Everything they feared and more

The Left is freaked out by the staunch legal conservatism of Supreme Court Justice Neil Gorsuch:
On Monday, Justice Neil Gorsuch revealed himself to be everything that liberals had most feared: pro-gun, pro–travel ban, anti-gay, anti–church/state separation. He is certainly more conservative than Justice Samuel Alito and possibly to the right of Justice Clarence Thomas. He is an uncompromising reactionary and an unmitigated disaster for the progressive constitutional project. And he will likely serve on the court for at least three more decades.

Although Gorsuch has barely been on the bench for two months, he has already had an opportunity to weigh in on some of the most pressing constitutional issues of our time. In each case, he has chosen the most conservative position. On Monday, Gorsuch indicated that he opposes equal rights for same-sex couples, dissenting from a ruling that requires states to list same-sex parents on birth certificates. (Justices Clarence Thomas and Samuel Alito joined his dissent.) That, alone, is startling: In Obergefell v. Hodges, the court held that the Constitution compels states to grant same-sex couples “the constellation” of “rights, benefits, and responsibilities” that “the states have linked to marriage,” including “birth and death certificates.” Obergefell, then, already settled this issue. Gorsuch’s dissent suggests he may not accept Obergefell as settled law and may instead seek to undermine or reverse it.

Gorsuch also joined Thomas in dissenting from the court’s refusal to review a challenge to California’s concealed carry laws. California grants concealed carry permits for “good cause”—namely, a “particularized need, substantiated by documentary evidence, to carry a firearm for self-defense.” Gun advocates challenged this rule, alleging a violation of the Second Amendment. But the 9th U.S. Circuit Court of Appeals upheld the California regime, and on Monday, the court declined to reconsider its decision. Thomas and Gorsuch dissented vociferously, essentially declaring that the Second Amendment grants individuals a right to carry loaded firearms in public. Not even the archconservative Alito joined their bizarre opinion. It appears Gorsuch is eager to strike down almost any law that limits the right “to keep and bear arms” in any way. If adopted by the court, Gorsuch’s theory would effectively bar state and local governments from passing almost any kind of gun safety legislation.
Conservatives used to say that the only thing that mattered about presidential elections was the Supreme Court. Well, by that standard, the God-Emperor is already the greatest conservative president of the post-WWII era. We'll have to see how his future appointments shake out, but at 1-0, he's already doing better than Eisenhower, Nixon, Ford, Reagan, Bush the Elder, or Bush the Younger.

The rumors of Kennedy retiring have quieted down, but I do think he will retire before Trump's second term is up. That gives us yet another.

It's a pipe dream, but in a perfect world, Roberts would be impeached for legislating from the bench in regards to Obamacare. Would love to have a do-over on that traitor.

I'm thinking he figures that the court is still so slanted that it will make little difference. Plus, look at future appointments. When he has the threat of adding more like Gorsuch hanging over them can you imagine how easy it will be to put in anyone he wants? I wonder how much of his socially liberal public positions are there to cater to the current zeitgeist. I certainly do not get the impression he is invested in a Christian view of homosexuality, marriage, etc. I do think he prefers to raise his kids in a 1950's atmosphere and is not interested in championing the further destruction of traditional America. He may see preserving traditional America as a practical necessity in the same way that there are many culturally Christian atheists on this blog.

Nice rhetoric.... restrictions on self defense is never about safety. Its only about the rabbits being afraid of their shadow...
Bring back a modern Agoge, USMC type basic training, physical, combat, tactical training with classical education added on, make it a 3 year endeavor. If you want voting rights you must pass the Agoge. Fail and you may have citizenship but no voting rights.

It's strange that same-sex couples would want to get both their names on the birth certificates. My birth certificate does not list "Husband" and "Wife", but "Mother" and "Father" - ie - those who *genetically* contributed to me (and new techniques mean they're really going to need a third slot soon). It's not about the parents, it's about *ME* having data that may be critical for medical purposes down the road - you know, that paperwork the doctors keep making you fill out *OVER AND OVER* called your "family medical history". This is also one of the problems with adoptions where the children aren't allowed to know who their genetic parents were - it can be important data for the doctors.

I think someone like a Sean Hannity or a Paul Ryan is more likely to be pro-gay-marriage than Trump. Watching Fox News you really get the sense that conservatism is liberal-lite. Which it always was, but even to a relatively young person like me I can see the movement leftward in my own lifetime. Conservative/liberal conflicts are intramural sports.

2A grants nothing. "shall not be infringed emphatically removes any control of people bearing arms, in whatever manner, by the federal government. This now includes the states due to the 14th Amendment.

I'm always happy to see leftists get upset, but Gorsuch is not so wonderful when you consider that he is every bit as eager as Ruth Bader Ginsburg to intervene in state and local matters and strike down laws he dislikes. The fact that he is striking down laws that are dear to leftists makes no difference; a truly great Justice would embrace federalism, decentralization, and states' rights, even when the states are wrong.

These are the bitter dregs of the 14th Amendment, which was never meant to transform the Supreme Court into a "perpetual censor" of state law, to quote from the correctly-decided Slaughterhouse Cases. But we're so far down the rabbit hole that no Justice will dare question the misbegotten jurisprudence since then that has transformed the federal government into the master rather than the servant.

Trump is loyal to his base and also knew that he was replacing Scalia's seat, and wanted a similar vein. I think he knew Gorsuch would be more socially conservative then he his, and has absolutely no problem with that as a thank you and an appeasement to many who are more conservative that voted for him. Also as out of respect for Scalia and the seat he filled.

