Hillary skates again

Well, Justice Thomas already warned us that the Rule of Law no longer applies to the United States of America:
FBI Director James Comey on Tuesday announced the agency is not recommending the Justice Department bring charges against Hillary Clinton, while also denouncing the former secretary of state and her aides for the way they handled classified information through private email servers.

"Although we did not find clear evidence that Secretary Clinton or her colleagues intended to violate laws governing the handling of classified information, there is information that they were extremely careless in their handling of very sensitive, highly classified information," Comey told reporters in Washington, D.C., noting that the probe has found that the former secretary of state used several different email servers and numerous devices during her time in office.

Even so, Comey added later, “Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case. Prosecutors necessarily weigh a number of factors before deciding whether to bring charges."

Clinton spokesman Brian Fallon said the campaign was happy the FBI probe was now in the rearview mirror. "We are pleased that the career officials handling this case have determined that no further action by the Department is appropriate,” Fallon said in a statement on Tuesday afternoon. “As the Secretary has long said, it was a mistake to use her personal email and she would not do it again. We are glad that this matter is now resolved."
Seriously, how on Earth does this woman continue to get away with everything? I mean, even if you were a Power That Be, why would this, of all women, be the one that you'd go out of your way to protect no matter what she does?

They can't find anyone more competent? They can't find anyone less cartoonishly hateful?

Here is a good analogy that sums everything up:

I got taken to court for letting my cat walk around my yard without a leash (since it was in violation of the local "leash ordinance"). Seriously. That actually happened. The local animal control board as well as the local judge made it seem like I murdered someone. They fined me a few hundred dollars. I swore to not pay it. I didn't.

Clearly the Clintons are actively in league with Satan, who deftly arranges whatever deaths, treasons and malfesances are required to keep them going and generally promote evil and the fall of civilization. Actually, that's the optimist view of things.

The darker picture is rule of law is indeed dead, and the country is in the hands of shameless, ruthless and utterly corrupt people who will do whatever it takes to grasp and keep power.

The only people who can save us at this stage is *us.* Anybody who can vote for Clinton after what Comey said does not deserve citizenship. And Clinton, for her part, has been proven -- again -- to be utterly unworthy of a leadership role.

It just goes on and one, doesn't it? I highly recommend Fox's special "13 Hours at Benghazi" if you want to weep over how Clinton and Obama abandoned Americans and then blithely lied.

Little wonder Americans are moving to places like Italy.

According to anonymous source on 4chan, the FBI discovers all the dirty dealings involving the Clinton Foundation on the servers. What the FBI found, involved nearly the entire US government. If FBI went head with the case with Hillary, it would have prosecute almost all of Washington DC. Comey does want entangle himself with the Clinton Machine, and wake up dead from bench pressing in his home. /Pol/ has been finding links between to show where the Clinton Foundation is getting it money and favors it give in return. Considering there was no way an Obama DA would ever prosecute the democrat presidential nominee, the FBI recommendation was just a formality. All they could hope to achieve would be to put Obama on the spot for not following through with an indictment. That would inevitably result in career suicide for the investigators and do nothing to harm Clinton, so why bother.

I'm not a fan of Clinton but it looks like Comey did the right thing. The laws governing the misuse of classified information require 3 Thongs

1. That the person knew the info was classified.

2. Delivered it to someone who wasn't authorized to have it

And/or

3. Took the info from government custody with intent to keep it.

It doesn't appear #2 occurred and #3 would be nearly impossible to prove.

I don't see why people would be surprised about this. Mishandling classified information comes in two flavors: malice and gross negligence.

Malice is out here. There was no evidence of her sending classified information to third parties. So it's not espionage, and was never going to be espionage. She ain't no Snowden

Which leaves gross negligence. People in the intelligence community, military and law enforcement are trained in handling classified materials. They go through a screening process before receiving their clearance allowing them access to classified information. If they mishandle classified information, they get punished.

Politicians are not screened. The intelligence community cannot withhold information from a president or secretary of state because they don't have clearance. The "Oh, sorry, I didn't know I wasn't allowed to take this document home" defence sounds plausible from them. Proving that they weren't giving a shit as opposed to making an honest mistake is one of those things that is really hard to prove in court.

So prosecuting an offense like that against a public official is such an uphill battle, that no investigator would recommend that without overwhelming evidence that said public official knew they were doing wrong. Otherwise it's the kind of thing that gets some handsome actor to play you in a made-for-TV movie while you work as a mall cop and reminisce about the good old days at the Bureau.

