She has issued her order

Now let her enforce it.
The ACLU is getting “multiple reports” that federal customs agents are siding with President Trump — and willfully ignoring a Brooklyn federal judge’s demand that travelers from seven Muslim countries not be deported from the nation’s airports.

“The court’s order could not be clearer… they need to comply with the order,” Omar Jadwat, director of the ACLU’s Immigrants Rights project, told The Post late Saturday.

“It’s enough to be a serious concern,” Jadwat said of the reports.

Jadwat and other ACLU lawyers had earlier Saturday night won an emergency stay of Trump’s deportation order from Brooklyn Federal Judge Ann Donnelly.
I suspect the portrait of Andrew Jackson in the God-Emperor's office can safely taken as a reliable guide to his future actions.

The judiciary which has taken on undeserved and unauthorized authority to itself will be trimmed back like a blackberry bramble that has taken over a field. Each step it is hacked back is one more of free sweet grazing land we can live on.

Likely as long as she desires. The president can't remove a federal judge, who have their position for life. They can be impeached, but issuing an order is not grounds for impeachment since it is neither a high crime nor a misdemeanor.

@MIG It's based on whether you can get enough info to screen the people. So countries that (apparently) offer enough info to screen are not receiving a temporary blanket ban(even though they have citizens who are enemies). Not sure if that's exactly the reason but it's a plausible explanation.

That's what I was wondering when I first heard this: how does an activist judge enforce her orders? Leftist activist judges have been able to supersede Republican adminstrations because Republicans always let them do it. But if the administration simply says, "No, you're wrong, and your bullshit isn't welcome here," what can a judge do?

Presumably it would be up to Congress to step in and either clarify the law or impeach a president who refused to obey constitutional judgments. But even if Congress agreed with the judge, does it want to be defending immigrants from terrorist-producing countries as its first big battle against Trump?

Judge Brinkema's order covers only the one airport in DC. The other judge's order covers the nation. Both are temporary orders and expire in, I believe, 7 days.

His order does not ban immigration from these countries, but rather, imposes extreme vetting, which is well within his rights. What is wrong about it is not letting people with actual green card and in. These people have been vetted, over long periods of time. Furthermore, it gave no notice to people in transit.

Tightening immigration From these countries is a good thing, but being righteous requires a bit more consideration for disrupting the lives of those already approved. It would be no issue to deny all new visas and give intense scrutiny to those carrying tourist visas, but denying lawful permanent residents and dual citizens entry, especially with no notice, is wrong.

Finally, the president is not king and he is not allowed under our constitution to just ignore a court order. That ventures into problems for him, not these judges. They are not, even remotely, censorable for their actions. They could be reversed by a higher court, but he on the other hand, if he continues to ignore them (which, to his credit, he is not) would run into the realm of impeachable offenses.

The whole apparatus could be replaced by Administrative courts, or nothing, or by restricting the jurisdiction of current federal district courts.

@38 Legal permanent resident is a misnomer as green card holder have to renew their ability to stay on a regular basis.

Second, the incompetence and devilry of the previous administration hasn't left much choice. Pretty much everything done by them needs to be reviewed.

As a former consular officer, let me assure you that half the consular officers couldn't reason their way out of a paper bag, and the other half go out of their way to find reasons to approve visa issuance. I couldn't count the number of immigrant visa folders that I dealt with, finishing up what others had started, where I found multiple errors and, even under the ridiculously limited restrictions we were allowed, illegally and incorrectly marked as okay for issuance (which I then gleefully cancelled).

The President can't remove a federal judge. But the Justice Department can bring charges against Americans for aiding and abetting terrorists, or... say treason. All that's needed is probable cause, which has some subjectivity. See the investigations by left partisans on TX gov. Perry.

Further they can go after professional credentials re: left' attacks on Bybee and Lee for drafting Bush legal memos on enhanced interrogation.

There's a number of ways left's weapons can be replicated to ruin this woman's life.

This is another issue I've not gotten to the root of yet. When was it determined that the Supreme Court is the ultimate arbiter of the Constitution?

There are suppose to be 3 equal branches of government. That would imply that congress or the president can interpret the constitution for themselves and know what is, or isn't, constitutional.

Then you add the further issue of how the Supreme Court is not even representative of the population.

The branches are out of balance, and it's not just the executive.

To echo Sheila4G, there are many countries (to include allies) where we (USG) can NOT obtain the proper records to thoroughly investigate (vet) immigrants of any sort. Further, in most countries, we (USG) are not allowed to conduct our own investigations of a foreign national or even an American citizen.

