Buckle up, Star Citizens

Derek Smart reports that a former backer has defeated the new Star Citizen Terms of Service that tries to deny backers the ability to get refunds from Cloud Imperium Games.
A backer who, like so many that contact me, use my online resources for navigating this farce etc, has been fighting diligently for over a month to get a refund of $3K from CIG/RSI after they changed the ToS and stripped him of rights he already had, has PREVAILED.

It’s only going to get worse from here on out, seeing as I have now been made aware that the LA county consumer protection office is also looking into similar complaints, and complainants (regardless of where you live here in the US or overseas) have been advised to file a complaint on their website.

Notice how Ortwin ( that would be this guy), Chris Roberts’ long-time business partner (and entertainment attorney), basically lied (I have now made them aware of this in detail) to the Attorney General’s office when he stated the following – in writing (!):

i) cited the ToS which the backer never agreed to, hence the whole point of the refund battle

ii) states that the backer has an agreement with RSI; when in fact the backer (like all backers before the ToS change) actually has an agreement with CIG. Note that this is all part of them shifting the liability from the more established CIG entity to one of the several shell corps associated with this train-wreck.
It looks very much as if the pyramid is starting to crumble. Once more, we see that despite the doubters, time has proven Derek Smart to be correct. Don't be surprised if he turns out to be right about the rest of it too.

Some of the True Believers are already losing their faith:
This game has shown me one major thing: Never back something that strays from its kickstarted objective. Star Citizen was supposed to be some freaking Wing Commander that was amazing and up to date, then it basically fucked its backers by COMPLETELY straying off course and trying to be some end all be all game. CIG basically lied to its original backers and told them "thanks for the money, NOW GO FUCK YOURSELF". When I heard about this game all I knew was...joy, joy that came from the dream of a supreme space game.

After buying a package, I was officially inducted into the Cult of Star Citizen. Anyone who dared question my holy game would be called a troll, idiot, or not know one thing about game development. After a while I started having doubts in my head after so many delays, but I kept putting them deeper and deeper in my head only to have them resurface with a vengeance.

After I started thinking about the game and what these so called "trolls" were saying, I realized something: This game is already vaporware and a scam. Think about it; its missed constant deadlines, keeps asking for more money for basically concept art, and is completely different than was originally promised...This..is..FRAUD.
The thing is, all of the veterans in the industry realized, around a year ago, that the game wasn't going to come out. Scope creep, particularly in an already sizable project, is a killer, and Star Citizen suffered from more scope creep than any game I can recall. This is something we cover in DevGame; the combination of a visionary designer and a weak producer is always a dangerous one because the primary purpose of the producer is to rein in the designer and focus on completing the designer's original vision.

And, of course, the involvement of the principal's wife is always a red flag in any business. Meanwhile, COD: Infinite Warfare looks absolutely amazing. It's particularly fun for me to notice the gravity effects, since RMR was the first shooter to utilize turning gravity on and off as a weapon.

I'm amazed that anyone would spend $3k (or in some cases I know if, $30k) on a crowdfunded project in an early development stage.

Actually, I'm pretty amazed that anyone would spend that much for a video game, period.

I'll revise my statement. Last year was the time to get in line. Failing that, when they revised the TOS was the next time to ask for the refund.

The TOS change says very bad things about the project. Any decent attorney would have advised them it wasn't going to hold up. The fact they still did it indicates that either they are only listening to people who are saying what they want to hear or they are just trying to extend the timeline while they try to pull all of money out of the operation.

This latest decision is the last warning for any backers that may want their money back. Bankruptcy is not going to be far behind.

Fo what it's worth, Roberts' himself added a new goalpost _after_ Star Citizen had become the record-breaking game development Kickstarter campaign being the most funded in both dollars and backers.

I forget when, but he noted that if the campaign took in something like $27m then it could be entirely free of external financiers. Now WTF that had to do with crowdfunding and game playing, Inhave no idea because he wasn't offering anyone profit-sharing to registered players or anything, but that seemed to really pass out the kook aid to the backers. Note, this was at a time when the campaign had made more than $6m, exceeding its goal by at least $2m. So whatever implication it had for people, it was a reasonable new goal to hit. And of course, game players probably felt they had to beat that next boss, so "hey, here's $40,000 to buy some game art for a ship."

The game could have been bossible without the integrated ship/staton interrior/exterior areas.
And the current amount of texture/mesh quality with gravity and other game engine related thingies greatly reduce the amount of player they can have in instances at the same time.
These and many other problems will make the game production very difficult or almost impossible with the current current computer technology.

About one year ago I also started to tell my friends that they should stay away from this project untill it's "complete" and then spend the money if they wan't,,

Loved Modern Warfare, and they dropped that style like a hot rock, devoted themselves to x-box peer-to-peer nonsense, and just shot the franchise in the head. The new CoD looks visually cool, but here's a big bag of Nopes. Ain't ever gonna get another CoD game. I've moved back to Counter-Strike: Global Offensive and THANK GOD that Steam dusted off that corpse and hit it with the paddles.

