Policing off-platform behavior

The legal stupidity of the new Twitch policy on off-platform comportment should be easy to understand on the basis of the idea that it assumes bloggers like me have the right to police your behavior away from this platform if you agree to this blog's contract of adhesion by leaving a comment here.

On Wednesday, Twitch announced an expansion of its Hateful Conduct and Harassment Policy that takes into account behavior taking place off of the platform. A blog post from the company shared that the it is bringing on a “third party investigative partner” to support Twitch’s internal team with investigations, and to help enforce off-platform violations.

Per Twitch’s post, the new partner is an “experienced investigations law firm” that will help the company to “more thoroughly investigate and respond to reports of off-service misconduct.” In addition to adding sheer numbers to the team that investigates incident reports, the post also shared that there will a dedicated email address for people to report “egregious, off-service misconduct.”

While disciplining users for off-platform behavior isn’t new to Twitch — inappropriate behavior off the platform has led to bans since 2018 — this addition will beef up existing policies that the company started enforcing in Jan. 2020. Prior to the announcement, it was unclear how the company would address off-platform violations.

The problem, of course, is that virtually no one is willing to stand up and fight these anti-consumer abuses by corporations, despite the best efforts of the state legislatures to hand them effective weapons to do so.

Consider me skeptical, but the whole thing sounds like a scare tactic, especially given the risk of uncontrolled cost escalation when the "investigative partner" finds/plants villainous villains in almost every comment thread.

A lot of these things start as scare tactics or trial balloons, but if some people bow to them and no one pushes back, they tend to develop into real policies over time, and establish the foundation for the next extreme to be presented as a scare tactic. Thus the ratcheting effect.

The first time someone said "respect my pronouns," it was probably a late-night Jewish comedian, and everyone laughed at how ridiculous that was. Something that crazy could never become actual policy, and when it started to, everyone assured themselves it was only at wacky liberal colleges, so they didn't haave to worry about it. Then one day they look around and reasonable people are being fired for saying "he."

Really seems like Big Tech is creeping ever so closer and closer to some sort of social rating system like China uses to control their population. But this is American Capitalism, so instead of a single social score (government), we will have several to pick and choose from (FB, Amazon, Google, etc).

It does, you just have o understand the nature of power and authority.
You see, as Jesus said "the servant is not greater than the master, nor does the messenger have more authority than the one who sends" — and this is so true that nobody is going to disagree, and it is also applicable here: you see, the articles of incorporation are in some state (typically Delaware, for tech companies, IIUC) and are under that State's authority. Now if that State does not have the power to (e.g.) disbar the people from weapons* then how can it be that the thing created under that State's powers, the corporation, can?
It's all sleight of hand there.

The policy is for popular streamers who wander too far off onto the Right Wing Reservation. Can't let the enemy have even one source of validation, even though Leftys currently make up most of the pop culture commenter community already. What this will do is cause more content creators to compartmentalize their output - have their gaming stuff on the major platforms, then make an anonymous avatar not connected to their identity to comment on "alternate news media" sites and forums. This will drive Right Wingers underground and radicalize them even more. This is where the "And then suddenly, for no reason whatsoever, Germany voted Hitler into power" meme comes from. Of course Hitler's ascension came as a surprise to the Weimarists and Jews in Germany at the time, as they couldn't think of anyone within their circles who voted for him.

Harass all of your political opponents, and they'll go into the shadows. When you and your policies fail, they'll come back from the shadows more powerful than ever to take over. You'd think with how many times this exact same scenario has been portrayed in popular fiction, the Left Wing would understand it, and do their best to de-legitimize their foes by giving their enemies a platform to rant and rave on so ordinary people may see them for the madmen they are. But then, to do that, the Leftists would have had to create a well-functioning, comfortable society that provides for all of the needs of its citizens, and the Left isn't even remotely interested in doing that. I'm munching on popcorn reading all the comments mentioning Twitter when the OP clearly reads "Twitch".

Twitch is a streaming platform popular with game streamers. It was bought out by Amazon a couple years ago, so falls under Bezos' purvue. Think Amazon's livestream platform. They don't (and don't try) to act as a YouTube, Twitter, or Facebook competitor.