As an example, in previous assignments, part of my job was to conduct background investigations of AMERICANS that were renewing or attempting to gain a security clearance for work with USG (to include military, LEOS, etc...). The host country did not allow the USG (me or any of my staff) to conduct neighborhood or witness interviews, technically, we weren't even allowed to verify residence, school, work employment, etc... if those activities were done outside the Embassy (think a student attending a foreign college or someone just living/working in a foreign country). My office submitted the names to host country and host country would tell us if that person had a criminal record. That was it... So in an allied country, we couldn't even thoroughly investigate (vet) someone. How in the hell do people think we are going to thoroughly investigate (vet) someone if a war-torn, failed state?

So to assume that a citizen of one of the seven countries was investigated to any standard is a wrong assumption.

In most instances, a visa applicant is interviewed for a few minutes by a Consular Officer (in many cases these are very young and junior Foreign Service Officers). Most are trying to do what they are told or perceive is the right thing, but they are the first line of defense. Consular has access to multiple U.S. databases and the applicants name and other identifying data is run through the database. But if there are no "hits" and the Consular Officer is satisfied with the interview and supporting documentation, then the foreigner gets a visa. The refugee program is different and I don't have a lot of first-hand knowledge on it.

State gets a lot of pressure from all facets of the Uniparty to keep issuing visas. Until the pressure stops, or there is enough top cover from POTUS, CONGRESS and SECSTATE, then State will continue to be pressured by the Uniparty Globalists to keep pushing visas.

Also, there's been recent test cases on a lot of Obama legislation of both Federal Dist. Ct. and Appeals Ct. judges trying to be more expansive than just their district and getting push back from others judges in other districts. There was some case in last 6 mos. where a judge at same level basically said fuck off trying to have your BS order enforced in my jurisdiction.

If Trump is acting in the interests of National Security, there is virtually nothing any court can do or say that will make a bit of difference.

Interesting. There is a book where the United States was attacked by terrorist with nuclear bombs in a few cities by Muslims.

The new President issued Draconian orders that were opposed by judges. He then legitimized assassination by passing a law that allowed him immediate commutation of all convictions.

His opponents lined up pretty quickly after that. It was a good read.

8 years ago I would have been terrified of this. I would have had a "law and order" meltdown like Benji Shapiro contemplating a Trump presidency.

Now? There's a word for playing by the rules when the other side refuses to do so, and that word is "loser." The Constitution is not a suicide pact and neither is separation of powers. And after 8 years of Obama I am far, FAR more likely to judge the God-Emperor's actions on whether or not the ends are just than on any abstract notion of law or fair play. I happen to believe in those notions. But they only work in a super majority WASP society.

Since I was in grade school I've been told by the left that the Constitution is a "living document" and who should obey a crusty old piece of paper written by evil slave owning white men any way?

This episode also shows that Bush II was an idiot. After 9-11, Bush II could have done something that Trump is doing now. Bush II could have said "for the sake of national security, the borders are closed to future immigrants. ". Because of the crisis nature of the moment, I think that Bush II would have succeeded had he tried that. But no, Bush II took advice from big specialist interests, and invaded a country that had nothing to do with 9-11 and also proceeded with the demographic change of the United States.

During the Clinton era a NY Federal Judge held that Blacks running from police is not a reason to stop or search them.

Everyone lost their minds because it is really bad law, and there wasn't time to get to the Circuit (appeals) court, so Clinton went on TV and called it out and the judge reversed the decision.

There are very limited instances where Circuit can be more expansive than their district. The way it gets resolved is if everyone agrees with the order.

But U.S. Circuit judges are notorious for being bonkers partisans, and their court is merely the first step.

If Trump wished to appear to play ball but he need not, he'd direct just airports in New York circuit to toe exactly the visa line; let everyone into but not beyond the port of entry, then have Homeland refuse them entry into US within Homeland's legal authority. Everywhere else he can suggest the ridiculousness of the judges order and state he's going to not bother with port of entry step since it won't change end result.

@43 As every Constitutional lawyer knows, the only Article III Court required by the Constitution is SCOTUS...Everything below that is at Congressional discretion. The whole apparatus could be replaced by Administrative courts, or nothing, or by restricting the jurisdiction of current federal district courts.

Interesting. So it is actually a delegate of the Congressional branch issuing that judgement, while neither the Judicial branch nor the Legislature itself have said anything about it yet.

An Executive Order is issued pursuant to a law that already exists. At the top of the EO it will say what law the EO is intended to enforce. In this case, the law is the Terrorist Travel Prevention Act of 1015, signed by Obama himself in December of that year. That is why it applies only to seven countries, those countries are the ones listed in the Terrorist Travel Prevention Act.

Discard, right. The reason it applies only to those countries is that Trump is taking it slowly, starting by implementing something Obama already put in place (presumably for appearances) but didn't enforce. We've been saying for years that a lot could be done without any new laws, just by enforcing the ones in place, and that's what he's doing. Contrary to the Narrative, he picked something that was already law so there wouldn't be any question about it.

The fact that there have been so many questions about it just proves MPAI and how desperate the left is to keep every possible invader coming.
