Supreme Court rules against President again

The Supreme Court says the President must turn over his taxes:
The U.S. Supreme Court on Thursday ruled that a New York prosecutor can obtain President Donald Trump's financial records but prevented - at least for now - Democratic-led House of Representatives committees from getting similar documents.

Both 7-2 rulings were authored by conservative Chief Justice John Roberts. One ruling means that the subpoena issued to Trump's long-term accounting firm, Mazars LLP, for various financial records to be turned over to a grand jury as part of a criminal investigation can be enforced.

But the court sidestepped a major ruling on whether three House committees could also obtain Trump financial documents under subpoena, giving Trump at least a short-term win. Litigation will now continue in lower courts.

In both rulings, Roberts was joined by the court's four liberals as well as Trump's two conservative appointees to the court, Justices Brett Kavanaugh and Neil Gorsuch.
I have no position on this, but things are rapidly getting to the point that one finds oneself beginning to wish Trump would stop arguing and tweeting and start ordering drone strikes.

hmm weird middle ground political decision. they ruled that the prosecutors can have them but not congress? where on earth is that mentioned in the constitution. anyways i don't really get what does this have to do with the constitution in the first place and why this reached the supreme court. the supreme court is accepting way too many things that it has no business accepting

Trump's tax records are squeaky clean. He's doing this to either 1) provide a mechanism to go after cabal tax returns or 2) reveal his squeaky clean tax returns later this year as a reverse October surprise, leaving the democrats slavering over a big nothing burger.

Trump should immediately order the release of those seven Justice's tax returns.

Blogger CoolHand July 09, 2020 12:51 PM

What's going to be funny as hell is that they've gone through all this shit to get those taxes, and they're going to find that there's nothing even remotely actionable in them.

If they could have come at Trump through the IRS, they'd have done that twenty five years ago.

Donny boy is clean as a whistle, because if he wasn't, he'd have been dead or in prison decades ago.

Blogger rikjames.313 July 09, 2020 12:54 PM

Trump can still assert his standard defenses at the lower level courts for the grand jury subpoena, and the congressional subpoena has to be fully relitigated under the standards.

So absent democratic judges going insanely high speed to brush aside his motions and defenses, he gets past the election without giving them over.

I would have said trump was in the clear, but the last three years have shown me the more activist federal judges don't care how things look and are just going all out for their side. Thumbs are not just on the scale of justice anymore, many of the judges are fully in the tank.

Nobody talking about McGirt v Oklahoma (9 July 2020) declaring half of Oklahoma including the 400,000 residents of Tulsa official Indian reservation.

Not that this is unfair. The US signed the treaty out of their own free enthusiastic consent. If they wanted room for growth they ought to have added an expiration clause, but they reasoned that they didn't need one.

Blogger Samuel Adams July 09, 2020 1:19 PM

One wonders why Gorsuch and Kavanaugh are ruling this way after all the build up and fanfare of their being "constitutionalists". So far they've given the left wing everything it's asked for. I doubt they would have made the same rulings before they were appointed SCOTUS justices. I think they've been intimidated and scared so badly that they won't even consider ruling any way other than how they've been instructed by their (((handlers))). Chief Justice Roberts was already compromised before he was appointed by Bush, and his alleged homosexuality makes him easily controlled, so his aligning with the leftist justices is no surprise.

Taxes? The Obama administration (goldman sachs administration) featured a treasury secretary, Timothy Geitner, who had been caught cheating the IRS. The recent precedent for accountability is actually a lower standard than Donald J. Trump.

Brutal but true.

The truth is that what we call 'finance' is so borderline to criminality, that it rarely matters. The only reason Bernie Madoff went to jail, is because he stole from rich people. "Financial Sector" has tripled in recent years as all other industries declined. Ponzie schemes are an apt description of modern finance.

Personally I suspect Trump to be drawing this out for maximum enemy effort to be spent on it. Nothing to see here...

"But the court sidestepped a major ruling on whether three House committees could also obtain Trump financial documents under subpoena, giving Trump at least a short-term win. Litigation will now continue in lower courts."

