Why Johnny can't sue

It clearly grieves Ken of Popehat to have to give McRapey the bad news, but let's give the man credit for his professional integrity anyhow:
So: here is the short answer. The book title is almost certainly parody protected by the First Amendment, because an audience familiar with the circumstances would recognize it as parody and not as an assertion of fact.

The factors point very strongly to the book being treated as parody, and protected by the First Amendment, rather than as a defamatory statement of fact. With all respect to Scalzi, his question is wrong: you can't analyze the book title in isolation. You have to look at it in the context of the whole. In that context, the intended audience (both fans of Beale and fans of Scalzi) would recognize it as a reference to Beale's tiresome meme. Plus, the Amazon description explicitly labels it as "a blazingly inventive parody," and the descriptive text is mostly nonsensical and evocative of ridicule of "SJW" concerns, and references some of the topics that anger Beale's coterie in connection with Scalzi like the Hugo Awards.

I think this one is protected parody, and I don't think it's a very close call.
I'm not even remotely surprised; it was a stupid question in the first place. I suppose that leaves lobbying Amazon to ban books that make fun of John Scalzi, which I tend to doubt will be a successful strategy. I like reading both Vox Day and PopeHat. They both have a lot to offer in their respective spheres. However I do have a question re: one of PopeHat's claims. Is it true what PopeHat said? That Scalzi "wrote a [clearly satirical] essay in the voice of a rapist" and that Vox is running with that Scalzi claimed to be a rapist in real life? If so, that is way beneath Vox.

hmm @10 gone from your Kindle library? Of course I never bothered to read the agreement with the Kindle, but I'm very surprised they'd police your past purchases like that. You paid for it, it is yours, does that not apply?

The "Deleting from customer's Kindle" action is going to be a briar patch. Now thought control can be retroactive if a book or PDF is deemed unacceptable. It's bad that a corporation is doing this on their own hook, but Amazon is also subject to DHS or any number of alphabet soup agencies. A little further down the rabbit hole and it is within the realm of probability that books and authors will be remotely censored!

I am seriously considering going back to my Nook if I can assure myself that BN can't remotely yank my content.

hmm, from Amazon Kindle terms of service: "Amazon grants [the purchaser] the non-exclusive right to keep a permanent copy of the applicable Digital Content and to view, use, and display such Digital Content an unlimited number of times"

Novel use of "permanent" if they can disappear it.

Found reference to a case where a guy took them court over this and won a $150k settlement for deleting (of all things!) George Orwell's "1984" from his Kindle in the middle of a book report he was doing.

This is a dicey thing to be doing! I do have it still in my Kindle library, I just checked, so maybe it will sort out but still .... dicey stuff

The new rules for Kindle readers:

1. Always keep the device in Airplane mode except when actually downloading. That will prevent Amazon from thought policing it any old time.

2. Forget the cloud, always backup all titles on the device to a separate memory device that never goes on line. Do this before any new downloads. Then if Amazon thought-polices the device during download, forbidden material can be restored.

3. Be prepared to assist in flash drive samizdat...

@37 I didn't have my actual Kindle on hand at the time. The book disappeared from the Amazon cloud reader (read.amazon.com) and didn't show up on my authorized Android phone for my earlier comment. At my Kindle now, and I've manually synced the device as well as rebooted it, and the book is still on there.

I read the book, got it on the KU program. It was funny at first, but the joke did stretch on a bit long.

What IS pretty F'in funny is Scalazi's reaction to it however!

If he had wanted to 'win' that one, all he had to do was read the book live, at a con, while wearing a dress, and having it recorded to be sold as an audio book. Then he would have OWNED the joke.

But instead he ran around and whined, and the joke owned him.

It will be interesting to see if Amazon re-instates the book or not, because it really is just a parody. However Amazon does have a policy on books about rape, and that probably had more to do with their taking it down than Scalazi's panties being in a wad.

He was mostly likely behind it, but we don't know for sure. What we do know is he endorsed the ban. Either way he's a book banner.

I was going to buy it, but I remembered how Amazon zapped books off Kindles with the wrongful taking of 1984 a few years back, and I didn't trust that they wouldn't just rob me as soon as I bought it. This has kept me from buying ebooks on Amazon since I don't trust them too far. Albums - I can get MP3s out of Amazon Player, thank you, and archive them off - but I haven't figured out how to move a book out of Kindle.