But what if she had been indicted? There's no way the trial could be concluded by the election, so we're back into the same territory we were in with her husband. There's really no way you can try a sitting president. If the system doesn't seem to be working it's because, as Adams noted "Our Constitution was å only for a moral and religious people. It is wholly inadequate to the government of any other." The real problem here is the Democrats don't have the sense to nominate someone who hasn't been caught with her hand in the cookie jar over and over.

How about the people who decided which emails to delete out of the archive? Even if having her own people do that wasn't a gross abuse of power and a violation of several laws, how likely is it that any of the people who did the screening had the proper clearance to view the classified stuff which was at the highest levels of classification? Here's a hint: she had lawyers do it. They didn't have any clearance. Is that enough gross negligence for you?

This is all so very convaluted. It's hard to stay focused on what really matters, because so many things about this matter.

No, ignorance is no excuse. All of the people that sent the information (because Clinton isn't collecting it herself) were required to mark the documents with the correct classifications (regardless of whether that was a Private E1 or some brand new just graduated college inductee to State), and further, all the gov't classified email systems have macros built into Outlook that won't allow the email to be sent without selecting the proper classification. Part of the reason why there were discussions about scrubbing classification markings off the documents, there would have been umpteen levels of classification markings on all the docs.

Your argument makes no sense for anyone who has been tangentially related to the government. I worked for a defense contractor once and I was required to be trained on the handling of classified information on a regular basis. I didn't even have a clearance and my business had a grand total of 1 classified project involving maybe 8 out of 600 employees. If I as a civilian was required to know the rules (and would have been prosecuted if I violated them) then it's hard to accept a political appointee with a clearance shouldn't have been held to the same standard.

I was just thinking today how there should be a competence review in pretty much every government agency. Police departments, clogged down in affirmative action and PC protection, would be high on my list.

I'm slightly amazed that anyone is upset that Clinton was not indicted. If Clinton was indicted anyone who read those emails, used them or knew she had her own private server would also be guilty. I'm not aware of any sitting government or any government in the history of western civilization which has fallen on it's own sword to do the right thing.

The establishment always protects it's own. This has been going on since at least the 70's. Ford pardoned Nixon. Regan had Iran Contra. G.H. Bush had the S&L scandal (McCain got a pass on an indictment on that one and became the Republican Nominee in 2008...). Bill Clinton was brought up for impeachment. G.W Bush and Cheney had the sub prime scandal. Cheney shot a guy in the face. Obama had fast and furious (One of those guns was used in the Paris Terrorist Attacks). Everyone of these incidents was just the naked of face of power showing itself above the rule of law which the mob is expected is to comply with.

The problem is every time one of these incidents goes unpunished, it erodes the nature of the social contract. Declining prosecution on Clinton is one of the worst 'cock slaps' in the face to the social contract I've ever witnessed. At the very least this should have a significant number of people questioning their commitment to the current social contract.

Ironically Bill Clinton's non impeachment was the Alpha and Hillary's non indictment is the omega of the end of the establishment.

That's true, but here's where the rule of law comes in: The state likely cannot prove the obvious in that it can't show she traded money for uranium concessions and what not. But when normal people get an order to produce all the emails on a server and then delete some significant portion of them, they go to jail. Even if they can't get her on influence peddling, obstruction ought to be a slam-dunk.

The fact that codeword Top Secret emails were on her server at all is all the proof that is needed to convict for failing to guard classified information. Intent is not required. Her staff had to have transposed these emails from secret systems and typed them into the unclassified emails, and if Hillary didn't know that some of her emails were classified, that means she is manifestly too fucking stupid to be Secretary of State, let alone President.
The millions of people who have worked with classified information have got to be absolutely livid with anger. They know what she did, and that she gets a pass on it while others who have done much less have the hammer of God land on their head...
If she gets into office, any and all HUMINT sources all over the world should disavow all contact with their CIA case officers out of self preservation, and any technical means we have for snooping that have not been compromised yet must from that point on be considered bought and paid for by China.
The bad old days of Clintons will come back with a vengeance, and everyone will understand the virulent reflexive hatred the Clintons garner everywhere they go.

Not only that but there is more than enough evidence available to take it to trial and let a jury make the call.

There is usually very little solid evidence blood alcohol level for a drunk driver that refuses to take a breathalyzer and the officers fail to take them to the hospital for drawing blood. Despite that, prosecution is frequently brought against those individuals which depends on officer observations and opinions.

The evidence here is much better than in one of those cases.