It takes a full house vote to authorize a committee to issue subpoenas. Absent that, no committee can issue anything more than sternly worded demand letters, and Trump can outright ignore them. Remember, subpoenas have a criminal penalty for non compliance, and it takes a full House authorization vote to empower committees to issue subpoenas. Without the criminal penalties of a subpoena, all the House can do is hold an Executive branch person in contempt, as we saw happen with Eric Holder when he refused records requests in relation to Operation Fast & Furious.

No such vote has ever happened with any of the House investigations related to Trump, therefore Nadler can go eat a bag of dicks, AFAIAC.

It's possible that Trump still has a lot of house cleaning to do at the Pentagon before he can expect those drone-strike orders to be followed.

From recent moves, it looks like he's trying to exploit the divide between the brass and the grunts in order to render any other would-be Vindmans mostly impotent, kept in the dark with their nominal subordinates mysteriously failing to receive their direct orders. That's not going to be easy, but is at least within the realm of possibility, whereas fixing the judiciary probably isn't.

I'm with you there.

But to keep my head above water, I know who is victorious in the end.

The most critical thing I can do for my kids is to pass down a legacy of solid faith built on scripture, where emotions submit to The Word and not vice versa.

From there, they are the Lord's. I accept they may be persecuted. I pray they don't lose their faith and I know that around the world, as we succumb to persecution, the church that has strengthened over seas will see our plight and pray for us in our time of need as we prayed for them in theirs. And they will be the strong prayer warriors covering our children and grandchildren in blessings and who knows... perhaps what persecution has caused for the churches in other countries will cause here - a strengthened, more solid church that carries our progeny to the building of a new nation.

Our Jesus comes back and gives us rest.

Either way, we win.

I prefer the Jesus method, because I'm so tired and I don't want this for my kids... but the war isn't over and I know we win regardless.

So that's how I keep away from the black pill. Philippians is a great read, btw. They were a very persecuted church at the time, but that book is so filled with joy.

Because Christianity started out as a religion of 12 men who were hunted and hated, but despite this, the faith grew to conquer an empire in 3 centuries time. Remember the ride or the Rohirrim. They rode down into the plains, not expecting to win, not even expecting to survive, only hoping to remain faithful to their vows and to their fathers before them.
This is a different sort of war. The lines are not clear-cut, and lies and treachery are the weapons of the Enemy. Still, we can be faithful to God, to our vows, and to our ancestors.

Blogger The Depolrable Podunk Ken Ramsey July 09, 2020 3:53 PM

I dunno about this idea that Trump's tax returns are squeaky clean. With this convoluted tax code it is simply impossible to be 100% compliant if your taxes aren't trivial. Even then it's not so easy. They can always ding you for something. As you work through filing your taxes at many points you have to make a decision, and the more complicated your income and financial situation is the more decisions you have to make. At each one of those decision points you are vulnerable.

It's so ridiculous that you can even appeal to the government for advise, take that advise, and then you can still be fined for following it. Worse, I've even seen a case where the government argues that just because, say, the 6th district federal court ruled one way in a situation that it doesn't apply to you if you aren't in the 6th district. It is nuts.

Tax filing violations can be very easily manufactured. That's how they got Al Capone, famously, it wasn't some great gumshoe detective work by Elliot Ness. This is not to suggest that Trump is like a gangster, but simply to point out that, when all else fails, they can always hang you on the tax law if they want. It's how they scandalously hung the Tea Party folks en masse and helped neutralize them in the 2012 election. And they got away scott-free with that outrageous travesty. That is certainly not a good precedent.

Such stuff is also an outrageous violation of the original deal. Income taxes were never supposed to be make public. They were never supposed to be a requirement for running for office, for applying for loans, for employment, for security checks, etc. It's an outrageous violation of trust that they now have a role in so many things.

Blogger Damelon Brinn July 09, 2020 4:03 PM

as you would expect a Bush-appointed judge to be.

The surprising thing is that Thomas and Alito have been as good as they are. Gorsuch and Kavanaugh may have bent over backwards to try not to look biased toward the president who appointed them, figuring the decision was only going to send it back for months of more legal wrangling anyway. Not the most righteous stance, but not necessarily on Roberts's level either.

Blogger Damelon Brinn July 09, 2020 4:24 PM

How do you guys keep from giving in to blackpill?