Not sure about all Kindle devices, but...

On the Kindle Paperwhite you can connect the micro USB in the bottom edge of the device (where the "on" switch is) to any standard USB and mount the Kindle as a device. It is then straightforward to copy the Documents directory off of the Kindle, right into a folder or directory on the computer it is mounted to. This Documents directory can then be renamed something like "My_Kindle_Pre_Scalzi_V1" for clarity, then further backed up onto a flash drive, an archive disk, etc.

Or so I've been told...

Yes, Amazon has deleted purchased content from customers' Kindle accounts in the past, and they'll keep doing it. The defense that I've heard is that a person who purchased an eBook purchases a "license," but does not in fact purchase the book.

Given that attitude, repeat after me: Side-loading is my friend!

There are a few curious points to consider: when I was deciding on an ereader a few years back, nook won because it accepted the largest number of file types & it had a memory card slot (up to 32MB). However, newer versions of nook and Kobo lack the memory card slot (and nook has disabled the download function from their website, but customers can still download via the nook for PC app) ...

Amazon deleted comments to a review of mine (Cassidy's book on the development of slang from Irish). I was going back and forth with someone who took exception to my nuanced review (go figure), when I noticed comments disappearing. Reasoned inquiry availing me naught. I deleted all by book reviews and have decided to use amazon as a search engine only. I'll buy my books somewhere else. I'm sure it won't hurt them, but I feel better.

Just an FYI, for those who don't know: if you use Calibre, with Apprentice Alf's de-drm plugin tools, you can get/create/download de-DRMed versions of all your Kindle/Nook books to your PC where the thought police cannot delete them. At least, this is the approach I've taken ever since Amazon remotely deleted those books from Kindle owners.

I always archive my purchases from Amazon and, even, Castalia onto two separate dvd's. Problem is, if you try to read an Amazon purchase that has drm and maybe even one that does not it won't play on your computer when in airplane mode. Near as I can tell this always happens. And, this is what annoys and worries me about buying stuff from Amazon. You really don't own the damn thing. From Castalia; you own it. They don't care if you send it to 100 of your friends. Well, they would care but not worry too much over it. They [Castalia] depend on the honesty of their fans and purchasers. Usually, this is good, reliable business. Amazon not so much. I would like to see a major court case [like this situation maybe] where Amazon is forced to defend this policy at some really high levels. I would pay good money for the Kindle transcript of that one.

It needs to be on Amazon for good reasons:
It burns the SJWs that it has risen to the top
It highlights their extreme hypocrisy
It greatly highlights and makes public the ongoing culture war
It will come up on every search for "Scalzi" by name in Amazon.

However, there are benefits to making if available elsewhere on the internet for that last reason alone. Imagine that coming up in searches for Scalzi books!

actually this will probably lead to a bunch of more parodies. Parodies that do not cross the lines that get them pulled from Amazon. If he does get them pulled, then win. He's for censorship, a spoilsport, and can dish it out (poorly) but not take it. If he doesn't get them pulled, then it can feed off itself.

Question for authors, does Amazon refund money from books it's taken down if so does it take that money back from what the author has earned?

As soon as I heard that Amazon was deleting the book at Scalzi's insistence, I fired up my Kindle and found the book is STILL there. But the Kindle isn't connected to the Internet. The Rapist Parody is still on my Amazon cloud account too.

But wait...if I connect the Kindle to the Internet, and that allows Amazon to yank my copy...that would allow Amazon to get into my account and delete both copies. As Tom Wolfe wrote in "The Right Stuff" through the voice of the experimental space chimpanzee..."Fuck THAT shit!"

So I dare not connect my Kindle to my cloud account. Until that time my copy of the Vox Day parody is safe. Can't burn MY book, Amazon pigs!

Popehat does not know literature. Maybe its the drugs. The Scalzi piece was not a satire, but intended as a polemic against the rapist mindset, using a first person persona. Look up the 2 definitions and compare. That is why it is open to satire.

No worries. It may help to keep in mind that I never introduce a questionable new tactic. I only make use of weapons that have been used against me. Once one SJW introduces a new form of attack, it is right and proper to use it against all SJWs.
