Score one for the concerned consumers

And it's a very big one. Patreon's core strategy from the start has been to try carving out an exception to the arbitrations it imposes upon all of its users in order to avoid paying the required arbitration fees. This strategy has uniformly failed, as evidenced by decisions by the arbitration company, the arbitrators, and even the Superior Court judge.

Now Patreon's attempt to avoid permitting the arbitrators to decide if its practices are deceptive and in violation of California law or not has been comprehensively shot down by the highest relevant authority. This means that its legal strategy has been a complete and comprehensive failure, as any informed observer could have told them it would be back in December when they implemented it.

Even the best lawyers are more cunning than intelligent. Patreon's appear to be neither. They can probably afford the highest quality coke though.

Patreon is a market.

That second "moon" we had was really just the first of the rubble bouncing.

At this rate NASA and all those commercial spaceship companies ought to hire Vox and the Legal Legion. 2 for 1 deal, contract law and orbital mechanics.

In related news, Castelia House's next hardbacks are being offered tastefully bound in Californian lawyer skin.

Might consider John Doe / Jane Roe aliases for the second and subsequent waves with identities disclosed under secrecy orders if to Patreon and its external firms at all, with arbitration tribunal approval of course. A group (and useful others) used those tactics successfully to push through upending judge-made laws, and still does, as it deploys a tactic to wreck livelihoods and lives of and sic mobs on non-anonymized people who stand up to it. It's gross and slimy, but using the enemy's moves and weapons against it may be necessary. It would be great to see costs and sanctions imposed for the rampant non-disclosure and settlement discussion disclosure violations. Maybe complaints down at the State Bar are in order.

Just checked my email for any updates and didn't find anything new. Are there any public records regarding this that we can review?

Slightly OT: Perhaps if Patreon were to take a leaf from Ben & Jerry's book and proudly announce their intentions to the world, there would be fewer complaints. There might also be fewer customers, but hey! That's the free market: "Ben & Jerry's says it is an ice cream maker which behaves like a social justice organisation. According to its former chairman Jeff Furman, the company 'sells ice cream to be able to fuel its advocacy'."
