The end of the Supreme Court

It's clear that the inverted justices of the Supreme Court are observably among the "all asserts" that have reportedly been activated.
Within 35 minutes today at 10 a.m. Eastern, what some thought was the most conservative Supreme Court of all time concocted a fundamental right to transgenderism in the context of labor law, erased the Second Amendment, and interfered with a state death penalty case, but declined to interfere with a California law that criminalizes law enforcement cooperation with federal immigration agents.

Taken in totality, the “conservative” legal movement, which has promoted the idea of “appointing better judges” rather than fighting the entire concept of judicial supremacism, has failed miserably. This was its Waterloo.

Here is a brief summary of four very important decisions and orders issued by the court today:
  • The justices denied certiorari to gun rights groups in 10 gun cases where states have denied citizens the right to carry arms under any circumstance. Justice Thomas dissented in the denial of cert in the New Jersey right to carry case and was joined by Justice Kavanagh. It takes four justices to agree to hear a case, and it’s not clear which of the others would also have agreed but didn’t sign on to the dissent. Despite the plain meaning of the Constitution, 10 years after Heller, and with circuit splits, the court refuses to act.
  • In U.S. v. California et al., the Supreme Court denied the petition from the Department of Justice to overturn a Ninth Circuit ruling upholding California’s sanctuary law. California prohibits local law enforcement from cooperating with federal immigration agents. Only Thomas and Alito would have granted the appeal.
  • In what has become a growing trend of SCOTUS interference with the few remaining capital punishment cases, the justices remanded a Texas capital case because they believe the accused did not have sufficient counsel. Alito dissented, joined by Thomas and Gorsuch.
  • In a 6-3 opinion written by Justice Gorsuch, the court ruled that Title VII of the Civil Right act, which passed in 1964 before anyone could fathom transgenderism, applies to transgenderism and sexual orientation.
Taken together, these decisions show the court believes there is an inalienable right to transgenderism and illegal immigration but not to the Second Amendment. The court believes it can tamper with every state criminal and capital conviction on ever-evolving novel grounds, but it somehow believes a state can criminalize foundational federal immigration powers.
It's just another failure of conservativism. The good news is this is one more step towards the end of Paper America and the false hope it offered to those inclined towards cuckservatism and civnattery. Americans were never going to sue their way free of emanations and penumbras.

The federal courts have been famously dirty for years. Our federal bench here is about 2/3 politically corrupt, and 3 of the judges are known to be personally corrupt.

The Third Circuit had a rule that since the second amendment was not an absolute right, any government restriction at all were fine. Heller undid that, but democratic judges literally don't care.

The Sixth Circuit, also very liberal, has for decades decided everything in a death penalty case is ineffective assistance of counsel. The insane circuit court decision that Trump's personal twitter is an official but unofficial government communication device so he can't block anyone but his tweets aren't protected

Socially I disagree that gay should be a protected class. Legally there is a lot more basis for this decision than a lot of the policy decisions out of the supreme court. I only read the decision once, but there is some argument for it on that one read. If Heller is in the 100% supported category, and Roe v Wade is the 100% unsupported example, than this is abut 1/3 of the way down from Roe

OK. So why bother to vote in Nov.? Maybe the way to go is vote in dems everywhere in sight. Give them the Presidency, both houses of congress, most governorships. Then, let the new/old normal simmer for a brief time and have at it with Civil War 2.

Time to press the accelerator pedal to the floor. If you are fired for being white, male and conservative, drag the company who fired you into court and claim they fired you for being transgender. We all know that there is no objective way to prove you are or are not, so make them eat that, raw.

This also sets up a contradictory standard for discrimination by sex, because if one wants to keep special dispensations based on sex, you cannot exclude based on gender. MTF trans can, and will, sue to get all the special set sides reserved for women, and there isn't a damned thing anyone can do about it.

In short, it is time to go full accelerationist so as to make the stink of this so bad that something breaks.

It shows that if you had 9 conservative justices, they would still defer to the states and to precedent too often to ever seriously roll back leftism through the courts. You'd need activist conservative judges, which is kind of an oxymoron. They could exist in theory, but since conservatives are more focused on playing fair and by the rules than they are on winning, that type would never get to the bench.

I had to laugh at the idea that some think this is the most conservative SCOTUS of all time. As if *anything* that exists today could be more conservative than what was the norm a century ago.