Others have given spiritual advice, so I'll just add these:

1. Take in no media or social media. Seriously, as little as you can as a primary source. I get all my information from a couple blogs, /pol/, and individuals I know. The only time I see an article or a tweet is when one of those sources shares a clip or screenshot. Yet I'm still better informed than anyone I know in real life. You don't need the media to tell you what's important; other people will do that. And then you get it with most of the propaganda and demoralization tactics filtered out of it.

2. Corollary to that one: spend time with regular people who couldn't name all 9 SCOTUS justices or the president's top advisors. Talk to people about things that actually matter in their regular lives and communities. People are still having babies, building homes, going to church, and doing their jobs. Life is pretty good out here beyond the areas the media concentrates on every day.

3. Pay attention to the desperation of our enemies. They're trying to win the whole game *now*, because they sense that the pendulum is starting to swing back, so they can't afford any more long marches. For instance, they spent decades working through the legalization of homosexuality to tolerance to normalization to bake-the-cake-or-else, and now they're trying to do the same thing with trannies in months. If we were losing, they wouldn't be desperate.

@26 Faith.

Faith cannot be faked, for some, it is hard earned, for the blessed, their norm.

I gained my faith, despite the best efforts of churchianity, because God is true.

For this filthy soul, that meant speaking / praying truthfully to God, never sugarcoating things, never pretending to believe things I did not believe; negotiating "the problem of evil" with God involved a lot of F-bombs, directed directly at God, the sorts of prayers your typical church goer cannot comprehend.

God don't give a damn about 'nice'; this is a Guy who fought dirty with Jacob, loved Samson (makes the old Roosh look like an altar boy) and praised Phineas.

God gets down in the dirt with us and works, truthfully, patiently and hard as fuck-nosed with those who call on Him.

Tl;dr; bring the blackpills to Him; bring Him your heart and soul. He desires you to come to Him as you are; in truth, He can work with you from where you are.

To be frank, my prayers of late concern guidance on who to kill so we can put this goddamned evil to death throughout Christendom.

The latest Kevin Schipp vid demonstrates the task is daunting , probably requiring Christendom to self organize in opposition to get the job done.

There is a corpus of prophecy out there, much recent, some centuries old, both Catholic and Protestant, much contradictory on the specifics, but in agreement regarding the broad themes of these times. It is a map, but keep Pournelle's maxim regarding maps in mind while reading it.

Fun little factoid; there is now a shortage of pocket change; per the fed, its covid(!) related.
Just a week earlier, I watched this Kentucky pastor's prophetic video where the ability to make change..first coins, then ones, fives...disapeared.

We are blessed to live in a pivot point in History; God needs you to bring yourself, in your wheelchair, to the fight.

Trying to 'get him' on some transaction is lengthy and uphill work and entails years of fidgety action - although the press will try to blow it up. It's too finicky to explain on camera though. So there's not much point in worrying about that being 'the one that gets him.'

It's hard not to blackpill. However the darkness is proof that the goods of this world are counterfeit and our only hope is in Jesus Christ.

How do you guys keep from giving in to blackpill?

By remembering that we aren't going to save the USA anyway. That cake is already baked and what matters is what gets built after. Our kids and grandkids futures are on the other side of a singularity. The Enemy has taken control of too many institutions already for us to patiently fix things, we have to break it first and rebuild on the wreckage. That our enemy is working so hard to destroy what they've already taken over is to our great good fortune.

Don't know, but a suitable amphitheater where SJW's could be fed to wild beasts complete with pay-per-view would be a better reason to visit than the usual third-rate casinos.

"Supreme Court rules against President again"

Yes, but which president? A precedent set for one applies to all, including former presidents. Whatever Trump has to turn over, so does Obama. And the Clintons.

>> Kill you television. Really.

Put your TV in the attic for 2 months, and notice how

1) your thinking becomes clearer and more rational

2) You stop buying shit you neither wanted or needed in the first place.

3) How much TIME you have to do things that are actually important to you.

On the original topic of the tax returns:
When you are on your way to getting commissioned as an officer in the military, the military has access to everything: high school grades, SAT / ACT scores, criminal record, maybe even sealed records depending on the offense, college transcript, medical records, results of medical exams performed by the military rather than by your private doctor, etc. etc. They get to see it all before you get commissioned.

