The end of democracy

I make no claims about the accuracy of this report, which is supposedly a leak from a clerk for one of the Supreme Court justices.

I am a clerk for one of the Justices on SCOTUS. Today was like nothing we have ever seen. The justices are arguing loudly behind closed doors.

The Justices met in a closed and sealed room, as is standard.

Usually it is very calm, however today we could hear screaming all the way down the hall.

They met in person, because they didn't trust telephonic meeting as secure.

Chief Justice Roberts was screaming

"Are you going to be responsible for the rioting if we hear this case? Don't tell me about Bush v. Gore, we weren't dealing with riots then! You are forgetting what your role here is Neil, and I don't want to hear from the two junior justices anymore. I will tell you how you will vote."

Justice Clarence Thomas says "This is the end of Democracy, John."

When they left the room, Roberts, the Libs and Kavanagh had big smiles. Alito and Thomas were visibly upset. ACB and Gorsuch didn't seem fazed at all."

I am beginning to wonder if ACB and Gorsuch know that the President is not relying upon them to shoulder the burden of defending the Constitution. It may be that Kavanagh is the only traitor appointed by Trump. While I don't trust either of them, it is interesting to hear that a) they were opposed to Roberts's position and b) unlike Alito and Thomas, they were unsurprised by the Chief Justice's absolute unwillingness to hear the case.

But Roberts isn't afraid of rioting. He's afraid of his secrets and his corruption being exposed by his masters.

Justice Thomas is correct. One way or another, this is the end of democracy in the USA. We must hope and pray it is because the God-Emperor is going to cross the Rubicon.

Watching the short video of the GE at the Army-Navy game, he does not give the appearance of a defeated man. On the contrary, I think he has made up his mind already and is waiting for a series of checkpoints to be crossed. Thomas has always been one of my favorite judges (even more than Scalia). I guess I need to add Alito to the list of favorites. As for the rest, the coming fallout is upon their heads. What a bunch of cowards. At this point, TX should just select 200 electors and dare the other states to sue. The SC has already established the precedent that states do not have standing to challenge how another state handles its election.

Blogger B December 13, 2020 7:57 AM

ACB has lived in a refined bubble all her life. She doesn't have a clue about the storm that's coming. Roberts is just evil, but he doesn't think TGE would DARE. The 2 libs are commies of course and, if the clerk is real and to be believed, Kavanagh is a traitorous piece of Ivy League garbage.

What is sure is this: SCOTUS has lost the respect of half the country, more or less, and is now irrelevant. If they think their decisions will be honored from here on out, they should think again.

Blogger Unknown December 13, 2020 8:00 AM

Its the end of democracy because those now aware of the fraud will not bother to vote. Im already there and have been since 2004 and the implementation of diebold machines. A supposed leak, but it's plausible physically. Those buildings were designed for ventilation and retaining some coolness in summer, not for soundproofing. Been in similar conditions in another large, old building like that. If this was a reasonably accurate report, then it's sad confirmation that all decision in DC are not made with needs of the nation in mind, but the need to win this urination contest.

Barret and Gorsuch unfazed; they might be deeper strategic picks than expected, placed there to help with a reshaping. Another thought for why strict constitutionalists were placed high on the list: following the written document, the SC was the weakest branch and not a major activist for political gain.

Blogger Johnny December 13, 2020 8:49 AM

The only good reason they could have for not hearing the Texas case is if they have another one lined up, and it doesn't appear they do. And if they are genuinely afraid of rioting then they have their collective heads shoved up their collective butt holes. You don't repress violent behavior by rewarding it, as we can see before our eyes. It is the cities that withdraw police enforcement that get looted. Plus the rioting we are seeing is fake anyway. Sponsored and not that many people in the street once the initial looting runs out of stuff to be stolen.

There is a fallback in all this. If Biden gets in and they implement the claimed agenda, it is so financially unsound we could burn through our credit, and it won't take years and years. And trust me, saying "but they can print money" isn't a way out. If our government loses the "full faith and credit" on the currency, that could very easily produce regime change, and not by a constitutionally recognized method. People respond to circumstance, not to ideology, which is why the public is so calm about this stolen election.

Blogger Unknown December 13, 2020 8:52 AM

I'm torn on this one. Of Trump's SCOTUS picks I had always pegged Kavanagh as the one most likely to go "Roberts" on us. That said, I can't believe after what that bitch did to him during the confirmation hearings that Kav would be A-OK with Heels-Up Harris as POTUS.

I also get the impression that Kav is not a man who likes to be bossed around by anyone, much less a lightweight like Roberts

So my alternative hot-take is that it's Kavanagh and his clerk who leaked this because he, like ACB and Gorsuch, knew TGE was never relying on the courts to save the Republic and that he gets to toss Roberts under the bus in the process.