Unless you're willing to go rogue and pick men from outside the judicial system entirely--who would never get past the Senate--these are the best you can get. I’m admitted to and actually practice before SCOTUS and its bar. When in term, nearly every Justice is vulnerably reliant on staff to sift through an avalanche of records and issues. Clerks serving their respective Justices socialize together and debate (guardedly) and since many are at least paper communists and all are screened for wokeness the influence of the leftists disproportionately percolates up to and through the “conservative” Justices and this affects their votes and other decisions. Enlarging the Court _might_ help address workload for the rightward-leaning Justices and thus restore more balance on issue selection and opinions. But I doubt it because the cake is already baked by a law school system that winnows top clerkship positions until only leftists from affluent families remain candidates for SCOTUS clerkships. Or we’d need to amend the Constitution to restrict the power of SCOTUS and good luck with that.

I've had to stomach hearing and seeing other attorneys gush about this abomination today. They virtue-signal while simultaneously preparing to line their pockets in yet another onslaught of litigation against the productive members of society.

The 1964 Civil Rights Act already was offensive because it has NO basis in civil rights as covered by the Bill of Rights or the Fourteenth Amendment. Instead, it is a grotesque contortion of Congress's power over "interstate commerce" to regulate what is neither interstate nor commerce, as blessed by the members of the Court for a long time. Indeed, the Civil Rights Act represents an attack on our civil right to associate or not associate with whomever we choose, so today's ruling just compounds the outrage a little more.

It's the 2A denials that trouble me the most. The Heller decision has been blown off by the lower courts...and SCOTUS won't trouble itself to correct the situation.

One really DOES have to wonder what the hell someone has on Roberts. Thomas is chomping at the bit (he wants to write the decision, and thus write his name into the history books), I think Alito, Gorsuch, and Kavanaugh are OK...but Roberts seems to be the weak link.

This next election will be critical. Win, and we've got a fighting chance.

This is an example of nonsense which has been spewed endlessly by Trump loyalists, mostly from ignorance. Trump probably didn't choose any of them personally except maybe those on the Supreme Court. The ones doing the vetting for judicial appointments are The Federalist Society, a longtime conservative (= swamp) institution. They even managed to nominate an Antifa judge (Thomas Cullen) to the federal kritarchy a few months back. Like Chick-Fil-A, the Boy Scouts, the USAF and countless other conservative institutions, the FS is obviously converged. Perhaps this another part of the great revelation... or unveiling.

At the end of the day, Trump bears responsibility (gets to take the blame) but this raises the question of whether he's really in charge of anything except maybe his Twitter account. Is he just another puppet?? Obviously the nominees go through Kang Jared (a devout Satanist) so the recent idiocy is not all that surprising. The judicial nominations have been in the typical GOP "conservative" pattern. If one has delegated important decisions to the Devil's servant, it will not work out very well - irrespective of one's intentions. I don't understand what is stopping everyone from now just retaining 'Saul Goodman' and declaring to HR via a sealed form they are a cross dressing, gender fluid, homo-sexual. Same pattern as with the gay marriage decision: a court theoretically dominated by "conservatives", but when it comes to making a decision one or two of them have an "unexpected change of politics" and vote with the "progressives". "progressives" vote in block and the decision passes in favor of the "progressives". Conservatives then make a decision in favor of some corporations to appease the corporate side of the republican base and to make it look like the court still has a "rightwing" twist. This Bostock decision is so wrongheaded. Despite the Court's reassurances to the contrary, they ignored long established rules of statutory interpretation to decide that "sex" means something other than what it meant when Title VII was written. The Court overstepped their authority by, in effect, rewriting Title VII - this authority belongs with the legislative branch. Further, the Court invited litigation to challenge the definition of "sex" in other laws.

I believe Bostock will end up being as divisive as Roe has been.

I don't believe, though, that anyone who was around when the law was passed would have understood the statutory text forbidding employment discrimination on the basis of sex to require employers to have perfectly identical, asexual behavioral standards for men and women. The Gorsuch reading only makes sense if originalism requires autistic, out-of-context literalism.

Some still believe The Book of Judges is somehow an apologetic for a republic ruled by philosopher kings.
It is precisely the opposite. God does not rule as first among equals. Why should the image of God do so either?

Ever since I was a child starting kindergarten, I realized we were headed for a civil war. I got my education, and then joined National Guard unit... stayed in the Guard until I became too old to keep up with front line units, and switched to the Reserves.

