Tic-tac-toe

So, I wonder how many kitty pictures McRapey will post this week? But that's not all, folks, there's more!

Looks like the Os have it.

UPDATE: That scent you smelled this morning wasn't burned toast, it was the butthurt emanating from Bradford, Ohio.
John Scalzi ‏@scalzi
Question for the legal scholars among you: Is this title parody? Or libel?

John Scalzi ‏@scalzi 11m11 minutes ago
Personally, I'm not sure where it is on the parody/libel line. I am a public figure, but there is definitely malice, etc. It's a puzzle!

John Scalzi ‏@scalzi
Also, for those asking, I obviously reported it to Amazon as inappropriate. I mean, the cover art is TERRIBLE. And, uh. Other things.
Here is a hint for the man with the 2.8 GPA: it's in the parody section. And the parody directly quoted you. But I'm sure everyone at Amazon will be astonished to learn that John Scalzi believes satire directed at John Scalzi is inappropriate.

Which usually involves getting your face chewed off. If you're lucky, AFTER you're dead.

121 is the number of reviews of the book.

It'd be absolutely hilarious if it climbs higher than when it was released.

Anonymous Alsos September 02, 2015 9:58 AM

After reading the book, I figured the SJWs would call it libel or decry it as an elaborate rape joke, with the latter more likely as it is a richer vein of contrived outrage and moral status signaling.

Scalzi himself is actually taking the libel path. I guess that surprises me a little, as sanctimony over the "rape joke" angle is something he could feed his rabbits on for weeks. It would be all about them, you see, and how the other side is attacking them and minimizing their trauma and suffering. The other side thinks rape is funny, while he cares about them and wants to protect them from badfeels.

Making it about libel instead turns the focus on himself and his own badfeels. I suppose that *could* generate some sympathy, but isn't it more likely to make him look weak before the warren? The chief rabbit has allowed himself to appear wounded, no longer able to effortlessly brush off any badfeels with teen-girl snark. Seems like an own-goal here.

Blogger Russell (106) September 02, 2015 9:58 AM

So the chief rabbit sounds his mighty horn not to assemble his faithful to ask them to charge into battle, but ask if anyone knows a lawyer, to display his ignorance, and to lie about why he reported his butthurt.

Funny, not humorous you understand, We were not laughing at it. We were laughing because of it. There's a difference. We weren't at all butthurt.

But oh my stars and whiskers are they ever butthurt! This is gang banged by a herd of Rhinoceros during the Folsum Street Fair butthurt! This is new infinite, strange and wonderful dimensions of butthurt.

And the best part is Scalzi has legally neutered himself by agreeing to do a dramatic reading Rainbow Brite Boy's work under any circumstances. He has endorsed a parody work and legally acknowledged it as parody.

@21 Alsos

My WAG is that he is trying to prevent further escalation. The original SJWAL has already spawned 2 chilluns. Who knows where it might end? It must be stopped from going any further!

The hilarious thing is, it was AE that dragged Scalzi into the spotlight. I mean, sure, he was a part of a chapter in SJWAL, but then this side clown has to drag him out and make him the star of a parody of SJWAL.

Anyway, thanks to all involved, as this has been a fun happy time watching this all unfold :P

Oh Johnny boy. People in the US love to talk about defamation, but there is a reason anybody that can clear the jurisdictional hurdle sue in a European court.

1) In the US loser does not pay attorneys fees except in extremely limited circumstances, which won't apply.

2) Discovery. You will be required to sit down for 3-6 hours and discuss your entire sexual history, or face being found in contempt of court. This will be a matter of public record unless you negotiate for confidentiality.

3) The laws are not written favorably to the alleged defamed. You are going to have to prove malice and motive is irrelevant if the defendant can demonstrate truth. You are being directly quoted so good luck with that. And then you have to prove actual damages.

The legal bill for even uncontested actions such as these will clear 10k. If the defendant shows up and files a couple pro se motions, you would be looking at 30k easy. If they have 10k to hand an attorney he can easily run your side up over 60k. So good luck John.

The next phase in this culture war is to write reviews of McRapey's books.

