The last defender of the Constitution

RIP Antonin Scalia:
Supreme Court Justice Antonin Scalia has died at the age of 79, Texas Governor Greg Abbott said in a statement on Saturday. The statement did not indicate the cause of death, but several news outlets reported that he died of natural causes while in Texas this weekend.

Scalia was nominated by President Ronald Reagan to the Supreme Court in 1986.
It's sobering to think that he may be the last genuine Constitutionalist to sit on the Supreme Court. One can only expect that he'll be replaced by a black female Marxist.

Ross Douthat summed up the man well: "We should all die full of years, with 28 grandchildren, in our sleep after quail hunting."

That is the sign of a life well-lived.

The Senate has the option to delay confirmation until the next Presidential term, but the battle over this can easily get ugly. It can be made into a racial issue also, and I expect it will be, as an election maneuver. Obama will go ahead and submit nominee after nominee, all minority of one kind or another, and dare the Senate to reject them. It's the obvious move.

I had a son on that battlefield and they were shooting at my son, and I'm not about to give this man who was captured in a war a full jury trial. I mean it's crazy."

You're selling Clarence Thomas short. He is probably, by a slight measure, more of a Constitutionalist than Scalia was, because he is more willing to overturn bad precedent.

Well, yes. I do think Thomas was more loyal to the Constitution; Scalia used a New-Deal-era precedent to support Federal laws against marijuana possession. But Scalia was right most of the time, and had become increasingly vocal in defending the Constitution, and the rule of law in general, in the past year or two.

And we need more than one honest judge on the Supreme Court.

I foresee rulings coming down that will be breathtaking in their insanity: "Hate speech" is not protected by the first ammendment. The second amendment allows the army to have firearms, not individuals. The fourth amendment only applies to "protected groups" which doesn't include those icky white guys. The fifth amendment only counts if you have nothing to hide. Its not fair that some have more than others, so all property must be equalized. White folks are going to be taxed to provide reparations for black folks, and probably some so beyond the bounds of rational thought that we haven't even conceived of them yet.

Would be nice if a liberal justice "shrank in office" for a change.

Scalia had been pointing out in his speeches, and IIRC in his opinions as well, that when the government is widely seen to selectively enforce the law, and is widely seen to defy the laws meant to constrain it, the people may decide that they are no longer bound by the rule of law either. (He was an active defender of the Constitution, probably moreso than Justice Thomas.)

But we still have the Declaration of Independence, and some of us would still obey and uphold the Free System of English Laws if we were able to.

Scalia was a great man and will be missed.

However, if you think this will change the court, you haven't been paying attention. Every major issue has been sided 5-4 for the leftists in recent memory. Each time a different Repub appointee sees an emanation that allows him to switch sides - it's a rotating position. Scalia and Thomas were the only reliable pair on the bench.

I'll miss his dissenting opinions more than anything else. Always a powerful salvo towards the left and his quisling republican-appointed colleagues. RIP Scalia.

Presuming wikipedias numbers are halfway right, the average vacancy over the history of SCOTUS is over 127 days, with several over 200, a couple over 400, and one as high as 800 days. 6 months later, I still support Cruz. His tax plan isn't really an improvement, except for the fact that it would reset all the loopholes, but it's unpassable anyway. I just think he's the right combination of unscrupulous insider and rigid ideologue. Less crazy than trump, smarter than Rubio and Jeb.

If Trump would be better, it's only for his value in shocking the system and his competence at running things, but I don't trust him to do anything good. I do believe he would attempt to shut down illegal immigration.

It doesn't matter. If Trump betrays those who elect him it will destroy any illusions those people still harbor about achieving anything through the system. Cruz is a sellout cuck so his cucked up actions will not make people realize that nothing will ever be achieved through politics.

Almost all his positions are already a flip from previous positions going back to 1999 at least.

However, in the current campaign, he has already contradicted parts of his immigration policy, he might have flipped on his healthcare policy (no one knows what his actual policy is, so it's less of a flip and more of just an incoherent mess).

We graduate two times more Americans with STEM degrees each year than find STEM jobs, yet as much as two-thirds of entry-level hiring for IT jobs is accomplished through the H-1B program. More than half of H-1B visas are issued for the program's lowest allowable wage level, and more than eighty percent for its bottom two. Raising the prevailing wage paid to H-1Bs will force companies to give these coveted entry-level jobs to the existing domestic pool of unemployed native and immigrant workers in the U.S., instead of flying in cheaper workers from overseas. This will improve the number of black, Hispanic and female workers in Silicon Valley who have been passed over in favor of the H-1B program. Mark Zuckerberg’s personal Senator, Marco Rubio, has a bill to triple H-1Bs that would decimate women and minorities.

Requirement to hire American workers first. Too many visas, like the H-1B, have no such requirement. In the year 2015, with 92 million Americans outside the workforce and incomes collapsing, we need companies to hire from the domestic pool of unemployed. Petitions for workers should be mailed to the unemployment office, not USCIS.

End welfare abuse. Applicants for entry to the United States should be required to certify that they can pay for their own housing, healthcare and other needs before coming to the U.S.

Jobs program for inner city youth. The J-1 visa jobs program for foreign youth will be terminated and replaced with a resume bank for inner city youth provided to all corporate subscribers to the J-1 visa program.

Refugee program for American children. Increase standards for the admission of refugees and asylum-seekers to crack down on abuses. Use the monies saved on expensive refugee programs to help place American children without parents in safer homes and communities, and to improve community safety in high crime neighborhoods in the United States.

Immigration moderation. Before any new green cards are issued to foreign workers abroad, there will be a pause where employers will have to hire from the domestic pool of unemployed immigrant and native workers. This will help reverse women's plummeting workplace participation rate, grow wages, and allow record immigration levels to subside to more moderate historical averages.