The only thing I have in support of this is that if Kavanagh's vote was already in Roberts' camp why would the CJ need to throw a hissy-fit at Thomas, Alito, and Gorsuch? He would basically just say "It's 5-4 against taking the case, we're done here."

IMHO only a traitor would ever suggest that negotiating with terrorists is the way to get peace, prosperity and law and order.

By that line of thinking, the underlying message to Patriots is that the way to get what you want is to simply riot harder than the enemy, which is what the rootless international cabalistic clique wants everyone to think and do, because the more chaos in the West the more the cabalites can plunder it without repercussions before they move their operations to Asia after they destroy the West and its People.

I had though Kav was a liberal plant. The ferocity of the attacks on him was so over the top I figured that was the only possibility. Roberts has been known to be compromised for years and Kav's first ruling siding with Robert's confirmed what i believed about Kav. Alito and Thomas being upset is a good sign. right now we have only two constitutionalists..Thomas and Alito. Doubtlessly a Rubicon was crossed. They are not even pretending to have elections anymore, and won't pretend again.
Changing this situation through legitimate means is not realistic anymore; we're on the path that will lead to horrible violence and dissolution. For all that the founding fathers wanted to emulate Rome, they didn't even get to the Imperial phase before their experiment came crashing down.
The one realistic option i see now is building the remnant, a community that will survive the new dark ages.

This does not sound authentic. I can believe that it got heated, but I don't believe Justice Thomas would have raised his voice to the point that he could have been heard outside the room. I don't think he shouts in such situations.Nor can Roberts tell anyone how to vote (and the vote is not published - we only know there were not four who voted to take it).
But thus far the entire judiciary has refused its duty. Not a single court of significance has addressed substantive factual or legal issues. No evidentiary hearings have been held. Only one intermediate appellate judge in PA addressed legal arguments relating to constitutionality of mail-in PA ballots and she was shot down by a corrupt PASC and SCOTUS refused to stay the order (with cert pending on the slow track).

Not mentioned in all of this is Thomas and Alito stating even though they voted to hear it they would not have done anything to "overturn" the election. No matter what happened the SC was not going to be the way this situation gets rectified.

Justice Thomas is correct. One way or another, this is the end of democracy in the USA. We must hope and pray it is because the God-Emperor is going to cross the Rubicon.

If this report is true, Trump has no choice but to cross the Rubicon.

People argue loudly, scream and a yell at each other when the stakes are high. When pearl clutchers hear it, they get all wild-eyed and panicky and claim it's "inappropriate" and "disturbing".

This story has the ring of truth, and in being present for lots of what would be called "disturbing" confrontations in my professional dealings, I largely believe it.

The bit about Thomas properly seals it. That is precisely how he acts.

It never ceases to amaze me how some very smart people manage to confuse their responsibilities with the responsibilities of others. It's not Robert's job to worry about riots, so why is he "concerning" himself with that? Vox's explanation illuminates why people stop worrying about their duty... It's because they are worked about themselves.

I'm still sticking with, "this is beyond a matter of “law”, the states lack of standing could refer to treason, insurrection, and rebellion." Art. III, Sec. III. and the Insurrection Act. And I am sure, the evidence by the Intel White Hats will be devastating. Remember Trump's election EO 2 years ago. He didn't create it, sign it, just to sit on it. This was an active operation, and we have to assume that this operation of 2 years had all it's ducks in a row.

And you have to remember, these traitors have nothing to lose, except prison, hanging, and a bullet. And there will be much gnashing of teeth. See: The apotheosis of evil.

Thomas has always been my favorite as well.

Many people don’t know that while Scalia was a very good justice, he and Thomas frequently disagreed on one thing, Stare Decisis. Scalia was much more in favor in allowing the decision to stand. Thomas on the other hand has always believed that when a past court made a bad decision, it was his duty to right that decision and bring it in line with originalist interpretation.

Having said that, if Scalia were alive today, I believe he would have sided with Thomas and Alito. Or course it would have still meant the case wouldn’t be heard, but I just can’t fathom him not accepting the case.

Someone help me out, what power does the -chief- justice have over the votes of the others? Isn't that role just to basically run/organize the meetings?

After all, I'm sure this was far from the 1st hissy fit they've witnessed at this point in their careers. Aren't they all appointed for life and could just tell him to pound sand?

I am not a lawyer but I work with and around judges every day at the state level. And while a few people have spotted this comment about Roberts and pointed it out as not ringing true or something, to me it is the most credible part of the account.

Judges are people and I have witnessed many a meeting between judges and there is always a hierarchy, just like VD's SSH, or any other ad hoc hierarchy. Rules and laws be damned, they're still humans and they still organize like the pack hunters we all are somewhere deep in our brains. They can't help it, just like we can't.

