National emergency

Immigration has been a national emergency since 1965, but better late than never. The God-Emperor declares a national emergency.
President @realDonaldTrump signs the Declaration for a National Emergency to address the national security and humanitarian crisis at the Southern Border.
Now here is hoping that he comes to his senses and flat-out refuses to sign the bait-and-switch law that the Congress has presented him.

The legislative text sent to Pres. Trump and he agreed to sign did not have the language rewarding child trafficking, granting immunity to large % of illegal aliens, and increasing H-2Bs. That was added on later and then rammed through the Senate. Bait and Switch!

I have heard tell that there are provisions that allow this sort of court case to be moved immediately to the Supreme Court.

Which would turn all the eyes in the nation directly on to the Supreme Court, and raise the uncomfortable question (for certain people)... where exactly is Ruth Bader Ginsberg?

Q (FWIW) just stated that Q never claimed actual death for RBG. I've stayed ambivalent, because from our point of view, death and profound incapacitation don't produce a difference in news coverage, so we have no way of telling the difference. What matters is that there is a clear difference between incapacitation and normal functioning, and the news does not look like it would if she was functioning normally.

One possibility is that the bill as such can be signed, and the worst provisions can be sued out of existence by the judgement of the newly 6-3 court.

(I am aware Roberts seems comped; I'm running on the theory that if the vote is going to go 5-4 even without him, that he'll be permitted to vote conservative to maintain his cover. If he goes full-on liberal all the time so early in his career too many questions will start getting raised in the public's mind.)

It seems more likely that he did the National Emergency first to overshadow the embarrassment of signing that horrible bill. He wouldn't want another memorable scene like the one that was set for the infamous omnibus "I will never sign a bill like this again" moment.

I REALLY want to be proven wrong though. I'm holding out hope until there is solid confirmation that he signed.

As of writing this comment, I am cautiously optimistic that President Trump is going to veto the spending bill. Here's what I think is going on. I think that he really did get bait and switched over the various amnesty and other poison pill provisions in the spending bill and he's not happy about it.

Right now,I think that he's got the few people who he actually trusts going over the bill with a fine tooth comb to see if there are enough legal work-arounds that he can use against the poison pill provisions in the bill. If there aren't good legal work-arounds then he's going to veto the bill.

I also think that there was some sort of back room wink-wink nod-nod thing on the national emergency declaration. I suspect that McCuckel and co. made some promises about the national emergency and how it will be fine in court. I think that President Trump declared the national emergency first to gauge the legal reaction from the left and cuck-right. If it looks like they aren't going to keep their side of whatever bargain they made (they won't) then he's going to veto the bill.

I think that the national emergency has a pretty good chance of holding up with the Supreme Court. Judge Roberts usually goes along with whatever the president wants whether it's Bush, Obama or the God Emperor. The God Emperor has to have the same blackmail material on Roberts that everybody else has. I think that the odds of getting the national emergency to hold up in the Supreme Court are better than 50/50.

I have an immigration related question. Someone here, maybe Vox, said that Somalis in MN keep their temps high because they do not pay for the heat. I am aware that Somalis, as 'refugees', qualify for welfare as much as US citizens. They also have low paying jobs and large families.

Is there any source for this story to quantify it? The heating subsidy may be local to MN or even Minneapolis. I never read about this before.

Invoking a national emergency based on a federal statute strikes me as weak, since Trump has a constitutional basis that cannot be nitpicked in court -- the president has the inherent power to act unilaterally to repel a foreign invasion, which is clearly what confronts us. Not only is this a stronger foundation for action, but it also avoids the left's predictable plan to use a "national emergency" to enable any number of vile initiatives in the future.

It never ceases to amaze me that protecting the border is one of the few things the federal government is authorized to do, yet we are tied in knots over that while unconstitutional federal programs such as Medicare, Medicaid, Obamacare, and Social Security are treated as sacrosanct. America is finished as a viable political entity. It will have to continue as a cultural heritage in search of a new political incarnation, likely in a seceded territory.

I think Nate was correct when he complained about Trump, and more importantly his advisors/cabinet, not reading or knowing the actual powers of the executive branch detailed in the Constitution. You would think as a Boomer trump would remember a bit of his civics lessons but he is 70. That's a long time to remember a class he probably bs'd his way through.

