The end of the EU is in sight

The Germans have decided that their law takes precedence over what passes for EU "law":
A ruling by Germany’s constitutional court has sparked serious fears of the unravelling of the European Union.

It’s a delayed judgment from an old fight that has hit the EU at its most vulnerable. A group of German academics, including a former leader of the far-right party Alternative für Deutschland, Bernd Lucke, took a case in 2015 to challenge the bond-buying programme of the European Central Bank (ECB).

They hardly hoped to win, but thought they could make a political point. During the euro zone crisis, as now, the ECB was buying the debt of economically weaker EU countries to bid down their borrowing costs and rescue them from the threat of a debt spiral, and directing national central banks to do likewise.

This is an emergency measure taken to hold the euro zone together when its economic imbalances threaten to tear it apart, but it has long been hated by German conservatives who believe it harms savers and pension funds.

Last week, the German constitutional court unexpectedly sided with them. It ruled that the ECB failed to conduct a “proportionality” analysis of the effect of its bond-buying policies on “public debt, personal savings, pension and retirement schemes, real estate prices and the keeping afloat of economically unviable companies”.

In a pithy 110-page judgment, the court ordered the German central bank to stop buying bonds if the ECB failed to produce such an assessment within three months. This immediately raised fears it could jeopardise current bond-buying efforts, and cause a run on Italian debt.

This is perilous to the euro zone, but not as damaging to the EU as another part of the ruling, which has tugged at a thread that some fear may lead to the unravelling of its very order.

The German court stated that it was free to ignore an earlier ruling from the European Court of Justice (ECJ) on the issue because “the Court of Justice of the European Union exceeds its judicial mandate”. This is contrary to the concept of the primacy of EU law. Under this precept, if laws of a member state are in conflict with EU law, EU law takes precedence, and the ECJ is the final authority to adjudicate on it. For the European Commission, agreeing to this is what it means to be a member state.
The Germans have effectively declared the EU to be nothing more than a treaty that nation-states can ignore at will. It's a bit of a surprise, as I would have expected the Italians to be the next to leave the would-be Fourth Reich, with the Hungarians and Poles as dark horses.

The nations are rising at last.

Again, the idea that a bunch of countries with different languages, cultures, and histories could become a United States of Europe is just plain stupid. Here in the US we have all of those things (more or less) in common and the system still doesn't always work. What made our European cousins think they could manage such a miracle, especially considering the blood they spent the last 1000 years spilling?

The interesting thing will be what happens when the shoe is on the other foot. When other countries start ignoring pro-Germany orders from the EU, will the Germans say, “yeah, that sucks for us, but we did the same,” or will they say “you will be made to comply!”

Time will tell, but our hope is, as always, with the nations.

Germany, being the new kid on the block in terms of European nationhood, has never really been too keen on being told what to do by its elders, like most surly teens. The 2008 crisis exposed the fact that faceless, non-elected, non-German bureaucrats have the power in the EU, so it isn't terribly surprising the Germans are starting to buck.

I wouldn't bet on the Germans leaving any time soon TBH - my read of the situation is that the politicians there will try and ignore this ruling as best they can, and be largely successful in doing so. I'm sure the ECB can cobble together a suitable analysis - 3 months gives them plenty of time to torture the data until it complies, at which point the whole merry scam carries on as before. Given that, I think I'll stick with your original expectation.

Kind of like when Boris Yeltsin, President of Russia, pulled Russia out of the Soviet Union. With Russia no longer a member forcing everyone else to stay in, the rest of the Soviet Union quit, too, and Mikhail Gorbechev woke up one morning in a hotel at a Black Sea resort to find out that he was unemployed, due to his erstwhile employer no longer being.

Only this time, it's Germany's Supreme Court instead of Merkel.

My guess is Italy will attempt to get out from their debt by printing money, as Italy always does. It has worked, rich people put their money in Switzerland and at the end of the day Italy is a very pleasant place.

Germany and France got their United States of Europe. Much to their surprise they realized that many of the other countries only wanted their cash. That explains why my Greek friend was drunk posting about how the Nazis are leaving them broke and destitute again

As to the article, there's a reason you meet so many Germans everywhere. They can't stand the bureaucracy in their own country, and there's been a layer added like a suffocating chip dip. It's really inevitable that these layers get into turf wars.

I am sorry to say but my German neighbors do worship the State for at last 500 years. But not all the blame can be placed on Mr. Luther.
The first notable king of Germany, Otto the I with a Byzantine princes for a wife imported also Byzantine courtiers and lawyers...
In my Poland Germany is seen as a byzantine civilisation while i.e. Russia is a tyrannical one.

To the best of my knowledge, countries which are in the Eurozone are not able to issue currency off their own backs, they have to go via the ECB. They may be able to create money by issuing bonds, but i am no expert in these matters, so defer to greater knowledge, if anybody wants to chip in.

I do know that we wont see a return of every Italian being a 'millionaire' by default like it was with the lira, at least as long as they are on euros for money.

One can argue that a united Europe made a better bulwark against soviet expansion westward, but that’s kind of an admission of the fundamental proposition.

It’s not that the Europeans are innocent of the stubborn hubris required for this project, especially the current generation of bureaucrats, but it’s beginnings were in Washington.

Of course, the prog tendency is to say federal (EU) law trumps state (US) law when it serves their interests, whereas the reverse is also true when it serves their interests -- as with, for example, California's sanctuary laws.