Why? Because this way, the government is training me, as the equipment evolves, so does my training. I understand the strengths and weaknesses of what we have, and what we used to have (much of which now in civilian hands if it isn't secure communications equipment or weaponry). [Protip -- the best red-dot sights out there are the ACOG (Advanced Combat Optical Group) made by Trijicon with a fiber optic light collection system to automatically adjust the brightness of the red dot to ambient conditions. The only time it doesn't work well is if you're in a dark place and you're shooting at someone in a brightly lit area.

I've stayed for coming up on 31 years now.
I've put my civilian life on hold multiple times to go overseas, for both training and for wartime deployments. Why? In preparation for the times like we are about to experience. Many might say that my time in Iraq was a waste, fighting for the deep state and conservatards. But most everyone I know who went to Iraq and Afghanistan consider it to be something else -- graduate studies in asymmetrical and 4th generation warfare. Returning home alive is part of the course.

The day is near when I can & will apply the lessons.

The least you can do is get off your lazy ass and vote.

I just finished reading Sydney Powell's book Licensed to Lie: Exposing Corruption in the Department of Justice, published in 2014.

Powell documents the systemic prosecutorial corruption and misconduct involved in the Sen. Ted Stevens case and the Enron case (with the subsequent destruction of Arthur Anderson, Merrill-Lynch and other companies caught in the government's web of lies). Recall that a certain judge named Emmett Sullivan was "outraged" by the prosecution team during the Stevens case, which was eventually tossed by the Supreme Court - but not before Stevens was hounded out of office. In all of those cases, THERE WAS NO ACTUAL CRIME. The prosecutors LIED repeatedly in court under oath, modified documents, failed to produce exculpatory evidence and threatened potential defense witnesses with indictments (for "process crimes" such as lying to the FBI) if they testified for the defense - and the judges refused to even consider any corroborating documentation (made by the prosecutors themselves) by the defense. (Does that sound similiar to the legal events of the last three years?!?) Judge Sullivan was lauded by Powell as someone with integrity - at least up until her book was published; I wonder how she "feels" now with Judge Sullivan's bizarre antics in the Gen. Michael Flynn case to dismiss.

The most corrupt government prosecutors in all these cases have been advanced to the highest levels in the government or lucrative "revolving door" appointments at prestigious law firms, including people like Andrew Weissmann (Mueller's "pit bull") and Elena Kagan, the Obama Solicitor General in 2009, elevated to the Supreme Court in 2010.

I knew that there was corruption in all branches and at all levels of the government (having been on the receiving end of it in a relatively few minor matters), but I had no idea it was this pervasive and blatant, especially in the judiciary. I was naive, assuming that the majority within government were NOT corrupted.

After spending 10 years working in Security and going to General District Court on numerous occasions as a witness to crimes, I'm no longer naive. IT STINKS AT ALL LEVELS!

The working hypothesis here is usually that the people at the highest levels of government have some sort of hidden sexual improprieties being held over their heads to blackmail them. It is just as probable to me that most of them have some sort of legal misconduct (either in their early career or currently) that is being used to control them. Perhaps it is both; Epstein had a lot of "grease" at the highest levels of government - at least until it became "expedient" to silence him.

That it will. However, it will be much like aeriel combat -- brief, but furious. As many have noted, the cities, which are the lefist strongholds, are concentrations. One of the lessons of 4th generation warfare is the concentrated forces are vulnerable in proportion to the concentration. And places like New York, Chicago, LA, San Fransisco, etc. are very concentrated.

We have discussed how EVERYTHING (refrigeration, fresh water processing, (and therefore toilets), gas pumps, etc.) is dependent upon electrical service, and how vulnerable urban centers are to having their power sub-station transformers ruined, with an 18-month lead-time on orders even during PERFECT conditions. And the wire windings are all vulnerable to rifle bullets shot from several hundred meters away (and because these things are anywhere from the size of a shed to a small barn). And at the same time, the countryside would be hardly affected -- momentary surge as current is redirected before the transient dies.

There will be LOTS of action in the suburbs. But suburban libs are disarmed. The only heavily armed leftists are the very few people who pull the plutocrats' strings, and the ghetto-dwellers. The first group is widely dispersed, but extremely few in number, and unable to provide mutual support for each other. The ghetto-dwellers, while many in number, generally can't shoot past pistol range, if they get their hands on a full-auto weapon, will go through their ammo in no time (Vietnam style spray-and-pray).

