Impeachment 2.0

 Did the media forget to tell Congress who is supposed to be the President? Notice that they are charging "President Donald Trump":

House Democrats walked across the Capitol Monday evening to hand-deliver an article of impeachment to the Senate charging President Donald Trump with 'incitement of insurrection' - formally beginning his second impeachment trial.

With solemn expressions on their faces, the House impeachment managers made the journey less than three weeks after a MAGA riot ransacked the Capitol during the electoral count after Trump told supporters to 'fight.'

In an event carried live on cable news, the managers left Speaker Nancy Pelosi's office at 7.01pm, crossed Statuary Hall and the Capitol Rotunda – some of the same spaces that were invaded by the mob less than three weeks ago.

Outside thousands of National Guard troops remained deployed around the Capitol which the MAGA mob had stormed on Wednesday January 6.  

House Clerk Cheryl Johnson led the nine House managers to the Senate, where Trump's second impeachment trial will be held. Johnson and all of the managers wore dark masks for the walk.

It was history repeating itself - with a COVID twist: On January 15 2020, nine Democrats had walked the articles of impeachment for his first trial to the Senate. It ended in his acquittal.

I just read the article, and it just says "Trump"; "President" is not there. In the byline, it says that it was published at 1911 EST, and it was updated at 1935. It's possible that they changed that part of the article. In any case, as of 1946 EST as I write this, it just says "Trump".

After reading comments here since the beginning, the last 3 months have convinced me to eliminate a phrase from my vocabulary.

I will make triple sure that I never say "I hope I'm wrong about this, but".

I remember saying it to someone about three years ago, I hope that was the last time. It displays lack of confidence and reveals gamma tendencies by leaving a way out if you're proven wrong by events.

Retroactive impeachment. Don't know if it's constitutional in the U.S., but, for historical reference, Robert Clive and Warren Hastings both vindicated themselves in impeachment proceedings after they resigned their offices as Governors-General of Bengal. 1772 and 1785 respectively.

@2: Not really. Until recently, it was custom that ONLY the sitting President was addressed as such. Theodore Roosevelt was quite firm about it...after leaving office, he'd claim the title of "Colonel", but never "President".

I'm waiting for Trump to be acquitted...then thank the Congress for recognizing him AS President. And then order the National Guard to turn the usurper out of the Executive Mansion. Hoist the Dems on their own petard.

Yeah, I laugh about this, but ...
Constitutionally, Roberts must preside over an impeachment "shall preside". Therefore, this action is not an impeachment, regardless of what MaligNancy calls it.
A Congressional impeachment and conviction can remove an office holder, and after removal, the former office holder may be exposed to State criminal charges IMO for actions not taken in the course of service in his office.
Alcee Hastings was impeached and convicted, but not charged under State laws, and has since been elected and reelected to Congress.
As I recall, we have convicted felons serving in Congress, as well as attorneys who have resigned ahead of disbarment actions (hi Hellary).
What the Demonrats arevseekingnis a Bill of Attainder, to try to neutralize Trump, and more specifically, to try to stop the groundswell of patriotic anger that he was frontrunning.
He did not create our anger, but hd did remind us that we were neither alone, nor wrong in our vision for our nation.
The Demonrats will try to, and probably succeed in, limiting the evidence Trump is allowed to bring in, but I think that his first motion should be a 12(b)(6), that the Demonrats have failed to state a claim upon B which relief may be granted.

Going to be very entertaining watching them explain in minute detail all about the algorithms.
Data storage, software security.
Watching State officials explanation of machine storage and access.
How or who determined that the software was of acceptable quality.
Has data or software been accessed since the election.
Is it verifiable that existing data hasn't been altered?
And the inevitable possiblity of data corruption being possible.
Very entertaining stuff indeed.
Might not be the most appropriate course of action.
Mind you all of this should have been addressed a long time ago.

Article I, Section 3:
"The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two-thirds of the Members present. Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States;"

I guess Roberts' argument is that since Trump's no longer President, the Chief Justice is not required to preside. It's only in trials of the President that the Chief Justice presides. I could see arguments either way: That because the impeachment deals with his actions as President, the CJ should preside or because it's after the fact, he shouldn't.

There is precedent, in the impeachment of Sec. Belknap, for impeaching an official after leaving office. Some Senators at the time disagreed and voted against conviction on those grounds, which I expect many GOP Senators to do now, to avoid taking a stand on the issue.
The precedent is also that a conviction automatically removes the official from office, but that disqualification from future office requires a second vote - a simple majority this time. That was not done in the Alcee Hastings case, which is why he was able to be reelected to Congress.
