Neil Gorsuch for Supreme Court

This is NOW CONFIRMED.
Two high-ranking administration sources have confirmed to Independent Journal Review that President Donald Trump's Supreme Court pick is Colorado Judge Neil Gorsuch.

Gorsuch, who recently traveled to Washington, D.C., was put on Trump's short list for the appointment after he met with the then-president elect after the 2016 election.

Speaking on background, an administration source instrumental to the SCOTUS selection process tells IJR, “Yes. It is Gorsuch. 100 percent. The Hardiman thing is a head fake.” Thomas Hardiman is the other Judge Trump was considering for the vacancy, who is also in Washington, D.C.

A second source within the Trump administration confirmed IJR's reporting.

The source claims that Judge Gorsuch will join the president Tuesday night at the White House at 8 PM for the announcement.
He looks pretty good, better than Hardiman, actually.

Gorsuch has made some past statements that seem to indicate how he would make major Supreme Court decisions. Most notably, he has praised the late Justice Antonin Scalia’s dedication to “textualism,” or the interpretation of laws based on the actual text rather than trying to decipher the “intent” of lawmakers or other potential consequences.

“Judges should instead strive, if humanly and so imperfectly, to apply the law as it is, focusing backward, not forward, and looking to text, structure, and history to decide what a reasonable reader at the time of the events in question would have understood the law to be,” Gorsuch said in a speech to Case Western Reserve University's law school shortly after Scalia passed away.

Further, Gorsuch can also be described as a constitutionalist and adheres to “originalism” when interpreting the U.S. Constitution. In other words, he believes the Constitution should be interpreted as America’s founders intended.

UPDATE: Confirmed. It is Gorsuch.

UPDATE: Some big stories being hidden under the main news story. It looks like H1B visas will come with a minimum salary of $130k. That's massive. Also, the administration has made it clear that it does not intend to permit the percentage of the population of Muslim to rise; it does not want to see the permanent problems that France and Germany have been experiencing for generations in the USA.

This appears to be a great pick. He interprets the Constitution as written and his opinion on euthanasia quoted above is right in line with my beliefs.

However, I'm surprised at the hesitation on this board for Hardiman. I have read a few profiles of the man and he would be a slam-dunk as well. Is there some red flag that I've missed?

Massive missed opportunity. The right pick is Charles Canady, Chief Justice of Florida Supreme Court. Reasons:

- Presbyterian (need some diversity on a Supreme Court with 5 Catholics and 3 Jews)

- Former Florida state rep and U.S. Congressman - need someone with legislative experience (sorely missing from U.S. Supreme Court) (BTW Canady stood down voluntarily because he believes in term limits)

- State court experience (again sorely missing from U.S. Supreme Court - Sandra Day O'Connor was last Supreme Court judge with state court experience)

Possible reasons Canady didn't get it: (i) former general counsel to Jeb Bush when Jeb was Florida governor; (ii) 13 years older than Gorsuch.

Reasons I don't like Gorsuch: (i) born Washington insider; (ii) former clerk to Kennedy; (iii) wife is an immigrant.

Gorsuch is better than Scalia who gave a radical amount of deference to Administrative agencies to interpret ambiguities in Federal statutes under what is called the Chevron standard. Gorsuch wants Chevron reconsidered which would be substantially helpful in draining the Swamp.

Trump knows how to do an intro and appears to be genuine. It's refreshing. When Obama would announce or nominate someone it always came off as mainly about him with some disingenuous kind words about the nominee. Without researching it, that's roughly double the previous H1B minimum prevailing wage. No wonder the tech oligarchs have been so unhinged.

This eviscerates the H1B pimp business. Most all H1Bs aren't direct hires to companies like real companies, but hires to staffing pimp firms that provide real companies with warm bodies. The pimps mark up their contracting hoes 30%+. Often there are multiple levels of pimps taking a cut out of the ass of an H1B.

If 130k is what the H1B must receive, that will blow out a lot of these pimping firms.

He needs to fix the "working student visa" problem too. In Silicon Valley, there is an entire university where all the students are "working visa" students who have been in America a long time. As long as they stay students, they get to stay. The university has been doing VERY well, VERY profitable, and is expanding fast.

And there are a lot of ESL schools, etc. I believe all these universities and schools should be limited; no one building or institution may have more than 1% of their students come from outside the country. That would be a start.

No, H1B at $130K is not sufficient to stop the displacement of US personnel by outsiders. And as was mentioned above, there are many different avenues to obtain work permits in the US, all of which need to be addressed.

I realize that these 'victories' are being perceived differently, but I'm not satisfied. The best way to deal with these programs is the same way one removes a band-aid, quickly and with one stroke. After all, we aren't looking for Pyrrhic victories.