Someone (maybe on this blog) was suggesting that the spending bill for the wall here was stipulating that the "requirements" listed by the poison bill applied only to the 55 miles listed by the bill itself.

If that's true, then ok, I'll take 55 miles of bollard fencing and the other 2900 miles can be whatever the hell we want.

There's also a good chance that Trump's lawyers can negate or outright throw out most of the garbage in the bill that doesn't have to do with border security, since that is what the bill is limited to, and the unconstitutional crap can be sent up to the Supreme Court to throw out.

I'm not losing hope just yet. If Trump and the SC can deny most of the crap, then Dems and Neocons just gave Trump the initiative without getting very much in return at all, AND we have his national emergency to Build The Wall.

If the shills and their screeching on /pol/ are anything to go by, this could be a huge win. It remains to be seen how it shakes out.

And one must always remember: if you aren't going to vote Trump in 2020, who else is there to vote for?

He was never going to be our Julius Caesar or Hitler.

Nothing good or necessary. From what I've read it includes stipulations on where the wall can be built, and essentially limits the amount of illegals ICE can hold which expands the catch and release program.

The wall cant be built in Republican counties only Democrat controlled ones and the county has the right to refuse the wall being built. If it borders on a county/city with Mexico the Mexican city/county can deny the wall being built.

I haven't read the exact bill but those are some of the highlights that are circulating.

My understanding of the CR (an appropriations bill) is they can put whatever restrictions they want on the money provided for in that bill, but not on other monies, from other sources. That would require other legislation. So sure, they could say "this xx million can only build a wall of x type, in location y" but not that no other monies can be used to build a wall in location y

Section 224, which we are told gives amnesty to “any sponsors or potential sponsors and their households” of unaccompanied children, only applies to information HHS gives to DHS through the foster system, and specifically excludes any household where any member has an aggravated felony record, in any country.

Section 232 does not give local officials a veto over construction, it only gives them a say in which design is used and which path is followed.

Section 230 (the 1.3 billion) for “primary pedestrian fencing, including levee pedestrian fencing, in the Rio Grande Valley Sector” - pre may 2017 levee fencing designs are all concrete walls with a steel fence on top

The $1.375 billion for constructing a "wall" is pedestrian fencing, not a real wall

The bill includes $725 million for "technology" for border security

The funds can only be used to make steel bollard designed barriers, no concrete walls and no prototypes. This is the same thing as what Bush and Obama built, just a little bit taller.

The bill secures more than $3.1 billion in foreign health services, more than twice for the wall.

The Sec. of DHS cannot increase border crossing fees

Border "Wall" construction is only allowed in the Rio Grande Valley Sector

The bill also includes: $415 million for humanitarian aide, $77 million for opioid equipment, & 1,200 new Customs and Border Patrol Agents

The bill DOES expand Catch and Release by reducing the number of border beds from 49,060 to 40,520

No funding for additional enforcement and removal field personnel. That means no more ICE agents to deport people already in the country.

$3.4 billion in refugee assistance - $74 million more than last year

$4.4 billion in international disaster assistance - $100 million more than last year

The bill does not eliminate any foundations that Trump wanted to get rid of including: The Asia Foundation, the U.S. African Development Foundation, the Inter-American Foundation, and the U.S. Trade and Development Agency

Israel, Ukraine, and Jordan receive $5.3 billion

That's #1 on the agenda every day, and they'll use whatever's handy. If there's actual bad news, they'll report it and spin it as bad as they can. Otherwise they'll make shit up. So it's hard to tell. None of the twitterati shrieking about it can actually know all the details, because the news cycle moves too fast for that. They just pick the position they think is most likely to pan out, or the one that fits their personality, and run with it.

So how will we know if the poison pills are actually there? We and some others will have to read and analyze the bill and compare it to the sections of law-- something that takes hours and hours of dedicated time by someone familiar with the sections like a lobbyist. I guess we know why Trump sat on the bill for a day while his team looked at it.

Some pills can be contained because of how they are written- transferring funds etc. Some pills can be tolerated until they expire 30 Sept. We will just have to see. I am glad that the right wing media is at least looking at these and trying to counter the black pill the leftist media has been feeding the Trump Troops.

2020 is what counts and all of the idiots that back off saying "Trump didn't grant me all of my wishes so I'm going to eat worms" go ahead a ESAD.