Do you still hold all the beliefs you held at previous times in your life, let alone all the popular beliefs you might have echoed at times to limit friction in your social circles or to get ahead in business? I don't. Neither does President Trump, obviously. That was clear during the campaign, no matter how many NeverTrumpers insisted he was a New York liberal whose judicial appointments would look like Hillary's.

As far as his position on homosexuals goes, there are plenty of people who thought a decade ago that gays were basically harmless and funny, like what they saw on "Will and Grace," and had a live-and-let-live attitude toward them; but the last several years of enforced cake baking and bathroom invasions have changed their minds on that. President Trump may be one of those. And if he knew something about the Clinton/Epstein/Podesta stuff like he seemed to hint at during the campaign, and has learned more about it since, he may have gotten a real education about just how harmless they are.

Actually, Ginsburg will be the first really significant SCOTUS pick Trump will make. Gorsuch replaced Alito, one of the most reliably original intent justices of the last century. Ginsburg is a (((judicial activist))). Her replacement might actually change the predictable numbers. Even Kennedy is considered a "conservative" justice, in spite of his gay marriage sell-out.

The judicial branch is even more important today with how they are willing to usurp the Legislative and Executive branches. They are an extension of the Executive and completely Ideological. I see this a lot, but it makes no sense. It's not like Scalia would have been replaced with a Scalia clone by default if Trump hadn't gotten around to picking someone. Replacing a conservative with a conservative rather than a liberal is just as important as replacing a liberal with a conservative rather than another liberal.

It's also important because it's a campaign promise kept, without equivocation or trying to weasel out -- he said he would appoint someone from a list he provided during the campaign, and he did. It's also important because excuse #1 for the NeverTrumpers who openly or tacitly supported Hillary was that they were certain that Trump would betray us on his Court appointments, so they didn't have to follow their own "we must vote Republican for the Court" logic from previous elections. I await the many mea culpa articles saying how glad they are that they didn't succeed in denying us Gorsuch, but I won't be holding my breath.

Please let Ginsburg leave the bench on medicle infirmity, and live long enough to see the court move FAR to the originalist-right, with her successor being a Gorsuch clone.
Please let Kennedy retire.
Please let Roberts get impeached (I don't know what skeletons are in his closet to give Dems such leverage as they used in the ACA cases).
Please let the remaining liberal micro-minority leave in 2023, having done little but protest for 8 years, on medical / impeachement / retire / whatever, to be replaced by some young originalists just before #45 leaves office, so as to stretch the winning for the maximum number of years. (It would also have teh side-benefit of giving them a front-row seat on their ongoing failure to do any of significance other than whining). Let Thomas and Alito retire in 2023, knowing the court was in good hands of more young originalists.

Is nine appointments really so much to ask?

Agreed. But, while Gorsuch's nomination was important, it didn't change the predictable liberal/conservative divide. If Ginsburg is replaced with someone of Gorsuch's caliber, the numbers will skew conservative. The left will fight that one with both barrels. It should be interesting to see how Trump handles that.

Yeah...I think that's part of it, but parents aren't just listed on birth certificates for your medical benefit. It's also for their legal claim to you. Minor children are not independent citizens. They are certainly protected by an endless list of laws, but they are ultimately still held accountable by the parents listed on the cert, who are also held accountable by the state for proper, care and feeding as well as socialization. It gives them certain right over you that as a minor child you don't have on your own. Should they do something to forfeit those rights, it's not automatically assumed you then become a legal independent agent. On the contrary. The state either becomes your "guardian" or they assign one to you.

Finally, family medical history isn't just about genetics. If it was, it wouldn't be important anymore given the extensive medical genetic testing that can be done. Family history is actually more important related to the social and behavioral aspects of medicine. Sure, a few rare disorders can be diagnosed faster if it's shown an ancestor also had the disorder, but those tend to be rare.

Quite likely, but if they didn't fight Gorsuch for the same reason, they're dumber than I thought. Had they won that one, they wouldn't need to worry so much about the next one, and they would have continued the precedent that Republican presidents have to let the left decide the acceptable pool of candidates to choose from. Instead, they've let President Trump set a new precedent that his judges get approved almost automatically, the way they're supposed to.

If they couldn't fight that in the early days of the Trump administration, when many people were still unsure whether he was in over his head and they were still ranting about the popular vote, it's going to get harder with every day of straightforward, doing-what-he-said-he'd-do administration that goes by.

While we wait for more openings in the SCOTUS, the God Emperor has plenty of opportunities to fill over 100 empty lower court benches, and should seriously consider the impeachment and disbarment of the judges who demonstrated total incompetence (and ignorance or disregard of existing laws and statutes) by opposing the travel ban.

Clearing the rot from the legal system is surely one of the best ways to dismantle the Progressive's "progressive constitutional project." (i.e dismantling the Constitution and stripping Americans of their rights). We have less influence here than in fighting the media and academia by withdrawing our support and participation, but can still influence our lawmakers and if really required start law fare aimed at overturning unconstitutional case law and precident.

Two points: The R's have demonstrated that they are not on the Trump train or, for that matter, concerned with what their constituency wants. I agree that IF the vote goes to the floor, whoever the Trump nominee is SHOULD be confirmed. But, the left will fight it before it ever gets to the floor, in the media and on Wall Street. That's where Trump's strategy will be implemented.

I've noticed that the Republicrat party has seemed somewhat more docile concerning Trump in the last few weeks. They may be becoming pragmatic about him. If his approval ratings among his base remain high and he continues "winning" they may ride his coattails. But, if their masters call in their markers, they'll do whatever they're told.

To be fair, the birth certificate father is not necessarily the genetic father. There's a presumption of fatherhood for the male half of the marriage that may or may not be accurate. Most don't demand a paternity test to know for sure, and the state is content to take it as given.