It seems to me that all candidates for federal office (House, Senate, President, Vice) should have to reveal all the same info, plus lifetime tax records including reported SSA income numbers. Wouldn’t have thought of it before Obama, but it should also include travel requiring a passport including that by you mother from 9 months before birth to one year after birth (where was Stanley when?) Probably your footprint should be open source with a check as candidate to prove you are the same little kid they were looking at when the birth certificate was done. All the info should be available to all voters.
I bet being able to see the SAT scores of W., and especially the geniuses Obama and Gore, would be hilarious.

2. An Indian can't just go to *any* reservation. He has to go to his own tribe's reservation.

It's easier to get made in the Mafia than get enrolled in most tribes, especially when there's many paleface dollars at play.

4) Notice how stupid, innane, childish and idiotic 99% of the content on The Box is when you might see something passing by a TV in an airport, doctor's lounge or relative's house who's still on the juice. It's like putting on the sunglasses in They Live. To mix Box metaphors: you see flapping-gum dead people when you chance upon TV after you're away for a period of time.

I play in a weekly pool league, and our home bar has a couple TVs. These days, with very little sports, they'll have at least one tuned to a drama or something. You can't hear it, but I can still see the indoctrination every time I glance over at it. Every couple is mixed, everyone committing a crime is white, the cops pointing guns at them are black, and so on. There don't seem to be any exceptions anymore. How could anyone absorb that day after day and not get a twisted view of reality?

That is most certainly the truth.

All of you people who still devote HOURS of your time, every day, watching TV... you have absolutely no idea how utterly silly or even stupid you look to the rest of the world.

I've never met someone who runs his own business who watches any TV other than an occasional college or professional game.

When do we rule against the Supreme Court?

Blogger rikjames.313 July 10, 2020 6:30 AM

I deal with Indian Country sometimes in our practice, not for criminal jurisdiction, but because certain property and project get accelerated depreciation by being located in those areas (the thought was it would help locate employers in Indian Country).

That part will be good for businesses in Tulsa.

Less good will be the criminal jurisdiction mess. For the most part, tribal courts are a joke.

Blogger Avalanche July 10, 2020 7:19 AM

@58 "By the way the Federalists are a joke, they approved these last two jokers."

Is it too naive for words for me to say that I have a sneaking hope because of President Trump's comment somewhere AFTER he got screwed... er, that .. WE got screwed by the "two new Trump justices"; that he apparently has a NEW list he's going to release for the next nominee(s) and he will *ONLY CHOOSE* from that list?

My first wan hope-reaction was: AH! Maybe he has dumped the Federalist's list, having been burned twice by them; and will be picking off a list of his own. He DOES seem to take shitty hiring advice over and over from the corrupt insiders... Unless maybe he is using the crap-picks to expose our enemies all over inside?

Taking the I-pray-it's-smaller 'hit' to get the bigger win?

Blogger Avalanche July 10, 2020 8:48 AM

@64 "leak them so they can point and shriek"

When the God Emperor ran, and the libs were having pretend hysteria about "he won't release his tax returns" I found it both vindictively satisfying and a bit salutary to ask the whiner:

"If you looked at his tax returns, would you have any idea what you were looking at or for? Just WHAT do you think you will find in his tax returns? Do you think the IRS has been paying no attention to his returns all these years, even though he was been audited EVERY year?! What do you think YOU could find in them that the IRS did not? Do you always let the media / libs stampede you in a direction when you have no idea what is there? WHY are you barking and snapping about how bad he is not to release his taxes? Do you even know why *you* want them -- or are you just responding like a parrot to what you've been told on TV?"

Deer in the headlights.

Make a note of shareable mlments in the streams that have family-positive can-do messages that you can rewatch with them to offer them an alternative narrative to the lies that stream from virtually everywhere else... or at least topics of discussion to see just how badly they are brainwashed to be part of the problem. Maybe they are just scared to speak out because they feel they are alone

I think that told us more than any detailed analysis of Gorsuch's career ever could. Trump had obvious contempt for the guy. So the question is, why did he get it?

That looked more like hatred to me.