Roberts may or may not have any actual authority. But he's the Chief Justice and if he wants to push his weight around, little will stop him. That's why it doesn't surprise me that Thomas and Alito would care less about his authority, official or not. And it doesn't surprise me that junior members would fall in line. He may be 'cucked' to us, and certainly compromised. But does that hold any weight when its likely most of them are cucked and compromised in some way? Roberts: Alpha-cuck.

I'm not sure if the whole thing is true but that one part rang especially true, especially likely, to me.

Blogger Chip Hazard December 13, 2020 11:43 AM

Again, I write the "ring of truth". I don't think this episode went according to this report exactly, as it also reads like Kabuki.

It seems as if it it is more a composite; bits and pieces taken from several different occasions leading up to the account.

Thomas's statement, though dramatic, seems factual, either written or uttered quietly.

The histrionics, though plausible through the cultural outlook that many Liberals and Leftists adopt, is more of an attitude than a shouted exclamation. The smiling seems to be made up out of whole cloth.

This seems to be a composite account taken from multiple episodes; statements in public, private and written within chambers and in confidence, but reads as if generally true, if not entirely factual.

He's A-OK with it because it was all a farce in the first place. The guy was a Bill Clinton whitewash clerk at DoJ back when the Vince Foster Whack was being buried by the "Republican" Starr Report. That Kavanaugh would be a deep-state shitweasel had to be a foregone conclusion to Team Trump when he was chosen, and the best theory I have at the moment is that it was his deliberate intention to stuff the high court with flagrant traitors in order to demolish it during the third act.

Caval RINOs are always running on the promise that, "this time", they'll appoint some real conservatives to the supreme court, who will then finally unravel the corruption. Trump is exposing that for the lie that it is, and always has been. Nobody gets promoted in the swamp unless they are thoroughly control-filed.

And you have to know that something fishy is up with Amy and her Haitian* rugrats brigade.

We don't know if it was 7-2. Had it been 5-4 the court would have heard the case. The vote was not announced. IMHO SCOTUS has failed. This would have been the perfect vehicle. I fail to see how Texas failed to state a cognizable claim of harm under the Electors Clause.

Blogger Timmy3 December 13, 2020 12:25 PM

Did SCOTUS change the precedent that a state has (no) standing to bring a lawsuit against another state? Trump needs to signal that riots will be handled and the SCOTUS should butt out of executive decisions. Separation of powers. All branches of government are encroaching on their territories. Maybe it’s time for the executive to take judicial power. Each branch is tasked to uphold the Constitution. If Roberts is blackmailed, it needs to be exposed.

WE already have rioting. In some places the rioting has been going on (daily) much more than the seven months since the drug suicide of George Floyd. Riots are not what Justice Roberts is worried about.

Justice Roberts is worried because he knew if the Court heard the case (at all), there would be only one way they could decide and then what would be the ordered remedy? Roberts knew that this case would put everything political in the laps of the justices to decide.

Perhaps Roberts knows no matter how they rule, civil war in this country looms as a real possibility and he wrongly believes that he can play Pontius Pilate. Roberts is Catholic. He has heard the story. How Pilate washed his hands of the matter, hoping to placate the mob, while keeping his own skirt nice and starched, by allowing an innocent man be condemned to die on the cross. I find nothing wrong with this man has become they have no standing to sue. John Roberts has become Pontius Pilate and what he has set in motion can no longer be stopped. He was the last man to have a civil answer.... and his answer was to brush it away to placate the angry Leftist mob.

"We need a new court or a new system. One free from kompromat."

No, the problem is the people within our system. The "system" canard is pushed by people in power to divert responsibility away from whom it actually lies, which is them. Other diversions are they are stupid, inept, cowardly, or made a mistake. When their financial and/or power interests are at stake suddenly they have balls the size of a small state and get shit done real quick. Marxists especially like the critique of the "system", as that really means they want to replace the current form of government with first Socialism and eventually Communism where their power is centralized and not diffused. The problem is with the individuals in the system that are corrupt or worse. Not to say their aren't some demagogic morons in there, such as AOC, but for the most part they are relatively intelligent--although not at the genius level in most cases--and hide behind these types of diversionary tactics to hide the true reasons and intentions for their actions. They don't care if people think they are "stupid" or the problem is with the "system", in fact they prefer over people holding them to true account.

There's an oddly biblical quality to the whole rotten thing. This “decision” is gross and rank Phariseeism because, by denying that they had original jurisdiction in the Texas complaint, the Super Supremes (performing without Diana Ross!) have pretended to follow the letter rather than the spirit of the law (“The Sabbath was made for man, not man for the Sabbath”), although in fact they have followed neither. Instead, they have made a decision not to decide, which is a decision in and of itself.

