Suspicions confirmed

The Chief Justice is no conservative:
A divided Supreme Court on Monday struck down a Louisiana law regulating abortion clinics, reasserting a commitment to abortion rights over fierce opposition from dissenting conservative justices in the first big abortion case of the Trump era.

Chief Justice John Roberts and his four more liberal colleagues ruled that the law requiring doctors who perform abortions to have admitting privileges at nearby hospitals violates abortion rights the court first announced in the landmark Roe v. Wade decision in 1973.

The outcome is not the last word on the decades-long fight over abortion with dozens of state-imposed restrictions winding their way through the courts. But the decision was a surprising defeat for abortion opponents, who thought that a new conservative majority with two of President Donald Trump’s appointees on board would start chipping away at abortion access.
Roberts is proving to be the most treacherous Chief Justice since Earl Warren. And he is confirming, once more, that no one is going to be voting their way out of this one.

About 25 years ago in Michigan we had a rule that said no medical care for children without consent by a parent or guardian. It had been in place a long time.

A democrat federal district judge ruled that birth control pills for girls are not medical care because they are birth control care. The Sixth Circuit (federal regional appeals panel) upheld the literally illogical ruling.

Things have not been well at the SC for awhile now.
Not to far afield, I think, with the morning post at Deninger's Market-ticker.org, ripping Trump mercilessly on his record and prior promises in campaign leading up to the 2016 victory.
Karl thinks Trump is toast in 2020. I don't agree. He will probably win as there is not logical other choice. This does not mean I'm happy with him; far from it. But, what other choice do we have other than civil war 2? If Trump is defeated, Putin has repeatedly stated that Russia will not tolerate a socialist United States. A non-Christian US. He has threatened limited nuclear release in response to such. If it comes to that I hope he realizes that we here in the South should get a pass. I hope.

We will not vote our way out of this because we did not vote our way into this. Leftists have been cheating, stealing, lying and committing massive voter fraud for decades. The voice of the people has been muted. And whenever the people did get their voices heard such as in the vote against faggotry "marriage" in their states, Federal judges struck down the vote. I would love to suggest he also isn't Catholic. Considering bishops to pope, at least, I can't in good conscience say he isn't. Regardless what that group says, you must look at what they do... or don't do. They obviously didn't explain these things to Roberts, in a clear and compelling manner. They have, last I heard, denied Pelosi communion. Have they with Roberts? And, yes, they had plenty of warning.

Through most of Catholic history, such an act would have received instant excommunication. Even currently, holding to the use of birth control medicines and devices, in marriage, is supposed to create a form of self-excommunication. As is being a member of the masons.

I'm not sure the whole church has any rules anymore. Oh, some will bleat, but unless he is publicly excommunicated, there are no more rules in the church. Might as well be Presbyterian. Bleh.

Roberts reversed HIS OWN prior ruling on the topic from a similar case a few years ago, claiming "precedent" required it. He and Gorsuch both seem to have leveraged handlers applying the screws when necessary; it may not matter whether Kavanaugh proves to be any different if the compromised rubber-stampers aren't impeached and removed. Trump and Congress can cite precedent.

This did not start with Roberts or Warren or even Oliver Wendell Holmes Jr., who upheld the Commonwealth of Virgina's involuntary sterilization of Carrie Buck with the dismissal "Three generations of imbeciles are enough" (So much for my body my choice). Me personally, I'm glad he and his wife were barren. God apparently thought one moral cretin is enough.

No this started a long time ago, when that first case mutated into the cancer of kritarchy in Marbury v. Madison in 1803. John Marshall invented judicial review as an "obiter dictum" to extricate himself from his failure to deliver Marbury's commission. It was the primal scream of judicial supremacism.

Generations of law school students are taught that Marbury is model jurisprudence, when it is the arrogation of power by Marshall, who was also guilty misconduct in not recusing himself from a case that emanated from his misfeasance as the outgoing Secretary of State.

Today, not only the SCOTUS but the lower courts are happy to act with total impunity. They see no limit on the scope of their authority or the principles with which they judge. Here Roberts opines that he is bound by State Decisis. Of course Anthony Kennedy felt no such bounds in Lawrence v. Texas, and when e-commerce grew the Court had no problem vacating Quill Corp. v. North Dakota with Wayfair v. South Dakota. The only reason for the reversal was the protection of state tax revenue.

So (and I'm not holding my breath, because liberals love judicial novelty and so do "conservatives" like little Marco who can shrug and say the court has ruled) unless the Congress starts using the plain language of Article III, Section 2 "with such exceptions, and under such regulations as the Congress shall make." to remind the judiciary of its place, this will continue.

First off, we need a moratorium on Harvard and Yale JD's. With Scalia's death, every "Justice" is a graduate of Harvard or Yale except RBG and she transferred from Harvard. That will also not happen.

If you think Gorsuch and Roberts are liberal, read law review articles written by people that will be nominated twenty years ago. You'll think Cambridge was teleported to Frankfurt.

