Project Veritas busts CNN

 James O'Keefe has done it again:

CNN has reported Project Veritas founder James O'Keefe to police over his latest undercover investigation in which he secretly recorded network president Jeff Zucker's morning conference calls 'for months.'  

O'Keefe, 36, on Tuesday announced he was releasing audio recordings of several network meetings which he claims will 'expose' Zucker and other CNN executives expressing their 'political biases'. 

The calls O'Keefe had been listening to over two months are the network's daily 9am editorial meeting with senior staff from CNN's main bureaus, which is run by Zucker. 

The move by Project Veritas is the latest sting operation orchestrated against the news station by the conservative operative who has long-targeted CNN over claims of liberal and anti-Trump bias.

I don't think the police will be particularly interested, given the laws that govern phone call recordings. Project Veritas is based in New York and CNN is based in Georgia. And it's not an illegal wiretap to dial in to a conference call with the correct access code.

  • New York's wiretapping law is a "one-party consent" law. New York makes it a crime to record to record or eavesdrop on an in-person or telephone conversation unless one party to the conversation consents. 
  • Georgia's wiretapping law is a "one-party consent" law for purposes of making audio recordings of conversations. 
Unless O'Keefe kidnapped a CNN employee and drove him across state lines before torturing him to get the access code to the daily call out of him, it's unlikely that any crimes were committed.

I had a lot of people blunder into video or phone conferences, over the past 6-7 years; right time/wrong but valid code, or received meeting notification by mistake but dialed in because they thought they were needed. Could be a mistake PV took advantage of, or could be a CNN whistleblower..

They can get bent with that call to amenable authority. They made the rules of engagement, now they get to live by them.

Why shouldn't their editorial meetings be for public record? Certainly they have nothing to hide. Just doing the honorable work of figuring what is true and what the public needs to know and how they plan to present it. They should be broadcasting this live.

I was amused by Zuckers reaction to being called out. It was immediate canned corporate response to something said that is not welcome. I wonder how many of the people on the call recall being told "thank you for those comments" and realized what that really meant at the time.

If CNN had the opportunity to secretly record Oval Office meetings, I'm sure they would decline out of ethics.

Good job by O'Keefe. The Right is too handicapped by excess nobility. I was talking to a guy the other day who was saying we need to use the left's methods against them, using the Rules for Radicals. I was nodding along, and then he said, "Of course, we wouldn't break the law, but..." I sighed and stopped nodding. I get where he's coming from, and I'm not saying we should murder random leftists like Antifa did to that guy in Portland. But we have to be willing to get into grey methods no respectable Republican would use, like lying to infiltrate their networks, doxxing people and getting them fired, things like that. If we're too good do those things, that's a major disadvantage that has to be accounted for.

Long-term VD fan, first time UK poster here. Hoping for someone to clarify a few things for me:

If we pass the safe harbour deadline, does this mean that state legislatures or SCOTUS can overturn the ruling of the electoral college all the way up to inauguration date? Or does it completely nullify the electoral college process?

Should the electoral college vote on the 14th, when exactly are the official results released? I'm seeing both December 23rd and January 6th.

You know what could have prevented this? An insider not sneaking PV the phone number, meeting ID, and passcode to the meeting in the first place.

CNN has absolutely ZERO right to bitch and call in the cops on PV. They can take out the insider (preferably by some sort of shakedown of CNN and AT&T), if they even have an inkling of who it is, because that's about the only policy (internal or external) that I can see being violated here.

These people aren't exactly the sharpest knives in the drawer, are they?

The linked news article does not identify the "police" to whom CNN "reported" the fact of the recordings (which O'Keefe announced to the flustered Zucker via livestream). Nor does the article describe the nature of the "legal proceedings" CNN intends to initiate. Suffice to say that O'Keefe does a pretty good job of researching the legal issues before he throws the grenade. He's not afraid of being sued by CNN. If CNN does initiate litigation, I hope it's in a jurisdiction that awards all costs and fees to the prevailing party.
