An interesting idea

Apparently France permits lawsuits against tech companies breaching their own terms of service:

Reporters Without Borders (RSF) has launched a lawsuit against Facebook in France, accusing the social media giant of breaching its own terms of service by allowing hate speech and misinformation to spread on its site.

The media watchdog group took the step to challenge Facebook over what it described as “misleading commercial practices” and a “massive proliferation” of problematic content on the company’s platform.

The legal action focuses on a section of Facebook’s policies that pledge to provide “a safe, secure and error-free environment” for users but RSF argues that hate speech and false information mean that the company is in breach of its own guidelines.

While the lawsuit has been filed in a French court, the group has named Facebook France and Facebook Ireland, as the Irish side manages some of the actions of the French branch.

If a court agrees that Facebook has engaged in “misleading commercial practices”, the company could face a fine of €1.5 million ($1.79 million), which can be increased to 10% of the company’s average annual revenue over a three year period. 

I wonder if there might happen to be any other tech companies operating in the European Union that are engaged in misleading commercial practices that breach its own terms of service by allowing content for which it claims to have "zero tolerance"?

When one cabal entity sues another, it's months worth of free advertising for both, money-sloshing, and promotion of tax-fed government legal-eagles handling the case.

This lawsuit was brought about by a cultural misunderstanding. In the US, the term "zero tolerance" means zero tolerance for any behavior that those in power choose to ignore.

Those out of power right now would LOVE to file some lawsuits in French courts if this thing goes forward.

So Facebook has taken upon itself the role of "Speech Police," and now some other leftist group decides they want a piece of that pie and are trying to force Facebook to follow what *they* define as offensive speech.

Something tells me this is just going to result in even greater censorship, not less, but it's still amusing to see the Left purity spiraling into irrelevance. "You're not censoring ENOUGH!" It will never be enough until people literally can't post ANYTHING without offending someone and getting banned. At some point, even typing in the English language will be deemed "racist toward non-English speakers and reminiscent of colonial oppression."

The revolution always eats its own. I need more popcorn.

Right? But, then, I remembered. They lost half their virile eligible young men in WWI. Then lost half that same population in WWII. Yea. Between the women not wanting to lose their sons and the better men, and young men seeing no real good to some things? I... sort of get their point.

The Brits, with a monarchy, and aristocracy crushing down them, seem like mules to mares, willing to take all abuse, and just die on command. But the French lost their heads... in more ways than one. So have no sense of duty to dying on some jerks command.

I believe that it was Scott Adams on his blog who said that at the fundamental level everything depends on what the insurance companies say. A few ruinous lawsuits that drive up the rates paid by our hypocritical, arrogant, Webster robber barons would be an appealing development indeed.

This is a tough one, maybe because my old habits of thought die hard.

On one hand the intent here is surely to push for MORE censorship and silencing if right wingers and un-PC skeptics.

OTOH it makes perfect sense in an Alinsky "make the enemy live up to their own rules" way.

I think it alleges they are not censoring as hard as they said they would.

They can stop claiming to have a zero tolerance policy, or they can really have a zero tolerance policy. Neither option is going to support the Narrative in the manner to which they have become accustomed.

This law can be leveraged the other direction.

Wait for a ruling, then go back and sue facebook for breaking the same TOS by banning TRUE posts about Gender Dysphoria, campus rape statistics, and black crime statistics.

Let this ping-pong back and forth enough and suddenly these terms of service will vanish, and so will the censorship.

You could say the exact same thing about Canada. Guess how many times those laws "in place for everyone" end up helping white men? Laws are tremendously over-rated compared to the actual enforcement of the law. Especially the ones concerning racial discrimination and hate speech - which is never far from any conversation involving "privacy."

After Pateron's debacle I am dubious that many of those TOSes are even legal. For example, there are explicit exemptions to the arbitration clause making it illegal in some countries.

After people make a few judges pay the price for getting it wrong, the rest will be too afraid to make the same mistake.

Judges MUST be held accountable, if need be, with their lives.