The problem is that too many people regard the Supreme Court as having final say on what the Constitution means, which is a lie. The Supreme Court has final say over specific disputes and parties brought before it, nothing more. It is part of the federal government and thus inferior to the Constitution, which belongs to us and cannot be changed without an amendment. We should give no more credence to the Supreme Court's ramblings about the Constitution than we would to a Congressman or a President. State and local governments not party to this case should go ahead and continue restricting or outlawing abortion, a subject well-within the residual police power that was never delegated to the federal government in the sparse words of the Constitution, the Bill of Rights, or the Fourteenth Amendment.

To be fair, Roberts has never expressed a desire to overturn Roe v. Wade, and this recent ruling is similar to others made by him in 2019. The man was a known commodity when he was picked.

Indeed, the quandary of Trump's selections to the high court (we shall not overlook Bill Clinton's errand-boy Kavanaugh here, greased in as he was by the ridiculous fall-back propaganda of the MeToo farce) is perhaps the most perplexing piece-that-doesn't-fit into the puzzle of Q-anon. --Unless what's coming end-runs the legal branch entirely, or sees them under arrest (in which case it doesn't matter if an in-the-know Trump permits the swamp to have its tools on the bench).

Not surprised. The leadership of the left and the leadership of the right agree fully on social issues and only differ on small issues of taxation. They all see social conservatives as outdated primitives who have to be slowly phased out of society. The conservative leadership is only there to give false hope to true conservatives and prevent them from becoming violent when they realize that none of the politicians they vote for believe in social conservative principles although they campaign based on them.

A common tactic that has been employed in the past decades is the "sudden change of heart conservative elite" tactic. It involves a conservative elite who has favored conservative causes in small cases(usually involving taxing corporations) to have a sudden change of heart when it comes to a critical moment regarding social issues. Reagan is a textbook example of a pawn in such a tactic. He campaigned as an arduous social conservative who promoted christianity and was against abortion and gay rights. He surrounded himself with christian leaders. First thing he did as governor of california is he gave rights to gay people and said no where in the bible it is mentioned anything bad abot gay people :).

In recent years all major SC decisions regarding social issues came from "sudden change of heart conservative elites". Gay marriage, transgender rights and the recent abortion rights decision all were done in the same way: leftwing judges voted on mass while one conservative justice had a sudden change of heart. The next step in this charade is that Roberts will give a decision favorable to companies/corporations and all rightwing leaders will yell from the rooftops "Look how much of a good conservatice Roberts is! He is a red blooded rightwinger/conservative.". Rinse and repeat with another judge.

Happens every time will happen in the future also. Roberts is just the fall guy they selected to take the fall in the recent cases. If it wasn't him it would have been someone else. Wait until a major case regarding the blacks reaches the SC to see Thomas make a 100% degree turn from his "conservative principles".

The timing of these SCOTUS decisions is interesting too. The last batch came right when the Democrats needed a distraction from the way several of their governors are destroying their state economies because the people in their city-hives won't stop sneezing on each other. This one comes right when they desperately needed a distraction from their riots.

That's been a regular pattern during the Trump era: something happens which benefits our side and is reason for celebration, and then the globalists and the media gin up an event to distract and demoralize. With school shootings off the menu, they've had to come up with other ideas.

I had the same thought when I saw the picture. You hate to have to think that way, because if people are legitimately trying to protect their lives and property, they don't deserve suspicion. But it was so perfect. Antifa appears to have retreated, leaving the "protests" as just a mass of Africans breaking things like an endless stream of WorldStarHipHop videos, and the media is trying its best to find something else to show. Then suddenly there's this very white, apparently wealthy couple pointing guns at people on camera.

It's the sort of thing that, if it didn't happen on its own, you'd expect the media to hire actors to play it out, and you'd say, "Come on, be less obvious."

@46- Judicial Supremacy need not have been the result of judicial review. Because it's fine if the judiciary refuses to recognize laws that run afoul of the Constitution. In fact, it is their duty to ignore such laws.

The problem is that for no reason whatsoever people act as though the courts have special authority in this arena. In one sense this is true, because due process and rule of law and all that. However, no. Because judges are not impartial arbiters of Truth. They're an unholy mix of bureaucrat and politician.

State Nullification is every bit as legitimate as judicial review. As is jury nullification. As is a president or Congress telling SCOTUS to go suck an egg.

Moreover, judges should be liable to impeachment on political grounds. No reason we should restrict ourselves to recalling them for petty crimes as opposed to crimes against the Supreme Law.

Not all traditions are good, and if Judicial Supremacy as a compromise to avoid party factionalism made sense at one point, it doesn't work anymore. Much like the compromise of giving black people everything they want to keep them from burning down our cities hasn't paid off.

There is; but it involves a lot of prayer and fasting, and a candidate willing to proverbially beat the ever-loving shit out of the Judiciary and force them to sleep in the beds that they've made. That would be simple; things like using Kelo v. New London to justify taking all material possessions from the Justices of the Supreme Court, selling them, and applying those monies to the Public Debt.

Marbury's been victim of the same pilpul that they applied to the Constitution, and why wouldn't they perpetuate lies to bolster their claims that "it's always been that way"?

While Marbury established the idea that the Constitution is law, the more important aspect is that the Courts says what it is. Are they following the Constitution or what they'd like it to say.
