and when the last law was down, and the devil turned on you, where would you hide, Roper, all the laws being flat? This country is planted thick with laws from coast to coast, man's laws not God's, and if you cut them down -- and you're just the man to do it -- do you really think that you could stand upright in the winds that would blow then?

Yes, I'd give the devil the benefit of the law, for my own safety's sake.

Dear Ms. Morgan,

At risk of being accused of 'feeding the troll' by others, I would like to address this quotation of yours:

Which pretty much makes my point. You obviously find it acceptable for children to be sexually molested, if you happen to find them 'obnoxious'. Once that principle is accepted, pretty much anyone is going to be up for grabs, since there is probably no human being that someone, somewhere, does not find 'obnoxious'

While I do like your quotation from A Man For All Seasons at the end of your entry, I fear that St. Thomas More would find your own quotation above to be replete with such fallacies as non sequitur, straw man and . Do please try to do better than that. At least, try to do so if you wish your arguments to be heard.

Blogger Bernard Brandt November 08, 2013 2:26 AM

Terribly sorry, but for some reason, the antepenultimate sentence in my last entry was cut off. After "straw man and" should have followed with the words: "and argumenta ad hominem."

Anonymous Gundeck Bob November 08, 2013 10:00 AM

Thanks to everyone. all prayers are gratefully accepted.

And yes, I live in Texas. Our smallish community still has a few OK cops, mostly deputies, men who realize that our local citizens have more guns than the entire police force, know how to use them, and are pretty angry over the way things are going to hell.

As an aside, there is indeed a heavy undercurrent of swelling anger in the populace, except for the transplanted Mexicans and Californians.

But they aren't Americans anyway.

Interesting.

http://www.theblaze.com/stories/2013/11/07/new-details-emerge-about-new-mexico-man-at-center-of-police-departments-anal-probing-controversy/

A records search for David W. Eckert’s past criminal history returns several results. The most recent drug-related arrest appears to have been in 2012. A section on the record, however, says the case was “dismissed by prosecutor.”

He was charged with possession of a controlled substance (methamphetamine), a felony, in the case. The state of New Mexico entered a “nolle prosequie” motion, meaning it found it was not in the state’s best interest to prosecute, according to court records.

In 2008, he was charged with felony possession of a controlled substance and misdemeanor use or possession of drug paraphernalia. He pled guilty and a judge granted him a “conditional discharge” with the stipulation of 18 months supervised probation, records indicate.

In 2005, Eckert was charged with felony possession of a controlled substance with intent to distribute in a school zone and misdemeanor use or possession of drug paraphernalia. The case was ultimately dismissed by the prosecutor after it went to trial and the defense entered an “alibi or entrapment” defense.

Finally, in 2002, Eckert was charged with forgery, possession of a controlled substance with the intent to distribute and use or possession of drug paraphernalia. Each count was apparently “dismissed” by the prosecutor after the state of new Mexico again entered a “nolle prosequie” motion.
