"Unusual activity"

Believe it or not, that's Indiegogo's lame excuse for failing to deliver as promised on a contract. We've also figured out what tactics they are hiding behind; they put the information in the account instead of emailing you, then delete your access to the account so you have nothing with which to hold them accountable. Too bad for them that I'm in the habit of taking detailed notes and screenshots when I don't trust people, so we can already prove exactly what they did and where to confirm it.

 Needless to say, it looks like we'll be moving forward on this one. We already have several alternatives, so if you're a backer, please just be patient and hold your fire. It will probably be a week or two before we open up the campaign version 2.0.

Unless you're VFM, in which case you know what information we want.

To be honest this kind of sucks. I supported Alt-Hero just to support something non-SJW, but I supported Alt-Hero:Q because I really wanted to read the story. Straight up my line.

Still, like Wraithburn said, I look forward to the reckoning.

How have you decided to run the campaign 2.0?

We all have our orders and ID numbers from the first campaign and you've got the email addresses, so you have a bunch of options. Plus you know it's happening, so you don't have to limit yourself either.

You might want to have some options for people that would be interested in helping with the legal battle but didn't fund the comic. The double backing idea is still good, but obviously there are a lot of people on the right that backed 0 either because they don't like comics, Q or whatever.

Vox has had a serious impact on my general confidence and calm when this kind of stuff happens. Years ago this would have been a fairly outrageous event. However, the calm demeanor and confidence Vox displays when this stuff goes down really helped prevent any kind of panic or shocked response.

My reaction was along the lines of "That's too bad. For them."

This is going to be legitimately fun.

Maybe next year at this time I'll consider reactivating, but I honestly expect I'm going to be too busy moving and spending time with my wife to have time for it.

My notice stated: “Indiegogo’s Trust and Safety Team determined this campaign didn’t comply with our Terms of Use...”

Which is it? An account activity firewall (presumably Indiegogo suggests unusual account activity by the owner account?)? Seems remedy is what credit card companies do all the time: “Hey Vox, something looks funny so we’ve halted access. Was this you?” “It was? Ok, access is restored. Sorry for inconvenience.”

Why does Trust and Safety Team have any connectivity to account access questions? Which is real reason? Because project doesn’t meet ToS or because project allegedly showed unusual activity?

The USA has a sitting Justice on the SCOTUS because he's documented his schedule for 30+ years. Channeling your inner German, whether you've got any German DNA or not, can be very valuable.

I'm with Nate, this seems late & forced, which means there is already contractual aspects in force. That's going to be where their Lawyers are going to hit the ceiling over. They really should have pulled this stunt on the last day of the campaign. At this date? All sorts of fun stuff can happen as counter-attacks. If they weren't in CA, there might also be fraud issues, but you need a local DA that would actually bring a case. Not happening in Silicon Valley.

Without knowing the details of Indiegogo's finances, this is a move that one would expect from a desperate, illiquid, and dishonest company. Does this rise to the level of theft under California law, and if so is it possible to go after the corporate officers individually?

Considering the delay between the end of the campaign and the cancellation notices, I'm kind of wondering how much interest IndieGoGo earned off the campaign funds before they shut things down.

Of course payments were processed. That's why yesterday afternoons comments were full of "I got a refund notice" from loads of commenters. Nobody refunds monies that they didn't take in the first place.

LOTS of corporations incorporate in Delaware for various reasons. When suing a corporation, you have 3 possible venues to sue in

1) The state where you come into contact with the business (typically where you live).

2) A state where the corporation has a physical presence or where the headquarters is located.

3) The state where the corporations documents of incorporation are filed.

Based on my cursory reading of the TOS, the idea isn’t specifically contemplated. But they repeatedly say “we don’t get in between backers and creators”, which implies that my cause of action is the same as Arkhaven’s, and the only difference is in the nature and quantity of damages.

They can claim that all they want, but they just returned all backers' money and cut off a project -- in defiance of the wishes of both the backers and the recipient.

Therefore, they absolutely DID insert themselves between backers and a creator.

If that's the case, it's going to be a nice bit pay-off from MC.

The theory of Punitive Damages is to cause the offending party enough fiscal damage that they won't repeat the act in the future. Punitive Damages only work if they're big enough to HURT. MC is a LOT of money... therefore, any punitive damage amount would have to be likewise a large sum of money.

I believe sometime back Vox indicated he would at some point open up applications for more VFM. Be patient, for now just be vile and faceless as someone already said.

I hope the next funding campaign allows to boost to the hardcover level. I'm in! I'm in too if Vox goes for a legal fund. Burn them to the ground!

OT Nate, good to see you around more. I still owe you that pic. Last time I went down to Portland it was dark so no joy. Intriguing thing though, the barbed wire now points outward.