And every gun owner in suburbia knows who the neighborhood commie libs are: They're the ones who can't help covering the rear bumpers of their cars with smarmy slogans from their pseudo-intellectual leaders (these slogans tend to be brittle -- all rhetoric with no dialectic foundation).

The combat arms (other than artillerymen) are overwhelmingly white. Even artillery observers tend to be white (guess who controls where the artillery lands?) as artillery observer is a separate MOS line from gun crewman, and they run around with the infantry.

Traditionalists who live in the cities and close-in suburbs are the ones who are most at risk. If they come out alive, they will probably lose everything. The good part is, if there is enough violence of action, the war will not drag on for years (just like a 1-on-1 street fight, battles between closely intermingled forces tend to come to a decisive decision (death, not retreat & regroup) for the losers rather quickly.

I would rather we don't have a civil war, but it is inevitable. I pray that it is after the election than now (as our side will be more motivated regardless of whether Trump wins or loses -- if Trump wins, the Left will become even loonier and remove the mask entirely. If Trump loses, the left will still remove the mask entirely shortly after inauguration day.)

It only takes 4 to grant cert.
This means 2 of the "conservative" justices denied cert on the gun case.

Note, there's still the NY case which has been granted cert and is being argued.

They may be using that as the vehicle for enforcement and denying so as not to clutter the docket, but even in a worst case scenario it's simply "status quo".

I am looking forward to the Transgender ruling barging "package-first" into the locker rooms of suburban leftists' little girls. It's the fastest way toward a preference cascade back to sanity.

@6- There is no legal basis for rationalizing the Gay or tranniedom as a protected class. Not if Congress don't pass no law saying so. (Remember legislation? A thing courts didn't use to do.)

You tell me "on the basis of sex" means "on the basis of considering chopping off your junk" or "on the basis of whether or not you put junk in your mouth," and I'll petition for you to be civilly committed for your own safety.

If Washington wants to make protected classes out of these freaks, let them pass a law and lose their next election.

Legally there is a lot more basis for this decision than a lot of the policy decisions out of the supreme court...

It is the congenital dysfunction of the legal profession that it believes finding a way to justify the process is the same as - indeed better than - justifying the result.

The result of this decision is an abomination, therefore the process was an abject failure.

But, how long do we wait? Trump got two SC judges appointed. Seems only one came though. Maybe? I also agree with the question. What the hell do 'they' have on Roberts. And, that does not include the flaming libs on the court.
How about one supreme court judge from each state? Appointed by each state or even elected. 10 year term maximum. They sit in a big circle with the action going on below them like an arena. 50 of those suckers. Might even work.

Acquaint yourself with Marbury v. Madison (1803) It is the primal scream of judicial supremacism, and it was a case where John Marshall was deciding a case he had an impact on creating. Marshall should have been impeached for misconduct-failing to recuse himself-instead, he is venerated as a great jurist.

By the way, this follows the refusal to hear the case against Emperor Wolf and his Transgendered Side Show a couple weeks ago.

The lack of an all out assault by the left on Gorsuch was the tell that Gorsuch was just another Harvard leftist, despite the hype.

Worse, he was born in 1967. He could be on the Court for another 35 years.

Hmmm...Let's think about this for a moment.

Not granting cert on the gun rights issue may have prevented a disastrous over-turning of Heller. Roberts did not grant cert because he likes what the lower courts are doing and Gorsuch did not because he could not risk that Roberts' betrayal would lead to Heller being overturned.

The Texas death penalty is interesting...but...we have seen how prosecutors behave and what law enforcement does in practice. This is probably not too big a deal.

California sanctuary law is safe for now, but is probably a tabled issue until other matters are dealt with first. Besides, Covid and rioting is muting the effects of the sanctuary law anyway.

The big "loss" is gay and transgendered rights, but this is going to lead to vast sharpening of the conflict within the Left anyway.

Yes, these are huge losses to a conservatard, or anyone who was expecting a quick victory through a captured social institution. No such luck, but there is no reason for despair. Just push on.

If it were not too late, I would say the GOP needs to be disbanded and a real right wing party created.
Not only do they make bad legal decisions, but they also bring prestige to their philosophy which ends up in the law schools, in the clerks and in the bar. It is how lawyers, as a group, have moved so far to the left. They make academics look downright right wing in comparison.
