Deplatforming Christian morality

Australian rugby star Israel Folau's legal defense crowdfunding campaign was deplatformed and shut down by GoFundMe:
Israel Folau's controversial appeal for financial assistance for his legal fight against Rugby Australia has been shut down by GoFundMe Australia, with more than $650,000 in funds donated to the sacked rugby star expected to be refunded.

Rugby Australia terminated Folau's multimillion-dollar contract last month after he posted a photo to Instagram in April that said homosexuals were destined for hell unless they repented of their sins.

Folau, 30, launched legal proceedings with the Fair Work Commission and said that, if a deal is not struck with RA, he would take the matter to the High Court. He set up the GoFundMe page in the hope of receiving $3 million in donations.

But GoFundMe Australia released a statement to the Herald on Monday saying the Folau appeal breached the organisation's terms and conditions.

"Today we will be closing Israel Folau’s campaign and issuing full refunds to all donors. After a routine period of evaluation, we have concluded that this campaign violates our terms of service," GoFundMe Australia regional manager Nicola Britton said.

"As a company, we are absolutely committed to the fight for equality for LGBTIQ+ people and fostering an environment of inclusivity.

"While we welcome GoFundMes engaging in diverse civil debate, we do not tolerate the promotion of discrimination or exclusion."
It's always lies, lies, and more lies, with a side order of lies, with these inversives. There was no "routine period of evaluation". What happened was that a bunch of SJW activists complained and thereby triggered the amenable authorities at GoFundMe, who duly pretended to have reviewed the campaign.

I am not familiar with GoFundMe's terms of use, particularly not in Australia, but Folau should carefully review them in order to see where their legal vulnerabilities lie. And this is yet another reminder that Christians and everyone who has not submitted to the satanic Narrative needs to build and utilize their own non-SJW platforms.

While Folau's GoFundMe page soared past the $580,000 mark on Saturday, there were growing calls for the "hypocritical" website, which proudly displays a gay pride flag on its social media accounts, to shut down the fundraising exercise.

As I said, lies and more lies. I hope Mr. Folau will follow through and make the rubble bounce.

OK, they stopped doing legal defense funds because of protests against the funding of Melissa's Bakery (who had refused to bake a cake for a gay wedding), then they restarted doing legal defense funds for "Time's up", a defense fund for people who claim to have been raped or sexually harassed.
I do not know what their current position is re legal defense funds, but they have a promising arbitration clause in their terms:

The Process. Any arbitration between you and us will be settled under the Federal Arbitration Act and administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (collectively, “AAA Rules”) as modified by these Terms of Service. The AAA Rules and filing forms are available online at www.adr.org by calling the AAA at 1-800-778-7879.

A party who intends to seek arbitration must first send a written notice of the dispute to the other party by certified U.S. Mail or by Federal Express (signature required) or, only if that other party has not provided a current physical address, then by electronic mail (“Notice of Arbitration”). Our current address for Notice is: GoFundMe, Inc. 855 Jefferson Avenue, Redwood City, CA 94063.

Blogger Gregory the Great June 24, 2019 6:17 AM

@4 well, if any consumer can start an arbitration for being discriminated against for just 250 dollars in California, it does not really matter if their terms are nebulous or not.

Blogger wahr01 June 24, 2019 6:32 AM

I don't see how this passes in arbitration:

It's not a campaign against gay rights, it's a campaign to help a football star sue for wrongful termination.

They'd have to get an SJW arbitrator to be able to twist that kind of intent out of it, and good luck doing that, arbitration in "social justice" circles is synonymous with "you have no rights", so no SJW would go near one, let alone fall into its employ.

Blogger Gregory the Great June 24, 2019 6:38 AM

@5 I was referring to the fairly astronomic costs for GoFundMe of say 300 parallel consumer arbitrations. Hopefully they will end up as "Dark Vapour" (very nice term, Vox!).

So we'll just go right ahead and discriminate against Israel Folou and exclude him from our service in our fight against discrimination and exclusion.

Question for any legal scholars who might be here. According to US laws at least, are private corporations like GoFundMe legally required to abide by their own TOS? Or like social media, can they ban anyone for any reason they want (or no reason at all)?

Blogger Doktor Jeep June 24, 2019 7:13 AM

Hopefully Folau does not go the Christcuck WWJD route and allow himself to get crucified further. There's only one crucifiction that mattered, ever. Everybody else is just submission.

Blogger VD June 24, 2019 7:22 AM

can they ban anyone for any reason they want (or no reason at all)?

Generally yes, as long as the campaign isn't complete and the money is not yet contractually owed. But it depends upon the terms of service.

I've been republishing "A Song of Grod," on my new blog.

My new commentors all thought it was great and funny stuff and why wasn't I publishing it?

My answer was at this point I'm not certain Amazon wouldn't cancel my KDP account for ThoughtCrime.

Besides a cover and editing cost money and "A Song of Grod," is such a niche market, it probably wouldn't sell enough to make a profit.

I mean, honestly, how big is the market for a hard right Terry Pratchett knock off?

I was then begged to put up a Go Fund Me.

I truly appreciated the sentiment but I am 100% certain that that would be canceled within hours.