"Gross negligence" is below "reckless" as mens rea. There almost is no way a federal jury wouldn't have indicted her under the Espionage Act. It is likely intent could have been proved as well. This is a big step toward total breakdown of the US government. The context is what makes it different. They were able to get away with past scandals because prosperity excuses many sins, the deniability or was plausible to enough people, or the orders came from the president, who cannot realistically be convicted. Now the charade of lawfulness is gone entirely; this alienates the loyalty of citizens to lawless government and forces them to lawful rebellion.

It still wouldn't fall apart if the economy didn't have everyone's back to the wall. The official statistics are as phony as the USSR's under Brezhnev, things are much worse than they seem.

Here's a bit I just saw elsewhere:

Everyone here has seen the alt-right becoming more militant and preparing; the whole population is moving in that direction, just from farther away. The election could be the rupture point, with a financial crisis likely at the same time.

Due to her open and notorious violation of the law, Hillary is by its specific provision ineligible for any office of trust in the US government, and cannot be allowed to take office no matter what the votes may be, or be said to be. She cannot be allowed to become president under any circumstances, the Supreme Court appointments alone would assure anarcho-tyranny. It truly is the very last chance before a war that may end up killing billions.

This could turn out very badly if too many people sit poolside or screw up.

One the one hand, she's guilty as hell. On the other, there are always partisans who think the other side's candidate is guilty of heinous crimes, and we've certainly seen Dems try the ol' last-minute indictment against a GOP candidate. Of course, in a real non-bananocracy, this would've been dealt with long before she was even a serious candidate. But, it's moot now. We really are heading into Gracchi territory. Next comes Sulla, then Ceasar (with a few interstitials here and here, maybe).

There's two things in operation here, that I can see. One is that as a simple fact of human nature nobody wants to be the secret emperor of Earth. The people increasingly ruling over every aspect of our lives WANT us to know that they rule, and who they are. As much as secrecy (in part) has been a key element of their plan to achieve the power they have, now they have it they want to exercise it openly. They don't want us merely to be afraid of "TPTB" or similar amorphous entities, they want personally the fear and the obeisance that goes with their power.

So necessarily, now they feel that the situation is beyond salvage by us, they think they can survive any attempt by the people to wrest back control of our own countries, our own lives, the gloves are coming off. The sheer evil of their plans is coming out in the open, as a necessary part of them personally coming out in the open.

A second factor is that they've been testing the resistance of the people to their machinations for decades now. It's not a coincidence that they have selected presidential candidates of such execrable qualities. Our willingness to "hold our nose and vote" for such treasonous non-entities is a good gauge of our own confusion, our own cognitive dissonance. Our own willingness to lie to ourselves.

Look at the presidents of the last decades. Not even counting the morons and cartoon characters you've rejected, look at the people who won: Carter, Reagan, Bush the Elder, Clinton, Bush the Lesser, Obama ...

People blatantly unfit for any public office, for the exercise of any power of any sort, and they've been made holders of the most powerful public office on the planet.

Why? In the name of all that is holy, why? Why would anyone do such a thing?

My conclusion is that the people who control them don't want principled or overly intelligent people in power. Like Roman generals, they tend to start having ideas of their own about who should be emperor in fact. So, only the malleable and/or controllable are permitted to higher office. That means, necessarily, only the already corrupt and stupid.

Since our would-be overlords are nothing if not opportunists, it is a secondary benefit that the people's willingness to accept these candidates, to glorify them simply *because* they are candidates, to actually vote them into high office even as we know without doubt they are fickle treasonous idiots, provides an accurate measure of our own condition. Of our lack of resistance to tyranny and evil.

So making it plain that Hillary is without doubt a criminal, and then promoting her anyway, is ideal tactically, from their point of view.

If anyone is at all interested in how I come to these conclusions, I will say that I used to be merely cynical. Then I read over many years the statements of many commentators to the effect that "no matter how cynical you are, when you find out what's really going on, you realise you haven't been cynical enough!"

After Snowden, several security and privacy experts said largely the same thing. Even as I knew what was possible with modern communications systems, I was shocked at the level to which federal agencies had gone to pervert the Constitution and invade the privacy of the people.

So I concluded what I had already suspected, which is simply to ask: If I was utterly corrupt and in possession of these capabilities, what uses for them could I think of?

And I assume that whatever I can imagine is the minimum of what is actually being done. It's not always accurate but it most often is. I knew our governments were spying on all of us, all the time, before Snowden. I just couldn't prove it. But I withstood the partisan attacks of the true believers and after Snowden they are suddenly quiet.

The OJ verdict was proper. I was unemployed at the time, and saw the entire trial. The only thing that could really convict him was the blood evidence (DNA).... but, the LAPD mishandled that -- One of OJ's lawyers questioned the LAPD officer in charge of the Evidence Locker -- who revealed that out of 9 vials of blood drawn from the suspect, the police could NOT account for 3 of those vials.