Personally, I could care less about Star Citizen, what I find more interesting is the CoD phenomenon, where a company uses the same name to produce a different game. It feels like they tricked us into buying it. Why not improve on what people liked, and develop a new name for the new game? Seems obvious, but it's often not what happens. Why the heck would you burn down your franchise?

How many people would be able to travel into space to find pokemon? I think there will be a lot of people wandering into die verse city in the US, because the game is not as safe as it is in japan. Niglet attacks with stab. Perhaps a Grrrlpokemon instead.

Hasn't been released in Europe or Japan yet. Places like Holocaust Museum and 911 Memorial are complaining people are showing up just to chase pokemons so inappropriate.

(shrug) I think the "tactics" and teamplay were almost nonexistent, even in Battlefield. There are SO MANY things they could do to foster it, even force it, but it's all arcade anyhow.

So, might as well do some awesome space marine action. I stopped playing CoD after MW:2 and switched to Battlefield, but quit playing that eventually too. This looks like the first one I've wanted to play in years.

Thanks for your coverage of this, I've been thoroughly entertained by your spotlight and Derek's work. He's as fun to read as you are. And I bought a few of his games (LoD & UC, plus trying the older free ones) and a few more on the Steam wishlist (AAW, AoA, GC:ES) to check them out. (And free demos if that's your speed.) It's the least I can do express appreciation for Derek regardless of whether I end up loving the games or not.

Thinking about the technical side of Star Citizen's downfall makes me think two things; how important it is to get a end-to-end working game early in the alpha phase, and how cool a spaceship game with rudimentary 3D graphics (Elite, Rescue on Fractalis, Castle Master) networked up with many players could be. Work out the fun game and the interaction/infrastructure bugs, then upgrade the graphics.

Well of course it does. It's a cutscene using a higher-end version of the in-game engine staged to look like actual gameplay, you know, with no mistakes, player idiosyncrasies, or representative level length (it's a trailer, not a walkthrough). I have no doubt some elements of what the trailer shows will be in the final game, but it almost certainly won't look like or play like that.

Cool COD trailer, but I wonder why you would use pilots as infantry, why the enemy ship lowered the breach shield for the attacking soldiers, why a ship's artificial gravity doesn't affect things outside the window, or why it gets disabled by a broken window.

Yep! Rainbow Six (not Vegas), Ghost Recon, Operation Flashpoint, Armed Assault, SOCOM, SWAT.

Those games were tactical shooters, and they are all gone now... No that is not a tear rolling on my cheek... Stop it... I am not crying.

See shooters today shitted to be more simple-minded and fast happy-times events. Tactical say F you in your ass-cave and live with the fact that you haven't killed anyone in 10 hours of gameplay! No perks, no powerups, no different stats to characters, "it's a dog's world out there!". Basically tactical shooters are semi-simulators. Guess what happens when angry fat kid plays a game that actually demands ability from him?

So since he will break his TV, break his keyboard and shove his mouse up his six; is better to give a game where you don't have to be all that good to get a kill: Meet current shooters!!!!!!11ELEVEN!!!!!

I thought the enemy AI in that trailer were incredibly dumb, especially on the way to the exterior bridge. A whole crowd, not under suppressive fire, sitting there like they're waiting for a bus while being shot.

Hopefully you can turn up the AI difficulty in the campaign so you don't get used to soldiers worse than the iraqi army, then get crushed in multiplayer.

Single player is just the excuse to have the price at 60USD. Shite, you will love to have the Iraqi army around if you had that AI to save you!

No aew, We've been there man; that AI will blow, and the Hard difficulty will be just a mild form of aimbot.

Damn, that intro for COD IW is what squadron 42 should have been and we're getting it in a COD game.

I may have to pay attention now to IW. Last COD game I've played was black ops 3, mostly because friends wanted to do the co-op story missions.

I've completely ignored COD since COD III when they introduced a game play mechanism where an enemy soldier would jump at you out of nowhere in an unavoidable ambush and a message would pop up on the screen telling you which buttons to push in which order to win the fight. Y, Y, Y, Y, B, B, Y you win! Yay! Or, "You got confused and pushed the wrong button. You're dead. Boo! I felt like a chicken being rewarded for pecking the piano keys in the right order.

Can anyone tell me if that stupid game mechanic went away? Because that preview looked pretty cool and I'd like to try it if they aren't going to be constantly infuriating me with their idiotic game design.

It should be noted that it was not provided due to any obligation, law, or anything the US District Attorney did. Cloud Imperium simply did it to remove a toxic detractor from the community.

I REFUSE to buy an early access game on Steam no matter what or how far along the game is. You finish your game and I will consider handing you money for it. Early access is essentially paying a developer to never finish their game.

This situation is heart-rending as a fan of the original Wing Commander so many times over. I not ready to write off Chris Robert's yet, but he doesn't have my money yet either.

I knew things were really in trouble when Chris started pitching all the actors he was bringing in for Squadron 42. Ordinarily I would have been psyched, after all look at wing commander, but the fact was that he was moving towards producing cut scenes for a single player game when the original concept had yet to meet anything remotely what was initially envisioned for the dog fighting module.

I think Chris Roberts really just wanted to produce another movie, but after his Wing Commander flop there wouldn't be a studio in the world that would've backed him on a cinema project.