Make them generally positive but express doubt about why anyone would buy a book written by a self-admitted rapist. Also mention that he was hamming it up with Jian.

Then lots of people up vote these new reviews while down-voting others.

I would ask Ken "Popehat" White why he suddenly finds it so necessary to investigate this so-called libel for Scalzi and have him square it with his contempt for an online bully named Bill Schmalfeldt.

You see Ken White loves to say how he defends the First Amendment... oh not on any moral grounds mind you... hell let's just quote him:

"I defend some spectacularly awful speech here. I don't often defend it morally — I call out ugly speech all the time — but I routinely argue that hateful speech is protected by the First Amendment." (http://popehat.com/2013/08/06/true-threats-true-incitement-or-truly-crazy-the-rhetoric-of-deranged-cyberstalker-bill-schmalfeldt/) Well let's hope Ken White defends the author of the satire for their speech and.... oh who am I kidding.... SJW's always lie!

And we of course can always follow through with his (what he termed non-legal advice... lol) post "So You've Been Threatened With A Defamation Suit" (http://popehat.com/2013/09/26/so-youve-been-threatened-with-a-defamation-suit/). Money quotes:

"One of the most important concepts in defamation law is that statements of fact can be defamatory ("you got drunk and ran over my polecat on your Segway!"), but satire ("this is a Downfall video about you") and pure opinion ("you're an asshole") and "rhetorical hyperbole" ("you're the worst dad ever!") cannot. Some statements can be hard to classify ("you're a crook") and whether they can be defamatory depends on their context. Once again, the Digital Media Law Project has a useful guide, and I have discussed the difference repeatedly."

"Truth is an absolute defense to defamation, and "substantial truth" — meaning that the statement got the "gist" or "sting" of the statement right — is also a defense." Gee I wonder if quoting someone and then parodying it counts?

And my personal favorite quote: "Under no circumstances should you search for legal guidance on Reddit." I guess seeking legal advice on twitter is ok in Ken White's book.

And if you want to read up on ken White's previous defenses of Free Speech (when it suits him... you know publicity wise):

Anonymous 334 September 02, 2015 2:32 PM

@64.

The fact that he doesn't have a legit case does not mean Scalzi (with his newfound millions) may not consider suing anyway. The concept of "lawfare" is not just being used by Muslims these days. Look at Michael Mann vs Mark Steyn. That's in about year four in the courts, with no end in sight. Steyn may eventually be vindicated, but the costs will be staggering. The idea is that the punishment is the process, so the eventual outcome is secondary to those who engage in it.

That said, if it were to happen over this tempest in a teapot, I'm quite sure the Ilk, VFM and those of us who read the parody and busted our guts yesterday would consider it a more-than-worthwhile investment to chip for Alexa's court costs.

Honestly if people are going to make a phone case with my image on it, this is the image they should use.

Blogger Salt September 02, 2015 2:49 PM

@93 One problem there. Scalzi could potentially open the door to all the dirt that's hanging out behind the scenes. Then there's the unknown - who is Alexa Eren?

New game, "What's in the World of Alexa Eren?" - yes, you too can unlock the secrets behind John Scalzi.

Damn. I think my tweet was deleted at Scalzi's. I think it will find a safe space here at VP though:

"Honestly if people are going to make a phone case with my image on it, this is the image they should use."

Not this

Appears Amazon has pulled the book off it's website. Cowards!

It's a puzzle!

@97, @100

. . . is that really him? Is this cross-dressing thing not a once-off?

Anonymous Ain September 02, 2015 7:50 PM

I don't know what Sir Dressalot is so irritated about. He should be pleased that his rape satire is the topic of a top selling parody book.

Anonymous John Scalzi is a Raptist September 02, 2015 9:36 PM

PRO-TIP:

Remember folks - If we search in Google for the name of the book "John Scalzi is a rapist" enough times from enough different IP addresses, browsers, etc if someone searches in Google for "John Scalzi is" or "John Scalzi" it might auto-complete to "John Scalzi is a rapist." That would be extra cool so tell all your friends, tell Twitter, tell GG. :)

It should be John Scalzi rapist in the search.

That way it comes up even without the "is" being entered.
