They don't have the right

Lawfare works:
Covington Catholic High School student Nick Sandmann received reportedly has received a settlement from CNN after suing the far-left network for smearing him last year.

“CNN agreed Tuesday to settle a lawsuit with Covington Catholic student Nick Sandmann,” Fox 19 reported. “The amount of the settlement was not made public during a hearing at the federal courthouse in Covington.”

Sandmann also filed lawsuits against The Washington Post and NBC Universal, each for $250 million or over, and is reportedly planning to “sue Gannett, owners of The Enquirer.”
The big social media companies are even more vulnerable than the big media companies. The problem, of course, is that no one ever stands up to them.

I'd call this a 99% own - I'm sure Sandmann and co are happy with this comparatively easy victory but ultimately its hard to say what the impact will be on the industry.

This is what CNN argued in their defense!

“Courts treat statements characterizing people as “racist” as nonactionable opinion because they cannot be proved true or false… Sandmann cannot as a matter of law base a defamation claim on this statement as it offers an expression of opinion so subjective as to be unprovable.”

So, 'racist' is a meaningless word.

Fantastic outcome. We live in a country with 70% of the world's lawyers. It would be nice to find a few creative ones, train them our way, and throw them into the fray.

But until then, they're swamp-creatures bogged down in parroting case law, content to be ever-encroaching parasites on society.

Disappointing that there was no public apology or public retraction of the defamatory statements. So Jeff Zucker gets to spend shareholder money to cover his own ass and skates completely. Unless the settlement amount is enough to choke the proverbial horse the Craptastic News Network will go right back to business as usual, lying, defaming, slandering and faking their way through every news cycle.

as i understand it, settlements of this type usually include a non-disclosure clause for the plaintiff and a clause in which the defendant does not admit to any wrong doing and the plaintiff agrees to quit any further claims at recompense for harm which may / not have been inflicted.

and then the judge seals the court record.

however, i believe these are all publicly traded corporations
...
therefore, you might get a general idea by looking at their year end financials under the "legal expenses" line item.

You can bet it was pretty rich since they'll be using this as leverage against the balance of the defendants. That stated, I'd have no confidence in most 16 year old youngsters to keep a large to huge settlement confidential. That's going to take a lot of discipline unless his parents are keeping the funds in some kind of vehicle that shields the amount from Nick. This is great news!

Good for Nick. I guess the insurance company leaned on CNN to settle ($1-9 million settlement is my guess). Less than cost of trial, plus avoiding discovery. You can win, but the system is still pretty stacked.

It's not as good as CNN losing in court would have been, but it's good. It proves you can sue, and settle, and settling is as good as winning. That's going to be powerful incentive for others to try their luck when wronged.

If the settlement was only $1M, it will only take 250 copycat suits to burn CNN as badly as winning the full $250M would have.

Nah, this is just an example of how they once again thought they could get away with anarcho-tyranny in the courts. In the Great American non-Justice System, for the left it's usually heads they win, tails you lose. This looks like one of those rare exceptions where somebody screwed up and blind justice actually prevailed.

CNN made a tactical move. Somebody on the defense team thought that it wasnt winnable, that discovery was not a good idea, they would be forced to publicly admit they lied, and a court loss is precedent.

If any if them loose it will expose them to a torrent of lawsuits from the legion if people they have smeared and destroyed over the years.

The twitter rumor mill says $25 million. To my mind it makes a big difference how the payments are structured. Lump sum is very different than yearly payments.

The telling thing about that whole event was how the MSM and left interpreted that kid's expression. Pretty much the whole story was his expression, when you whittle away the fake news about how the two ended up in a face-off. Or face-drum-off.

It is obvious to me the white one was being polite. Which is a kind of neutrality. Idiots saw naked aggression. For a while, white people smirking was thought equivalent to setting dogs on noble minority protesters.

Was this was an example of the projection we talk about so often? Or are they just so racist (in the bad sense) that a white face enjoying itself, even for the sake of peace, legitimately terrifies them?