As soon as the witness made that statement, I knew that the verdict would Not Guilty -- because the LAPD themselves had introduced more than enough "reasonable doubt" into the case.

3 vials of blood is enough to contaminate an entire house and every object in it.


A vial of blood, some water, and a 50-cent spray bottle and you can frame ANYBODY, especially with the small number of objects and area that were in play in that crime scene.

This is why the jury foreman, when interviewed, said that they did not consider the DNA evidence. I'm an engineer, and if I had been on that jury, I would have
a) completely disregarded the DNA evidence
b) trusted the testimony of most witnesses for the prosecution far less than those for the defense -- for the simple reason that if the LAPD were willing to tamper with DNA evidence, what other evidence were they ALSO willing to tamper with, so as to decieve various witnesses into saying things that would make Simpson seem criminal.

LA attracts a lot of kooky people -- not quite as kooky as SF, but SF tends to get the wimpy kooks, while LA tends to get the violent kooks. For all we know, someone killed her for mudsharking, or fag-chasing.

Re: intent, legally the required intent may be inferred from the obvious and natural consequences of the act. Further, the use of unsecure private servers is all the proof that is needed to prove the necessary intent in this case.

Second, when I used to sport a high speed, low drag clearance, I would have lost it for merely talking about doing what Hillary did. - would have spent time at Leavenworth for actually doing it.

Finally, this is the first time I've ever seen a cop refuse to pass the buck to prosecutors. Usually, the cop says that he just investigates, prosecution is up to the prosecutors. How ironic that Comey inferred what the prosecutors would do, but denies a jury the opportunity to make an inference actually allowed by the law...

I'm somewhat surprised Comey took quite that tack. There was another and possibly better one; legally better, I mean.

Different government agencies have different security procedures. For example, a DoD TS SCI means essentially nothing at State unless State wants it to. They have their own background investigation teams for security clearances and, I believe, their own classification systems for information. Yes, the terms are the same. The criteria and who gets to assign the classification are not.

Well, no GS-7 literally or digitally stamping documents in the basement at Foggy Bottom outranks the Secretary of State. She can overrule them, explicitly or implicitly. Were I Comey,I think I'd have argued that she did _and_ had every right to, at least with regard to information classified by State, itself. DoD and Agnecy information would be different, but that's almost a case of no fault, since mentioning that something's been compromised can bring it more attention than ignoring it. It might, after all, have been missed.

Comey has access to lawyers at least as good as I am, and people familiar with security much more so. He should have known this and probably did. So why not take that tack? Because it would illustrate Hillary more clearly as the out of control, tyrannical bitch she is, which would damage her chances slightly (among the few who don't already know this and might care).

What dif? The difference is that making that kind of judgment call means the Bureau is even more in the tank for the left than we might have otherwise suspected.

I think that she's the mark in a third-level confidence game.

There are multiple levels of cons. First is getting the mark's personal trust, such as by convincing a dotty old woman that you're her nephew. If you look around the poker table and can't spot the chump, then it's you.

Second is playing on the mark's greed. Let it look like the deal is too good to be true, but that's because of your mistake: you're ignorant, or time-pressured, or it's a little shady so you can't go through legit channels; one way or another, you deserve to be overcharged, and he's being clever to take advantage. If you look around the poker table and you've never played at this level before, yet you think you spot the chump, then you just Dunning-Kruger'd yourself and that's actually the shark or his partner.

Third is playing on the mark's hubris, and tricking them into thinking that they're the conman. If you look around the poker table and think they're all chumps, then no, that doesn't make you a super-shark; it just means that they're all in on it together, and now you're really in trouble.

So she got (minor, limited, aging) dirt on everyone who is anyone inside the Beltway. She thinks she's a super-shark who is forcing everyone to join her corruption, so that then she'll be immune -- when really, they tricked her into tying into all of their scams, so that now they all have a lightning rod who everyone knows is corrupt.

So now if their web of corrupt dealings gets exposed, the entire city will just hang it all on Hillary's neck, and sacrifice her to the bloodthirsty god of public anger. Lay low for a bit until it all blows over, then go back to business as usual with a bit more discretion, while she rots in Club Fed as the scapegoat for all their sins.

That's my best hypothesis for the otherwise inexplicable.

Regular people don't want to understand that every time they supported the Demoncrat party in the USA, they were giving the Leftist alliance more resources. Resources which they, for whatever reason, decided to begin using since about 2007-2008.