Instead of following the commonsensical “wait two days” injunction, I reacted immediately with dismay and outrage. But now, the customary two days having passed, I can see clearly that this decision is simply Phariseeism. The Super Supremes have twisted the Constitution by simply ignoring it, so their decision not to decide is downright Talmudic (“Oh, yes, we have original jurisdiction but, oh, no, we don't have original jurisdiction!”). So they have shown themselves to be “scribes and Pharisees”; “hypocrites”; and “a generation of vipers.”

But the Pharisees of old at least pretended to follow the law. These modern-day Pharisees don't even do that, as witness Obergefell and many other rulings that had “dwelt in darkness” before the Super Supremes, having “seen a great light,” discovered formerly unknown “rights” lurking in the Constitution's mysterious and invisible “penumbra.” And what could be more Pharisaical than that?

Therefore, I shall never again refer to them as “the Supreme Court” or “SCOTUS.” I shall call them what they are: Pharisees. And when the Roman legions show up to destroy the temple-like building in which these Pharisees “live and move and have their being,” not, I trust, leaving “one stone upon another,” I hope that the Pharisees do not escape the fate that they so richly deserve because they did not recognize “the hour of [their] visitation.” Then, at least, their hideous and repellant temple sacrifices of our people will stop. Heretofore, their temple sacrifices have been bloodless ones, but their inaction-as-action must now turn those bloodless sacrifices into bloody, and therefore Levitical, sacrifices.

Justice Roberts would do well to remember the poem of Martin Niemöller, who lived to regret his inaction when Hitler began to round up his enemies.

First they came for the Jews
and I did not speak out
because I was not a Jew.

Then they came for the Communists
and I did not speak out
because I was not a Communist.

Then they came for the trade unionists
and I did not speak out
because I was not a trade unionist.

Then they came for me
and there was no one left
to speak out for me.

In what delusional world does Robert's imagine that in the end the Left will leave him alone, if he just goes along with them now? They will send everyone to the wall who was part of the Republic they hate, even many of their own. If the symbolism of executing its representatives serves their purpose, they'll do it in a heartbeat.

Chief Justice Roberts needs to learn that in order to save the house you have to put the fire out while it can still be contained. You don't wait until it has you cornered in your third story bedroom with no exits left and nowhere to flee.

Blogger MarkyMark December 13, 2020 4:38 PM

What can Cheif Justice Roberts DO though? What kind of real power does he have to compell the associate justices to vote a certain way? We can see how the House Speaker or Senate Majority Leader can twist arms, as they often control fundraising; if a member doesn't vote their way, no reelection money for them. Roberts can't do that, because all the SCOTUS justices are appointed, and they're on the bench for life; they don't need Roberts to do them any favors. IOW, Roberts can huff and puff all he wants, he has no real LEVERAGE over the justices.

Indulging on your sectarian antipathy doesn't offer much explanatory utility in the present matter.

Alito is also a "papist" and Thomas is a "revert" to Catholicism. Gorsuch is an apostate and has already become Trump's William Brennan, and if you do a little research on the church he attends/attended -St. John's Episcopal in Boulder Co, you'll see why Bostock v. Clayton County should have been no surprise. The real question is when he does a 180 on 2A.

This is a better explanation of the SCOTUS and it is from 2012. I guarantee that Gorsuch, Kavanaugh and Barrett have worsened these deficiencies.

"the Roberts Court Justices have spent more pre-appointment time in legal academia, appellate judging, and living in Washington, D.C. than any previous Supreme Court. They also spent the most time in elite undergraduate and law school settings. Time spent in these pursuits has naturally meant less time elsewhere: The Roberts Court Justices spent less time in the private practice of law, in trial judging, and as elected politicians than any previous Court. The article argues that the change is regretful for multiple normative reasons, including the way these experiences lead to legal complexity in Court decisions, the lack of litigation or trial experience on the Court, and the lack of what virtue ethics calls “practical wisdom.”"

I despise the decision not to accept the case as gross dereliction of duty; but I'm not sure that it if it were accepted, we would have received an informed decision. My life in finance has occasionally brought me into contact with lawyers, and they USUALLY have no interest or competence in numerical matters. Law degrees don't require statistics or calculus; not only are lawyers not especially math savvy; they don't have the basic quantitative instincts that Larry Correia used two days after the election. They dismiss such things as petty or ephemeral. It's no accident that so many courts can't see the problem.

Unfortunately, we all, including the President overestimated the value of a Federalist Society imprimatur in staffing the same circus with better clowns. I am amused that Politico had an article some time back sounding the alarm about the FS moving the judiciary to the right. (John Roberts was a member).
