Flynn to withdraw guilty plea

At least, we are told that something of the sort appears to be in the works:
On Friday, Judge Emmet Sullivan issued an order in United States v. Flynn that, while widely unnoticed, reveals something fascinating: A motion by Michael Flynn to withdraw his guilty plea based on government misconduct is likely in the works.

Just a week ago, and thus before Sullivan quietly directed Special Counsel Robert Mueller’s team to provide Flynn’s attorneys “any exculpatory evidence,” Washington Examiner columnist Byron York detailed the oddities of Flynn’s case. The next day, former assistant U.S. attorney and National Review contributing editor Andrew McCarthy connected more of the questionable dots. York added even more details a couple of days later. Together these articles provide the backdrop necessary to understand the significance of Sullivan’s order on Friday....

In his plea agreement, Flynn agreed to “forego the right to any further discovery or disclosures of information not already provided at the time of the entry of Flynn’s guilty plea.” On Wednesday, however, the attorneys in the Flynn case presented the court an agreed-upon protective order governing the use of the material — including sensitive material — the special counsel’s office provides Flynn. This indicates Mueller’s team will not fight Sullivan’s standing order based on the terms of Flynn’s plea agreement.

Why Bombshells Are Likely Ahead

With a protective order in place, Flynn’s attorneys should start receiving the required disclosures from the special counsel’s office. There is reason to believe these will include some bombshells.

First, we know from the recently released GOP House Intelligence Committee memo and the Grassley-Graham criminal referral of Christopher Steele, the FBI and DOJ withheld significant (and material, in my view) information in seeking a Foreign Intelligence Surveillance Act (FISA) warrant to conduct surveillance on Trump campaign volunteer Carter Page. There is cause to believe the FISA court was connected to the criminal charge filed against Flynn because Contreras, who recused less than a week after accepting Flynn’s guilty plea, “is one of just three FISA court judges who sits in the District of Columbia, where it is likely the Trump-Russia FISA warrants were sought.”
Looks like things are about to heat up again on the Drain the Swamp front. Stay tuned.

IF this thing blows up as much as it could. The GE and his team will have to make sure their case is absolutely airtight.

He cannot count on the FBI or the Justice Department, so he will have to declare a 'State of National Emergency' and implement martial law. Minutes later various special units of the US Military would be tasked with executing arrest warrants.

If it all goes down as I hope, we may see the 82nd Airborne Division perp walking the FBI and CIA. I will, of course, have to seek medical attention, as my physical reaction will definitely last more than 4 hours.

When the perjury on the FISA warrant came out it became almost certain that Flynn would be able to get the case against him thrown out. The warrant was illegally obtained, tainting any evidence gained using it. Without that evidence, there is no case against Flynn.

There is NEVER too much winning.

I don't see Trump needing to declare a state of national emergency. I can see a possible waiving of Posse Comitatus restrictions on the use of the Armed Forces for law enforcement, but suspect it would be more in terms of a very temporary measure to provide reinforcements for existing civilian law enforcement.

From the beginning of the Trump Presidency, there has been chatter on Twitter that General Flynn was part of a secret plan to sacrifice himself in order to bait illegal elements of the deep state into exposing themselves. When Flynn plead guilty, it threw something of a wet blanket on this whole notion. But if he had known all along that the guilty plea would never hold up once the bombshells were known, then the original theory could still hold up. Interesting turn of events regardless.

At some point, it becomes malpractice for any criminal defense attorney to accept undocumented assertions made by FBI agents.

This will put a huge drag on the FBI system. It will be the one thing that finally disgusts the FBI rank and file to the point where they'll be willing to get off their asses and rescue their agency's reputation - about which they've been far too quiet.

And if they don't rise up once their own efforts and character are impugned, then maybe we discard this whole "the rank and file are honorable, it's the heads that have strayed" meme.

The question is when did it become the "Flynn Gambit"? They've run much of the White House like a Counter-Intelligence operation, but at some point Flynn became the source that had to be burned to lock the Deep State into their path. I'm quite sure he wasn't happy to do that to himself, but everything after he left has looked exactly like a counter-OP to the Deep State.

Take it for what it is. We don't know yet.

A defense attorney would be very reluctant to advise a client withdraw a plea unless there was a great probability the case would be dropped and jeopardy couldn't attach again, which is to say here the prosecutorial misconduct was too overwhelming to allow any case against Flynn to go forward. We are in for an interesting few months.

Ted Stevens (same judge presiding over Flynn plea): FBI whistleblower came forward that Holder's DoJ committed serious Brady Rule Prosecutor misconduct (same rule Flynn judge just ordered) & conviction was set aside. Judge Sullivan called DoJ conduct outrageous and held them in contempt; entire prosecution team was sacked including DoJ Chief of Public Integrity who was at heart of violations. Two prosecutors were suspended; suspension was later overturned. Stevens convicted two weeks before an election he was going to win otherwise had the intended damage done.

Duke Lacrosse: Prosecutor Nifong sent to jail. Duke Lacrosse team exonerated. Their academic lives thrown into turmoil; intended damage done.

NOLA blogging: Online blogging scandal by NO US Attorney office took scalp of US Attorney Jim Letton, then-longest serving. Letton's First Asst. Prosecutor Jan Mann, Prosecutor Sal Perricone, and DoJ officer all were caught anonymously blogging on local Nola.com insider prosecution information. Federal judge Englehart tossed nearly every conviction they touched during the time they were doing it, including the convictions and sentences of the officers involved in infamous Katrina-era Danziger Bridge shooting; in one of the cases tossing out mandatory 35- and 60- year sentences. The career prosecutors were sacked and Letton (didn't engage in misconduct and said he was unaware) resigned.

2015 Twin Peaks Biker Shootout likely going to be a bust since cops just went in guns blazing and prosecutors sought to charge based on affiliation not acts. Probably nothing going to happen, but intended impact on bike gangs has already been incurred.

Cloven Bundy: all not guilty; no misconduct technically formalized beyond clear Obama-era prosecutorial overreach and heavy-handedness by BLM. Probably self-correcting under Trump admin.