Blogger Tanjil Bren June 24, 2019 7:35 AM

Actually, it's quite conceivable that a thoroughly enforceable contract existed from the moment Israel launched his GoFundMe campaign, no matter what their seriously stupid 'terms of use' insist.
What's more, the damages are wonderfully demonstrable; in excess of AUD700,000 when I last checked.
The real issue is how corrupted the Australian judiciary now is.
On that front, all bets are off.
In fact, given the addition of that particular wildcard, I'd all but guarantee he'd lose.

Honestly, if I were that guy, I'd send e-mails to my supporters, put links on a personal website, etc to a legal account where they can donate directly. Fuck GoFundMe, PayPal, and all those other services. They are either too chickenshit to stand up to a tiny group of weirdos or in cahoots with them. Either way, they deserve nothing.

Oh, and screw the author of the cited article too. 'Controversial'. That's the kind of yellow journalist, Weasel Worded nonsense one might expect out of a high school newspaper, not a Mainstream Media professional article. Every time I see that in an article, I mentally replace it with, "action that I, and my organization, disagree with"

Blogger Rocklea Marina June 24, 2019 7:51 AM

GoFundMe isn't using JAMS, they use AAA. It comes under US federal law and not Californian law is my reading.

This was a set piece. This morning conservative talk radio were mewling about how, "of course Israel has the right to run a GoFundMe, but is it palatable that he is doing it on a site that raises money for sick children?" They had foreknowledge of the ban before it occurred and were trotting out the pre-scripted talking points. Slim pickings for talk radio in Oz.

As far as Israel getting representation, I imagine he'll have no shortage of Barristers and QC's lining up to do it pro bono. For the wrongful dismissal that is.

Blogger Gregory the Great June 24, 2019 7:55 AM

@19 does this mean that an arbitration will cost a consumer much more than under Californian law, like maybe 50 percent of the total costs?

Blogger Rocklea Marina June 24, 2019 8:08 AM

@20 Actually I was wrong. Here is the relevant section:

"Fees. If you commence arbitration in accordance with these Terms of Service, we will reimburse you for your payment of the filing fee unless your claim is for more than $10,000 in which case the payment of any fees will be decided by the AAA Rules. Any arbitration hearing will take place at an agreed upon location in San Francisco, California, but if the claim is for $10,000 or less, you may choose whether the arbitration will be conducted: (a) solely on the basis of documents submitted to the arbitrator; (b) through a telephone hearing or (c) by an in-person hearing as established by the AAA Rules in the county of your billing address. If the arbitration finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in the Federal Rule of Civil procedure 11(b), then the payment of all fees will be governed by the AAA Rules. In that case, you agree to reimburse us for all monies previously disbursed by us that are otherwise your obligation to pay under the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator’s ruling on the merits."

My apologies.

Filing Fee: $200 (nonrefundable)

The more serious issue is that they are מחטיא את הרבים try to cause many people to sin. And that is a much more serious offence.

Blogger Roman Daoist June 24, 2019 11:45 AM

Israel Folau is being hindered in his effort to settle a dispute legally. He's trying to be nice about it. And the left are just playing with him.

The harder the left push the more apparant their insanity, and the need for a structural counter-action, become. There's a lot of notionally polite people seething at this stuff just waiting to tag onto some kind of solution.

I predict the theory of equality, feminism, subjective-gender-ism-shit-whatever, will become illegal. Leftism will be a diagnosable condition with standard treatments (such as farm-work for the next 20 years).

Blogger Fozzy Bear June 24, 2019 11:48 AM

If Folau’s lawyers are any good, GoFundMe is about to discover that consequential damages for breach of the statutory implied warranty in Australia are potentially unlimited. The statutory warranty requires that the service be provided with due care and skill; be fit for any express or implied purpose; and be completed in a reasonable timeframe. The warranty cannot be reduced or mitigated by contractual weasel words. It is foreseeable that if GoFundMe had provided the service with due care and diligence, Folau would have been successful in his legal defense and regained his Rugby contract. Those are huge potential damages.

"After a routine period of evaluation"

This is a hilarious way to put it, to me at least. I think they want to say there was a long enough pause between their becoming aware of the crimetalk and their taking action. That there was nothing unusual in the swiftness of their justice. A routine social hammering.

However, this phrasing makes it sound like an inspector made a random spot-check on an assembly line in the Dallas/Ft. Worth plant, kicking off a recall of defective widgets for the whole South Central region.

Blogger Jason June 24, 2019 1:24 PM

As Vox has helped me understand, there is no free speech, there is only the interpretation of the first amendment set by those in power. The First Amendment enforced in the first 150 years of the country is nearly the opposite of what has been enforced in the past 50 years. There were blasphemy laws and sodomy laws on the books for over a century that weren't even questioned as being unconstitutional. Pushing homosexuality, Islam, etc., would have been swiftly shutdown by the prevailing powers of early America. Now we are told we are unamerican if we don't hand over the country to those who want to destroy everything it was built on. This is war gentlemen, and we are losing.

I know I said this on Dark Herald, but I just wanted to reemphasize that I think you would be surprised how many people who are not explicitly "hard" right would be willing to buy Song of Grod. I mean Kratman writes pretty darn hard right (with a dash of civ-nat, I suppose) war/military/sci-fi books, and his work has a guaranteed market, as far as I can tell.

Of course, I'm not the one who would be taking on the risk, so my opinion is worth as much as it cost to give it.

Yeah, the GoFundMe was a terrible idea.

On topic, I hope Folau burns them to the ground, and his lawyers salt the ashes.