Aside from H1B, we need to end birth-right citizenship (shutdown all [CA] baby mills for Chinese and other foreigners), end the EB programs, prevent ownership of land and single-family homes in the US by foreigners (not unlike many places around the world). The West is no longer open for unchecked business or ownership by foreign interests and all foreign holdings must be reviewed. Then I will start to be mildly excited about the future and hopefully the avoidance of civil war 2.

It's true that cheap labor isn't the reason Indians try to bring in more Indians, but cheap labor is the reason American business owners and managers are attracted to H1-Bs (and offshoring). They don't particularly like having to decipher incomprehensible pidgin English whenever they talk to IT, but they tell themselves it's worth it because they're getting a steal on labor costs (whether that's true or not considering the quality). Make H1-Bs as (or more) expensive as American workers, and they'll be a lot less amenable the next time Ravi comes in and says he needs to hire ten more of his cousins. Higher cost would discourage use of the program.

I prefer shutting the program down, though, rather than trying to price it out of use. As long as it's in use, the cheap labor lobbies will keep trying to find loopholes and ways around your intentions. Just shut it down, and you don't have to deal with that.

Salary of $130k doesn't include benefits and other expenses so this will make hiring foreigners very expensive. Entry level Americans will cost $60K for tech jobs. The rules should also change so foreigners on H1B won't be expected to work longer hours without compensation.

Short-term persuasion: generated suspense that drew attention.

Short-term negotiation: now we know who he will nominate second if his first choice is rejected -- and there won't get a third, because he'll whip up such public outrage over their mindless obstruction that Senate Republicans will enact the nuclear option to appease their voters.

Long-term persuasion: we're now already familiar with his nominee for the next opening, since the suspense got us digging into both guys' character.

Long-term negotiation: and their obstruction would truly be pointless, because then when the second opening comes along, Gorluck will be back in D.C. -- but as the alternative to a truly Deplorable nominee. So they might as well just confirm him now.

Of course I might be reading too much into it, but I think at this point it would just be consistent with his demonstrated high skills in persuasion and negotiation.

I just think many on our side are so unused to winning that we can't stop thinking like the out-of-power party, trying to head-fake our way to partial victories because we can't force anything. Winning means you don't necessarily have to do that dance; sometimes you can just go ahead and do what you want.

Re H1B visas:

In the part of Germany where I live, there is a massive number of Germans and German residents who work in Switzerland. Corssing the border each day, they're known in German as "Grenzgänger".

The Swiss have a system where, to get a work permit from a bordering nation, they have to prove nobody in their local canton can do the job. To get a work permit for any other EU/Schengen national, they have to prove nobody in Switzerland can do the job. To get a work permit for anyone else, they have to prove nobody in the EU/Schengen can do the job.

But in practical terms what this boils down to is that the Swiss measure this in strict Swiss Franc bands. When my employer first applied for a permit for me, the local bureaucrat told them directly it's not possible, the salary is too low.

So to get me a permit my employer had to significantly bump my salary. (Naturally, I did not mind.) The only "proof" that nobody else could do the job was that the salary was above the boundary line.

Since this system has served the Swiss fairly well (they've had other, familiar, immigration issues recently but not the issues the USA has with the H1B program), I think putting a price floor on the visas is a good step in the right direction.

Geez! It's only been TEN DAYS!!! Give the God Emperor a break!! He's not making rash decisions -- or making "tiny" moves -- because he intends to stop there! He's showing/deciding (I would guess) that destabilizing AMERICA a small bit at a time is better than blasting everything at once! (Well, not small bits at a time, really, if you look at the EOs! But it's smaller/slower than WE want...)

I explained to a worried friend: look, Trump is (metaphorically) a sea anchor. Our 'ship of state' has been headed for the rocks in a bad, bad storm for years. A sea anchor SLOWS DOWN the ship's race towards the rocks -- but it does not stop thr race nor fix the ship. The sea anchor gives us TIME to try to repair the ship: to reset the mast, to repair the sails, to patch the broken railings. (To throw into the brig -- or even better, to throw overboard -- the saboteurs doing the damage!) But it does not and cannot by itself STOP us from crashing into the rocks and sinking!

The God Emperor is giving us TIME (that we did not have!) to make repairs and TRY to hold our ship off the rocks. Heave to, dammit, and put pressure on the "sailors" who aren't helping (those whiners in Congress: those elected or appointed 'left-overs' interfering with the repairs.

That's actually more troublesome than it appears. People who get on the Supreme Court, or at least some higher court, tend to form the ambition quite young, much as do flag officers. What that means is they hide what they are starting in law school. Hence, you never really know what you're getting...not for sure, you don't. And even for those who are solid, there's a strong tendency for them to want praise from, and avoid criticism from, the only community they care about or come to care about, the legal community, which is more than a tad liberal.

That said, Gorsuch has enough of a paper trail that he's probably a safer bet than most; way safer than whatever the Hildebeest would have pushed through.
